PURPOSE: The purpose of this agenda item is to request the Commission direct staff to prepare a large scale comprehensive plan amendment: for the proposed Town Center. The plan amendment would involve both text and map change to the City's Comprehensive Plan. APPLICABLE LAW AND PUBLIC POLICY: The provisions of 163.3167 (11) F. S. which states "Each local government is encouraged to articulate a vision of the future physical appearance and qualities of its community as a component of its local comprehensive plan. The vision should be developed through a collaborative planning process with meaningful public participation and shall be adopted by the governing body of the jurisdiction. " Policy 3c. under Objective A of the Traffic Circulation Element of the City's Comprehensive Plan which calls for the creation of a "Town Center" to serve as a primary civic, business and service focus for the City. In 1995, the City Commission approved the preparation of a S.R. 434 Corridor Vision Plan that would include a "Town Center". The provisions of 420.9072(1)(a) F.S. which state: "Each local governing body shall transmit the complete proposed comprehensive plan amendment to the state land planning agency, the appropriate regional planning council and water management district, the department, and the JANUARY 25, 1999 AGENDA ITEM F Page 2 Department of Transportation immediately following a public hearing pursuant to subsection (15) as specified in the state land planning agency's procedural rules. The local governing body shall also transmit a copy of the complete proposed comprehensive plan or plan amendment to any other unit of local government or government agency in the state that has filed a written request with the governing body for the plan or plan amendment." The provisions of 163.3184(15)(b) F.S. which state: "The local governing body shall hold at least one advertised public hearing on the proposed comprehensive plan amendment as follows: 1. The first public hearing shall be held at the transmittal stage pursuant to subsection (3). It shall be held on a weekday at least 7 days after the day that the advertisement is published. 2. The second public hearing shall be held at the adoption stage pursuant to subsection (7), It shall be held on a weekday at least 5 days after the day that the second advertisement is published. " The provisions of9J-l1.006(1) F.A.C. which states "Each proposed amendment including applicable supporting documents which include data and analyses shall be submitted directly to the Florida Department of Community Affairs, Division of Resource Planning and Management, Plan Processing Team, the appropriate regional planning council, water management district(s), Department of Transportation and Department of Environmental Protection, Proposed plan amendments, except those discussed under the exemption provisions of Rule 9J-l1.006(1)(a)7. F.A.C., shall be consolidated into a single submission for each of the two plan amendments adoption times during the calendar year. The comprehensive plan submitted pursuant to Section 163.3167 F.S., shall be counted as one of the two plan amendment adoption times during the calendar year; however, only the submittal requirements of Rule 9J-ll. 004 F.A. C. must be followed. CHRONOLOGY: . On January 12, 1998 the Commission authorized the City Manager to enter into a contract with the firm of Dover, Kohl & Partners for preparation of a two-phase Town Center Development Plan. * Subsequently, representatives from Dover, Kohl & Partners spent one and a half weeks in and around the City collecting and analyzing data and conducting interviews with City officials and community leaders. . On February 11, 1998 Dover, KoW & Partners held a "Kick Oft" presentation at City Hall, followed by two workshops "Preliminary Concepts" on February 17th and "Work In Progress" on February 20th. JANUARY 25, 1999 AGENDA ITEM F Page 3 · The City Commission approved the Concept Plan for the Town Center on March 23, 1998 and authorized Dover, Kohl & Partners to proceed with Step II of the Proposal for town planning services. · Step II requires the consultants to prepare a "prescriptive graphic code" for the Town Center plan in two drafts. This effort includes a first draft for comments from the client and a final version based upon those comments and refinements. · On June 12, 1998, Robert Gray of Dover, Kohl & Partners advised that the first draft would be available for review on July 1, 1998. · The final draft of the Town Center District Code was presented to the City in October, 1998. · The City Commission scheduled a first reading of the Town Center District Code on December, 14, 1998. The first reading was continued until January 11, 1999 and again until January 25, 1999. CONSIDERA TIONS: · The City's adopted Comprehensive Plan calls for the creation ofa Town Center in the Traffic Circulation Element Goal 1, Objective A, Policy 3c which states: The optimal traffic circulation system to serve the creation in the undeveloped central area of Winter Springs of a primary civic, business and service focus for the City. · The City Commission has expressed its desire in 1996, 1997, 1998 for a Town Center to be located in the general' area of S.R. 434 and Tuskawilla Road. · The large scale comprehensive plan amendment involves two changes: (1) changing the Future Land Use Map (FLUM) designation of the area within the proposed Town Center District from present designations of "Mixed Use" and "Commercial" to a completely new designation of "Town Center"; and (2) creating new text for the new FLUM designation. SCHEDULE: February 3, 19995:00 p.m. Filing deadline for large scale comprehensive plan amendment, for Spring, 1999 Cycle. JANUARY 25, 1999 AGENDA ITEM F Page 4 April 6, 1999 Development Review Committee review of proposed plan amendment and recommendation to the Local Planning Agency. May 5, 1999 Local Planning Agency review of the proposed plan amendment and recommendation to City Commission. June 28, 1999 City Commission holds a first transmittal" public hearing on the proposed plan amendment to decide whether to transmit amendment to DCA. June 30, 1999 Plan amendment sent to DCA and all other required . . reVIew agencIes. September 28 1999 City receives DCA's ORC Report. November 28, 1999 (or sooner) City Commission hold a second "adoption" public hearing on proposed amendment. December 8, 1999 City sends adopted plan amendment to DCA. January 22,2000 DCA issues "Notice ofIntent" to find plan amendment in compliance or not in compliance. FUNDING: N/A STAFF RECOMMENDATldN: Staff requests the Commission to authorize staff to prepare a large scale comprehensive plan amendment for the proposed Town Center and submit it to the Local Planning Agency for its review and recommendation to the Commission.
