HomeMy WebLinkAbout1999 08 23 Consent Item A COMMISSION AGENDA ITEM A CONSENT i{)( INFORMATIONAL PUBLIC HEARING REGULAR August 23, 1999 Meeting MGR~EPT~ Authorization REQUEST: The Finance Department requests the City Commission authorize the participation in the joint governmental auction on September 18, 1999 at George Gideon Auctioneers, 2753 North Orange Blossom Trail, Zellwood, Florida and approve the inclusion of surplus property as identified by the City. PURPOSE: The purpose of this Board item is to obtain approval from the City Commission to participate in the joint governmental auction on September 18, 1999 and approval to include in that auction surplus property as identified by the City. CONSIDERATIONS: A. Declare the list of City property as identified by the Department Heads and approved by the City Manager to be surplus, B. Piggyback on the contract with Seminole County RFP-441-98/GG. FUNDING: A. There is no special funding requirements to participate in this auction. All fees are paid from the proceeds of sale. RECOMMENDATION: ~ ~ 1. Recommend the City Commission authorize the City to participate in the joint governmental auction set for September 18, 1999, and 2. Authorize payment of commissions as computed on gross sale proceeds of City surplus property as indicated on the attached list, and 3. Declare the attached list of items surplus and authorize the items to be included in the joint governmental auction. IMPLEMENTATION SCHEDULE: Upon approval of this agenda item and authorization by the City Commission to proceed. ATTACHMENTS: 2. List of City property deemed surplus by the department heads and approved by the City Manager. 3. Copy of Seminole County RFP-444-98/GG reflecting commission rates for services rendered. Form No. 99-001 Page # 2 . . ,. /' THIS AGREEMENT ~rX .AUCTIONEER SERVICES AGREEMENT (RFP-441-98) is made and entered into this J3 ~ day of 191f- ' by and between SEMINOLE COUNTY, a political subdivision of the State of Florida, whose address is Seminole County Services Building, 1101 East First Street, Sanford, Florida 32771, hereinafter called the II COUNTY, " and GEORGE GIDEON AUCTIONEERS, me., duly authorized to conduct business in the State of Florida, whose address is 1209 Jaguar ~ Court, Winter Springs, Florida 32708, hereinafter called the "AUCTIONEER. II W I '1' N E SSE T H: WHEREAS, the COUNTY desires to retain the services of a competent and qualified auctioneer to conduct auction for surplus COUNTY vehicles and equipment; and WHEREAS, the COUNTY has requested and received expressions of interest for the retention of services of auctioneer; and WHEREAS, the AUCTIONEER is competent and qualified to furnish .auctioneer services to the CQUNTY and desires to provide profes- sional auctioneer services according to the terms and conditions stated'herein, NOW, THEREFORE, in consideration of the mutual understandings and covenants set forth herein, the COUNTY and the AUCTIONEER agree as follows: SECTiON 1. SERVICES. The COUNTY does hereby retain the AUCTIOlljEER to furnish professional senrices and perform those tasks as outlined in Scope of Services attached hereto as Exhibit C;/iPB 1 vC) . d [: T : c: T E.t:,t:, T -c: T -:JIlt! A and made a part hereof. SECTION 2. TERM . This Agreement shall take effect on the date of its execution by the COUNTY and shall run for a period of one (1) year andl at the option of the partiesl may be renewed for two (2) additional one (1) year terms. SECTION 3. AUTHORIZATION FOR SERVICES. Authorization for performance of professional services by the AUCTIONEER under this Agreement shall be in the fOrffi of written letters issued by the ~ COUNTY Purchasing Manager and signed by the AUCtIONEER. Each letter shall state the dates and location for the auction and shall be issued under and shall incorporate the terms of this Agreement. The cotJ"NTY makes no covenant or promise as to the number of auctions nor that the AUCTIONEER will perform any auctio:q. for the COUNTY during the life. of this Agreement. The COUNTY<reserves the right to contract with other parties for the services contemplated by this Agreement when it. is determined by the CO~~Y to be in the best interest of.the COUNTY to do so. SECTION 4. COMPENSATION. The COUNTY agrees to compensate the AUCTIONEER for the professional auctioneer. services called for under this Agreement on a commission for sales basis, according to the rates as established in the commission schedule I attached hereto as Exhibit "B." SECTION 5. BILLING AND PAYMENT. (a) The AUCTIONEER shall retain all auction proceeds during the auction event.
