Authorization REQUEST: The Community Development Department-Code Enforcement Division requests the City Commission consider offering commercial vehicle limited term parking permits for an extended time. PURPOSE: The purpose of this agenda item is to request the Commission consider offering commercial vehicle limited term parking permits for an extended time. APPLICABLE LAW AND PUBLIC POLICY: On June 28, 1999, Ordinance 721 was adopted to redefine and restrict commercial vehicles in residential areas. A limited term parking permit was made available for certain vehicles until August 31, 1999. CDD/September 17,1999/4:08 PM SEPTEMBER 27, 1999 REGULAR AGENDA ITEM A Page 2 CONSIDERATIONS: · The City Commission adopted Ordinance 721 on June 28, 1999 restricting and regulating the parking of commercial vehicles in residential areas. · The City Commission established a deadline of August 31, 1999 to obtain a limited term parking permit. · As of August 31, 1999, twenty-nine (29) limited term parking permits have been issued. · Several residents have requested a limited term parking permit after the deadline. · The purpose of terminating the permits on August 30, 1999 was to prevent the number of grandfathered vehicles from growing during the limited permit period. As long as residents can demonstrate residency and ownership of the vehicle at the time of adoption of the ordinance there does not appear to be a reason not to issue late permits. · In order to extend the period of time to obtain a permit, the current ordinance would need to be amended with two readings, one of which would have to meet the advertisement requirement. An additional late fee could be charged and requirement that proof of residency at the time that the ordinance was enacted could be made before a permit is issued. STAFF RECOMMENDATION: Staff recommends the Commission consider amending Ordinance 721 allowing persons who can demonstrate ownership of the vehicle and residency in Winter Springs at the time of adoption of the ordinance to be issued permits in accordance with the provisions of the ordinance, and applying a late fee of$1O.00 (making the total permit fee $35.00).
