PURPOSE: The purpose of this agenda item is to request the Commission waive building permit fees estimated at $2,645.00 for the rehabilitation of the residential units in the Moss Cove Project. APPLICABLE LAW AND PUBLIC POLICY: Section 6-51. Inspection and permit fees, On all buildings, structures or alterations requiring a building permit, a fee shall be paid in accordance with the fee schedule adopted by resolution #771 of the City Commission adopted November 13, 1995. (Code 1974, ~ 5-29) Section 12.01. [powers generally]. As provided in Article VIII, Section 2(b) of the State Constitution the City of Winter Springs shall have the governmental, corporate and proprietary powers to enable the city to conduct municipal government, perform municipal functions and render municipal services and may exercise any power for municipal purposes except when expressly prohibited by law. CDD/September 30, 1999/3 :29 PM OCTOBER 11, 1999 CONSENT AGENDA ITEM F Page 2 CONSIDERATIONS: · The City has identified a need for revitalizing certain targeted areas within the City limits. The acquisition, rehabilitation, and conversation of apartments to condominiums will upgrade the appearance and value of the neighborhood and also provide housing for low income buyers. · The total number of units to be rehabilitated is 158. · The City has formed a public-private partnership with Wyman Fields Foundation, NationsBank, and the Seminole County S.H.I.P. Program. · Wyman Fields Foundation has extensive experience in these matters. A proposal to the City for rehabilitating the apartment complex in and around Lori Ann Lane was approved February 22, 1999. · On April 26, 1999 the Commission received an update on the Moss Road Redevelopment Project from Wyman Fields Foundation. FINDINGS: I). The City Commission is authorized in Article xn Section 12.01 to express any power for municipal purposes except when expressly prohibited by law. 2). The Commission has entered into a public-private partnership with Wyman Fields Foundation to acquire, rehabilitate and convert the 158 apartment units in and around Lori Ann Lane to condominiums. 3). Wyman Fields Foundation in a letter dated September 14, 1999 requesting the Commission waive building permit fees for the Moss Cove Project.
