Authorization REQUEST: The Community Development Department- Code Enforcement Division requests the City Commission consider the request of Ms. Sandra Rawlins, 1002 Gator Lane, to have more than two dogs at her residence, as per Section 4-2 of the Code of Winter Springs. PURPOSE: The purpose of this agenda item is to request the City Commission consider the request of Ms. Rawlins to have more than two dogs at her residence. APPLICABLE LAW AND PUBLIC POLICY: Section 4-2 of the Code of Winter Springs prohibits any household in the city to own or contain more than two (2) dogs and two (2) cats without the express consent of the city commission. CONSIDERA TIONS: Ms. Rawlins is involved with a nonprofit organization, Pet Pal rescue and is sometimes called on to help rescue dogs from destruction by area municipalities by temporarily housing these animals for a brief time at her home. Adoption days are held every Saturday at Petsmart in Casselberry. All transactions are handled at that location and no activity related to the adoption of these animals occurs at her residence. The dogs are contained in a privacy-fenced, one -acre residential lot. MAY 10, 1999 AGENDA ITEM D Page 2 STAFF RECOMMENDATION: Staff recommends that the City Commission approve this request. The city hereby adopts by reference as though fully set forth herein the "Animal Control and Protection Ordinance of Seminole County, Flori- da," County Ordinance No. 74-8, and all amend. . ments and additions thereto except as otherwise provided in this chapter. (Code 1974, * 4.1) Sec. 4-2. More than two dogs or cats prohib- ited; exception. No household in the city shall own or contain more than two (2) dogs and two (2) cats without the express consent of the city commission. Once permission is obtained from the city commission, additional dogs or cats may be maintained in the same household until such time as a public com- plaint is registered against their domicile or main- tenance. [The next page is 297) 247 "\ , April 20, 1999 Mrs. Jimette Cook, Manager 1126 East State Road 434 Winter Springs Code Enforcement Winter Springs, FL 32708 Dear Mrs. Cook: I am writing to you concerning my situation at 1002 Gator Lane, Winter Springs, Florida, and city code Section 4-2 currently on the Winter Springs books. Due to the nature of my work, animal rescue, namely puppies and dogs, I am frequently in a position where I have more than 2 dogs. I am regularly called on by Mary Beth Lake, Seminole County Animal Control and Vicki Hilburn, Casselberry Animal Control, to help out in last ditch efforts to save young puppies and dogs and sometimes elderly dogs and find new homes for them. I am their last chance. The numbers always change as do the individual dogs. Our adoption days are held at Petsmart, 4500 West Highway 17&92, Casselberry, every Saturday from 11 AM to 5 PM, therefore, no business is conducted from my Gator Lane address. Our mailing address is Pet Pal Rescue, Box 195672, Winter Springs, Florida, 32719. Pet Pal is a 501 C3 not for profit organization and has been in existence for 10 years. My property at 1002 Gator Lane is one acre of land, privacy fenced and decoratively fenced. The rescued dogs are contained within these fences and are never allowed to roam. The safety and well being of these dogs is of utmost concern to me since some have come from very traumatic circumstances or illnesses. It is not my intent to violate the city's laws, only to assist where and when I can in the life saving rescue of as many of these loving, innocent, helpless pets as I can.
