V'/Df, REQUEST: Community Development Department, Planning Division, presents to the Commission for their approval the conceptual design for the "Trotwood Connector" between Winding Hollow Subdivision and Oak Forest Subdivision. PURPOSE: The purpose of this agenda item is to present to the Commission a conceptual plan for a linear park to be located between Winding Hollow Subdivision and Oak Forest Subdivision, also known as the "Trotwood Connection". APPLICABLE LAW: The City and 434 PARTNERSHIP (the developer of the property at that time) entered into a Developer's Commitment Agreement on March 27, 1989. Subparagraph 2(h), listed below, discusses the "Trotwood Connection'''' 2(h) 434 agrees to incorporate within the Preliminary Plan, the CITY's request for a connection through the Oak Forest subdivisionlTrotwood Boulevard stubout located near the Property's southeastern boundary. The decision as to how this connection shall be made will be determined and decided upon by the City Commission at such time as that particular phase of the development which abuts the proposed Trotwood Boulevard connection is presented to the CITY. At such time the CITY shall, in its discretion, determine whether such connection shall be (1) a connection for police and fire protection with no public access, and in that event 434 shall install breakaway gates as approved by the CITY or (2) no connection whatsoever. 434 agrees to construct the connection based upon the CITY's determination at such time. In the event that neither option is selected by the CITY or a partial connection is required pursuant to item (1) above, and the CITY decides to construct an alternative connection within the Right of Ways or other property dedicated to the CITY on the attached Preliminary Plan, and only in the e~~nt _of such construction, (/ I \ March 22, 1999 REGULAR AGENDA ITEM F Page 2 434 agrees to provide the cost of road improvements (less credit for any partial connection as referenced in item (1 ) above) which shall be calculated and determined as follows: Donald W. McIntosh Associates, Inc., 2200 Park Avenue North, Winter Park, Florida 32789 and/or another State of Florida Licensed Engineer shall submit to the CITY a certified statement of the construction costs for the Trotwood connection. Said costs shall be subject to review and approval by the City Engineer. Said payment shall be due forty five (45) days after the CITY has determined that the Trotwood connection will not be made, and the receipt of all applicable permits by the CITY for the construction of the southern connection. FINDINGS: 1) This conceptual connection will serve as a connection for police and fire protection, without public vehicular access, for the Winding Hollow Subdivision and Oak Forest Subdivision. 2) The residents of both subdivisions prefer a linear park concept rather than a paved road with barricades at both ends. 3) Staff supports the linear park concept with emergency vehicle access. 4) The City will maintain the linear park. 5) The residents prefer decorative lighting and in this regard will pay the difference between the standard rate of$8.74 and the actual cost. The City will bill the Homeowner's Association for the difference which is currently estimated at $1,400.00 per year. 6) If Winding Hollow Unit 6 (approximately 7 units) is built, the developer will be responsible for moving the Oak Forest hammerhead and amenities approximately two hundred (200) feet northward to provide access to Unit 6. FUNDING: The estimated cost, not to exceed, $83,247.00 will be borne by the developer. I - Pill!,t/t.. fI(P ;eq-~AJ ~ SI6UE~ o/~/Al~<<., ,~ DEVELOPER'S COMMITMENT AGREEMENT -,jI THIS AGREEMENT is made and entered into this ;29 day of March, 1989 by and between 434 PARTNERSHIP, a Florida General Partnership herein referred to as "434", and the CITY OF WINTER SPRINGS, FLORIDA, a Florida municipal corporation, herein referred to as "CITY". WIT N E SSE T H: WHEREAS, 434 has submitted to the CITY a Preliminary Subdivision Plan (herein referred to as the "Preliminary Plan" and attached hereto as Exhibit "A") bearing date July 1, 1988 and amended through November 10, 1988, prepared by Donald W. McIntosh Associates, Inc., containing pages 1 through 5 inclusive, for review and Preliminary Plan approval (said approval was granted by the CITY on December 12, 1988) with respect to certain real .1 property described in Exhibit "3" attached hereto and made a part hereof, herein referred. to as the "Property"; and WHEREAS, it is the intent of 434 to develop on said Property four hundred (400) single family lots i and WHEREAS, the parties desire to reduca to writing their several agreements relating to the anticipated construction of 400 single family lots on the Property. NOW THEREFORE, in consideration of the premises, the commit- ments, and the undertakings set out hereinafter, and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the parties do hereby agree as follows: 1. The City Commission of the CITY, approves the proposed development on the Property, subject specifically to the following conditions required by the City Commission of the CITY, in formal public meetings regarding the Preliminary plan and subsequent development of the Property. 2. 