HomeMy WebLinkAbout1999 09 27 Public Hearings Item E \~ COMMISSION AGENDA ITEM E Consent Informational Public Hearing X Regular September 27. 1999 Meeting MGR~ Authorization '~~ V ( REQUEST: The Community Development Department - Planning Division request the City Commission hold a public hearing for the second reading and adoption of Ordinance 739 to adopt the Capital Improvements Program / Capital Outlays document. PURPOSE: The purpose of this Board item is the consideration of a Capital Improvements Program / Capital Outlays which serves as a planning tool to provide a perspective of the City's capital needs. It is through a Capital Improvements / Capital Outlays Program review process that long range plans for the orderly maintenance and improvement of Winter Springs' physical assets can be accomplished. APPLICABLE LAW & PUBLIC POLICY: The provisions of 163.3177(1 )(b) Florida Statutes which states "The capital improvements element shall be reviewed on an annual basis and modified as necessary in accordance with 163.3187 or 163.3189, except that corrections, updates, and modifications concerning costs, revenue sources, acceptance of facilities pursuant to dedications which are consistent with the plan; or the date of construction of any facility enumerated in the capital improvements element may be accomplished by ordinance and shall not be deemed to be amendments to the local comprehensive plan. All public facilities shall be consistent with the capital improvements element." CDD/September 17, ]999/3:44 PM SEPTEMBER 27,1999 PUBLIC HEARING AGENDA ITEM E Page 2 The provisions of9J-5.016(5) Florida Administrative Code which states in part "In addition to the general monitoring and evaluation requirements in this Chapter, this element (capital improvements) shall be reviewed on an annual basis." CONSIDERATIONS: . The Capital Improvements Program is a plan adopted by the City Commission outlining the annual operating and capital budget. There is no commitment to expenditures or appropriations beyond the first year (Capital Budget), except for those capital improvements programmed in the Capital Improvement Element. . The various department heads have prepared their appropriate sections of the Capital Improvements Program and reviewed them collectively and made appropriate adjustments. . The Capital Improvements Program / Capital Outlays document was presented to the Local Planning Agency for their review and recommendation on September 1,1999. The LPA recommended approval to the City Commission. . The City Commission held a first reading of Ordinance 739 on September 13, .1999. FUNDING: N/A RECOMMENDATION: The staff recommends that the City Commission approve Ordinance #739 adopting the Capital Improvements Program/Capital Outlays document as presented. WHEREAS, the Local Planning Agency has reviewed the Capital Improvements Program / Capital Outlays document and has recommended to the City Commission adoption of same, in accordance with 163.3174 Florida Statutes; }) -j NOW, THEREFORE, BE IT ORDAlNED that the City Commission of the City of Winter Springs, Florida, adopts the Capital Improvements Program / Capital Outlays document attached to this ordinance as "Exhibit A" SECTION I SEVERABILITY. If any provision or portion of this Ordinance is declared by any court of competent jurisdiction to be void, unconstitutional, or unenforceable, then all remaining provisions and portions of this Ordinance shall remain in full force and effect. SECTION IT CONFLICTS That all Ordinances or parts of Ordinances in conflict herewith are hereby repealed. SECTION ill EFFECTIVE DATE. This Ordinance shall take effect upon adoption. Capital Improvement 1 Capital Outlays Draft Document Mr. Grimms explained that the packet before them lays out what the Capital Improvement Project and Capital Outlays are; related definitions; and departmental tables and justification sheets. The recommendation of this Board will go to the City Commission for their adoption of an Ordinance; and a copy will be sent to the Department of Community Affairs. Mr. Grimms added that the Florida Recreation and Developmental (FRDAP) Grant is related to this in that FRDAP needs to see that the Parks and Recreation section is approved. Discussion followed regarding being informed prior to notices in newspapers; that many departments did an outstanding job with their report; the Winter Springs Boulevard turn lanes were clarified; the resurfacing of specific streets; tabs; Seminole Traffic Circulation Projects; that this is the first time since 1991 that this project will go through the process of being adopted; Trade Winds Park was listed; line items; transfers; funding; the lighting for soccer fields; and the status of the Community Land Acquisition. Mr. Grimms added that "No Capital Improvements Projects, still on the books, that would have to go in there - we have gone beyond the time frame in our planning horizon for the Comprehensive Plan."
