Florence, 101 N. Bombay Ave., to obtain permission of the Commission to have more than two dogs at his residence, as per Section 4-2 of the Code of Winter Springs. PURPOSE: The purpose of this agenda item is to request the City Commission consider the request of Mr. Florence to have more than two dogs at his residence. APPLICABLE LAW AND PUBLIC POLICY: Section 4-2 of the Code of Winter Springs prohibits any household in the city to own or contain more than two (2) dogs and two (2) cats without the express consent of the City Commission. CONSIDERATIONS: The City received an anonymous complaint on September 16, 1999 regarding the number of dogs Mr. Florence has at this residence. Upon notification of the violation, Mr. Florence expressed the desire to appear before the City Commission and request permission to keep more that two dogs. Mr. Florence has three adult dogs and four puppies at his residence on Bombay Avenue. He would like to keep the adult dogs and an additional puppy for a total of four dogs at his residence. Animal control and protection ordi- nance of Seminole County, Florida, adopted. The city hereby adopts by reference as though fully set forth herein the "Animal Control and Protection Ordinance of Seminole County, Flori- da," County Ordinance No. 74-8, and all amend- . ments and additions thereto except as otherwise provided in this chapter. (Code 1974, ~ 4-1) Sec. 4-2. More than two dogs or cats prohib- ited; exception. No household in the city shall own or contain more than two (2) dogs and two (2) cats without the express consent of the city commission. Once permission is obtained from the city commission, additional dogs or cats may be maintained in the same household until such time as a public com- plaint is registered against their domicile or main- tenance. The city commission shall have the right to revoke the granting of this special exemption as set forth above at any time. (Code 1974, ~ 4-2) Cross reference-Zoning, Ch. 20.