434 agrees to be bound by the terms of and to assume the obligations under that certain Settlement Agreement by and between Florida Land Company and the CITY, a copy of which is attached hereto as Exhibit "C", in the event that the proposed 1 ~: development is constructed on the Property; provided, however that the assumption by 434 of the obligations under the Settle- ment Agreement shall be specifically subject to the following; (a) 434 agrees to dedicate a site or sites on the Property reserved for use as a park(s) by the CITY, containing those areas described hereto as Exhibit "0", more specifically, the total park area shall be as follows: TOTAL PARK AREAS A) B) Southwest Park 31.8 Acres Northwest Park 23.7 Acres TOTAL AREA: 55.5 Acres PARK AVAILABLE FOR PERMANENT RECREATIONAL FACILITIES AND STRUCTURES A) Southwest Park 3.1 Acres B) Northwest Park 18.1 Acres ~ TOTAL AREA: 21.2 Acres PARK AREA AVAILABLE FOR PASSIVE PARK USES A) Southwest Park 28.7 Acres B) Northwest Park 5.6 Acres TOTAL AREA: 34.3 Acres Said dedication is reflected on the Preliminary Plan, as same may be amended from time to time. (b) 434 agrees to contribute TWENTY-FIVE THOUSAND DOLLARS ($25,000.00) for the improvement of the site's park facility. Said contribution shall occur at the time of issuance of the first building permit for construction of a single family residence on the property. (c) 434 agrees to dedicate to the CITY those conserva- tion easements and park site's defined on the Preliminary Plan attached hereto, as same may be amended from time to time, when requested by the CITY. Additionally, 434 agrees to dedicate to the CITY the Rights of Way described on the attached Preliminary Plan, as same may be amended from time to time. (d) 434 agrees to improve the State Road 434 project entry, prior to the issuance of the first Certificate of Occu- pancy on any residential housing unit on the Property, to allow 2 ,. " t~o (2) outbound and one (1) inbound entry movements, accelera- tion and deceleration lanes, along State Road 434, and a west- bound left-turn movement at the project entry, as shown in that certain State Road 434 map prepared by Donald W. McIntosh Associ- ates, Inc., attached hereto as Exhibit "E" and made a part hereof, subject to all applicable governmental agency approvals. (e) 434 agrees to pay FIVE HUNDRED ($500.00) per unit to the CITY, at the time each individual house building permit is issued, to be used toward public school system needs, within the CITY. (f) 434 agrees to make application to FOOT when requested by the CITY and to pay for the cost of the installation and cost of a traffic signal at the intersection of the northern project entry and State Road 434, subject to the FOOT approval and other applicable governmental agency approvals. " (g) 434 agrees to incorporate within the Preliminary Plan, the CITY staff's request for the provision of a north/ south collector road through the Property (Street A), and shall have the obligation to construct said collector road from SR 434 to a distance approximately 1,400 feet north of the Property's south boundary, as shown on the approved Preliminary Plan dated November 10, 1988.,/ (h) 434 agrees to incorporate within the ~reliminary Plan, the CITY's request for a connection through the Oak Forest subdivision/Trotwood Boulevard stubout located near the Property's southeastern boundary. The decision as to how this connection shall be made will be determined and decided upon by the City Commission at such time as that particular phase of the development which abuts the proposed Trotwood Boulevard connection is presented to the CITY. (i) 434 agrees to incorporate within .the Preliminary Plan, the CITY'S request for a connection to the Alton Road stub- out located near the Property's northwestern boundary. The deci- sion as to how this connection shall be made will be determined and decided upon by the City Commission at such time as that particular phase of the development which abuts the proposed Alton connection is presented to the CITY. At such time the CITY shall, in its discretion, determine whether such connection shall be (1) a connection for police and fire protection with no public access, and in that event 434 shall install breakaway gates as approved by the CITY or (2) no connection whatsoever. 434 agrees to construct th~ connection based upon the CITY'S determination at su'ch time. (j) 434 will underdrain all streets within the Property, as required by the City Engineer. (k) 434 agrees to mandate, develop, and implement as a part of the proposed project the formation of a mandatory Home- owner's Association ("Association"). The Association shall be . .' required to maintain the stormwater system and common areas within the Property. The Association documents shall be subject to review and approval by the City Attorney of the CITY. 3. The parties agree that Paragraph l(b) of the Settlement Agreement regarding the dedication of approximately one hundred (100) acres in the easterly quadrant of the Property for conser- vation purposes has been satisfied by thut certain Conservation Easement in favor of the State of Florida, Department of Environ- mental Regulation, recorded February 9, 1982 in Official Records Book 1377, Page 713, Public Records of Seminole County, Florida. 4. The parties agree that Paragraph l(b) of the Settlement Agreement regarding the dedication of approximately forty (40) acres of the Property for effluent discharge has been satisfied. 5. This Agreement Contains all the covenants, stipulations, conditions and agreements relative specifically to the CITY'S J approval for development of 400 single family lots and residences on the Property by 434. The parties hereby acknowledge that the conditions of approval of such development are as described herein. Attached hereto as Exhibits "F" and "G" respectively, are the transcripts of those certain Public Hearings dated April 25, 1988 and December 12, 1988, which transcripts are expressly incorporated herein and are essential terms and conditions of this Agreement. In the event there are matters set forth in the transcripts that this Agreement does not address, then said tran- scripts shall control and govern. In the event of any conflict between pages one through six of this Agreement and said tran- scripts, the terms and provisions of this Agreement shall control and govern. 6. This Agreement shall be binding upon the successors, assigns, and legal representatives of the parties hereto. 7. This Agreement sets forth the entire understanding of the parties with regard to the CITY'S approval for development of the Property as herein set forth and supersedes any and all prior agreements and negotiations, whether verbal or written, between .the parties and/or affecting the Property. ,. . . .'. .. ~.
