Authorization REQUEST: The Community Development Department-Code Enforcement Division requests the City Commission hold a public hearing for the first reading of Ordinance #750 to amend the City Code that deals with the keeping of animals in residential areas. PURPOSE: The purpose of this agenda item is to hold a public hearing for the first reading of Ordinance #750 which amends Section 4-2 of the City Code that deals with the keeping of animals in residential areas. APPLICABLE LAW AND PUBLIC POLICY: The current regulation prohibits a resident from keeping more than 2 dogs and 2 cats at their residence without permission from the City Commission. At the October 11, 1999 meeting, the City Commission directed staff to revise this regulation. CONSIDERA TIONS: . The City Commission on October 11, 1999 instructed staff to draft an amendment to the code that deals with the keeping of animals in residential areas. This change to Section 4-2 will take effect upon adoption of Ordinance #750. FUNDING: nla STAFF RECOMMENDATION: Staff recommends the City Commission hold a public hearing to approve the first reading of Ordinance #750 to amend Section 4-2 dealing with keeping animals in residential areas. Once pennission is obtained from the city cOlrunission, additional dogs or cats may be maintained in the same household until such time as a public complaint is registered against their domicile or maintenance. The city cOlmnission shall have the right to revoke the granting of this special exemption as set forth above at any time. SECTION II - Conflicts. All Ordinances in conflict with the provisions of this Ordinance are hereby superceded and tlns Ordinance shall prevail. SECTION ill- Severability. If any words, phrase, sentence or portion of this Ordinance is stricken by a Florida Court of competent jurisdiction, all other terms and conditions of tlle Ordinance not specifically stricken shall remain in full force and effect. Animal control and protection ordi- nance of Seminole County, Florida, adopted. The city hereby adopts by reference as though fully set forth herein the "Animal Control and Protection Ordinance of Seminole County, Flori. da," County Ordinance No. 74-8, and all amend- . ments and additions thereto except as otherwise provided in this chapter. (Code 1974, S 4-1) Sec. 4-2. More than two dogs or cats prohib- ited; exception. ORDINANCE NO. 750 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF WINTER' SPRINGS, FLORIDA, REPEALING SECTION 4-2, DEALING WITH THE KEEPING OF ANIMALS IN RESIDENTIAL AREAS. PROVIDING FOR CONFLICTS, SEVERABILITY AND AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF WINTER SPRJ[NGS, FLORIDA, AS FOLLOWS: SECTION I - Section 4-2 of the City Code, attachment B, is hereby repealed in its entirety. SECTION II - Conflicts. All Ordinances in conflict with the provisions of tins Ordinance are hereby superceded and tins Ordinance shall prevail. SECTION ill- Severability.
