HomeMy WebLinkAbout1999 04 12 Regular Item A COMMISSION AGENDA ITEM A' Consent Information Public Hearing Regular XX April 12. 1999 Meeting MGR.~ /D~_ REQUEST: Community Development Department, Planning Division, requesting Commission direction relative to negotiations between the City and Discount Auto Parts. PURPOSE: The purpose of this agenda item is to request direction from the City Commission relative to the Discount Auto Parts project. FINDINGS: 1) The City Commission, at their meeting of February 22, 1999, approved the Discount Auto Parts project subject to the following: a) subject to all requirements of the 434 Redevelopment Code; b) that the building be of earth tone colors; and, c) that this building would not have yellow on the structure, but would be allowed to have yellow lettering for the signage, either on their monument sign, and/or on their building signage. 2) The developers have met with the City Manager and do not want to eliminate the yellow on the structure, nor do they want to have the building earth tone in colors. 3) The developers have submitted an alternate scheme which does not meet the requirements imposed by the Commission for earth tone colors on the building and the elimination of the yellow striping on the building. 4) The developers have represented that they will seek relief in court from the Commission's directions. April 12, 1999 REGULAR AGENDA ITEM H Page 2 5) This item had been scheduled to be before the City Commission at their meeting of March 22, 1999, but the developer informed the City Manager that they were unable to attend the meeting and requested that this be heard at the meeting of April 12, 1999. RECOMMENDA TION: It is recommended that the Commission provide Staff direction relative to its desire to maintain its previous directives, or to accept the alternate design. COMMISSION ACTION:
