The City has expressed an interest in annexation in the past, (ref. 8-14-95 City Commission meeting). CONSIDERATIONS: · The owner of the subject property has requested annexation into the City. · The applicant is the sole owner of the 2.5 acre property. . The City has expressed an interest in annexation in the past (ref. 8-14-95 City Commission meeting). · The City has the capacity to service the property with sewer and water, as well as provide the other urban services it currently provides to other areas of the City. The property owner was infonned he would be required to pay for extending the sewer and water lines to his property. · Th adjacent parcel (Battle Ridge) on the east side and north side of the property is indicated as "Low Density Residential" (1.1 - 3.5 DU per acre.) on the City's Future Land Use Map. The parcel on the west side (Wofford/Slappey) was recently designated "Commercial", after annexation, on the City's Future Land Use Map. The parcel on the south side of S.R. 434 is designated "Low Density Residential" (1.0 - 3.5 DU per acre) on Oviedo's Future Land Use Map. . The adjacent parcel (Battle Ridge) on the east and north side is indicated as R-IA "One Family Dwelling District" (8,000 sq. ft. minimum lot size) on the City's Zoning Map. The adjacent parcel on the west side of the subject property is indicated as C-l "Neighborhood Commercial" on the City's Zoning Map. The parcel on the south side of S.R. 434 is indicated as R-l "Residential" (8,500 sq. ft. on Oviedo's Zoning Map. . The City Commission held a first reading of Ordinance 746 on October 11, 1999. STAFF RECOMMENDATION TO THE CITY COMMISSION: Staff recommends the City Commission approve the second reading and adoption of Ordinance # 746 based on: 1. The findings indicated above~ 2. Previous expressions of interest by the City for annexation~ IMPLEMENTATION SCHEDULE: The City Commission would hold a public hearing for second reading of Ordinance 746 on October 25, 1999 and adopt Ordinance 746 to annex the 2.5 acre parcel. COMMISSION ACTION: CDD/1O/19/9918:33 AM ) ORDINANCE 746 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, FLORIDA, ANNEXING A 2.5 ACRE PARCEL OF LAND LOCATED ON THE NORTHSIDE OF STATE ROAD 434, SOUTH OF THE BATILE RIDGE PROPERTY, AND EAST OF THE WINTER SPRINGS EXECUTIVE PARK PROPERTY; PURSUANT TO 171.044(1)(2) AND 166.041 FLORIDA STATUTES; PROVIDING FOR SEVERABILITY; CONFLICTS AND AN EFFECTIVE DATE. WHEREAS, Mr. Robert G. Lamoureux, the owner of the following described ) property, has petitioned the City of Winter Springs to be annexed into the City, WHEREAS, annexation of tllls parcel is consistent with Chapter 171 Florida Statutes. WHEREAS, the City can better provide sewer and water service and other urban services to the subject parcel than the county. SECTION IT - If any section or portion of tills Ordinance proves to be invalid, lmlawful or unconstitutional, it shall not be held to invalidate or impair the validity, force or effect of any other section or portion of a section or subsection or part of this Ordinance. SECTION ill - That all Ordinances or parts of Ordinances in conflict herewith are hereby repealed. SECTION IV - Tllis Ordinance shall take effect immediately upon adoption, in accordance with 166.041(4) Florida Statutes and Section 4.15(c) oftbe City Charter. Battle Ridge will be developed as a 110 unit single family residential subdivision with central water and sewer service as well as the other city services provided to the other residents and businesses inside the City. The City would like to invite you to consider including your property within the City of Winter Springs with full urban services provided to you. These services include: J. .. City water ..
