REQUEST: Community Development Department, Land Development Division, requests Commission approval of the Final Development Plan and the Final Engineering for Golfside Villas. PURPOSE: The purpose of this agenda item is to approve the final development plan and the final engineering for Golfside Villas. This property is located in the Highlands PUD, west of Sheoah Boulevard and to the immediate west of Seville on the Green complex. This project is surrounded on three (3) sides by the Winter Springs Golf Course and will have twenty (20) townhouses on approximately 2.7 acres. APPLICABLE CODE: Section 9-71. When a final development plan is to be filed; extension. (a) The final development plan including engineering and plat for all or a portion of the area covered by the preliminary plan shall be submitted within one (1) year of the date of approval of the preliminary plan; otherwise, such preliminary approval will automatically become null and void unless the City Commission grants a specific extension of time. Section 9-72. Processing of final plans. (1) City Planner ------- -- ~\~ (Z-l "'I o Processing offinal plans shall be as follows: (2) City Engineer (3) Staff Review January 25, 1999 CONSENT AGENDA ITEM A Page 2 (4) Only if significant changes, alterations or modifications have been made to the final plans which would cause to be construed at the time of staff review that a substantial difference between the final and the preliminary plans now exists, plans must then be sent to planning and zoning for further review. If no substantial difference between the preliminary and final plan exists, this step in the process will not be required. (5) City Commission. Section 9-73. Form and contents of final development plan. (a) The final development plan and plat shall conform substantially to the approved preliminary plan as approved and shall include all conditional requirements specified by the city commission on any conditional approval of the preliminary plan. The subdivider may propose only a portion of the area of an approved preliminary plan for final development should that be desired. Whenever developing only a portion of an approved preliminary plan, that portion being developed must be engineered so that section is not dependent upon further development to ensure adequate drainage, sewerage, water and other improvements. (b) Additional engineering/plans to accompany the final development plan/plat: (1) Potable water including fire protection systems (2) Sanitary sewer (3) Drainage and stormwater management facilities including underdrains (4) Bulkheads (5) Excavation and fill (6) Sidewalks, bicycle paths, and bridle paths (7) Streets and curbs. Street grades and elevation shall be established to minimize the need for underdrains. In soils where high groundwater is found or suspected, cuts shall be minimized in order to reduce the need for underdrains. Wherever along the proposed roadways projected January 25, 1999 CONSENT AGENDA ITEM A Page 3 groundwater elevation is less than one (1) foot, six (6) inches below the bottom of the swale (or bottom of road base where curb and gutter is used), underdrains shall be required. (8) Soils exploration. The results of comprehensive soils and explorations, evaluation of results and recommendations by a city-appointed soils engineering and testing firm. The soils exploration work shall include as a mInimum: a. Results of borings located by survey at suitable intervals along the proposed roadways; classification and properties of soils encountered; and groundwater elevation to United States Geological Survey datum found subsequent to making borings. The evaluation of the results and recommendations by the soils firm shall include as a minimum: Recommendations on the type of base construction; projected high-water elevation to United States Geological Survey datum along the proposed roadways, need, design, size, location, depth and details of underdrains; and a recommendation on the elevation of street grades including depth of cut. The results of the soils work, evaluation of results, and recommendations shall be incorporated into the plans and specifications submitted for review. b. If during construction of improvements, the city determines in the field that soils and/or groundwater conditions are found to be different than shown in the data submitted with final development and engineering plans, or there is a question about adequacy of the approved plans caused by conditions found in the field, the city shall have the right to require modification of the previously approved design plans including, but not limited to modification of street grades and/or installation of additional underdrains, use of solid cement base course, or other modifications. (9) Lot grading. At the time final engineering plans are submitted, lot grading and drainage plans shall be submitted for review and approval. The plans shall show minimum floor elevations for all homes, existing topography, grading of all lots, and any drainage improvements proposed on the lots. The lot grading and drainage plans shall show the lot lines, existing topography (one-foot contour intervals), and proposed lot filling, grading and drainage at a scale of one (1) inch is equal to one hundred (100) feet (or larger) in general accordance with FHA standards for lot January 25, 1999 CONSENT AGENDA ITEM A Page 4 grading. Substantiating soils borings, evaluations and studies shall also be submitted to document soil conditions, projected high-water groundwater elevation on the lots, and adequacy of t,he lot grading and drainage plan. (10) Street lighting plan, demonstrating power company participation. (11) Landscaping plans. Where site is commercial, industrial, or multifamily in nature, landscaping plans shall be presented along with the final development plans, unless specifically waived by the staff at the time of processing the preliminary plan. Section 9-74. Action on final development plan; expiration of approval. (a) If the developer elects to request approval of a final development plan separately and prior to approval to record the plat of that development, the city commission may approve such final development plan if the plan is in substantial conformity with the approved preliminary plan or a subsequently approved modification to the preliminary plan. The final development plan may be approved it if complies with all relevant regulations included in this chapter. Approval of the plan shall be subject to fulfillment of all conditions specifiec by the city staff and sanctioned by the city commission....." CHRONOLOGY: October 26, 1998 - City Commission approved Preliminary Engineering November 5, 1998 - Final Engineering Plans submitted to the City for review January 12, 1999 - Development Review Committee Meeting FINDINGS: 1. The City Commission, at their meeting of October 26, 1998, approved the preliminary engineering plans only, and not the Final Development Plan. This approval was held in abeyance contingent on a solution to Section 20-357(12) of the Code being reached. Please refer to Land Development Coordinator memo dated January 6, 1999 for this solution. These changes will be reflected in the covenants which will be presented to the City Commission simultaneously with the request to record the plat. January 25, 1999 CONSENT AGENDA ITEM A Page 5 2. The final engineering conforms substantially to the approved preliminary engmeenng. 3. The Staff has found this project to be in general compliance with Code requirements. 4. The developer has chosen to request approval offinal engineering separately and prior to approval to record the plat of this development and the City Commission may approve the final engineering if the engineering is in substantial conformity with the approved preliminary engineering. CONCLUSION: The Staff has found this project to be in general compliance with applicable code requirements. RECOMMENDATION: Staff recommends that the City Commission approve the final engineering for the Golfside Villas project. Requesting the City Commission endorse CALNO's recommendation for Sanford City Commissioner Whitey Eckstein's reappointment as a member of the Seminole County Expressway Authority: Commissioner Martinez said he has the verbatim minutes of the September 2, 1998 Planning and Zoning Board meeting and said there was some concerns of the P & Z Board regarding trees that were removed and not accounted for and said there was no mitigation for replacement of the trees planned. Commissioner Martinez said there was also mention of a pipe that was going to bring water to one of the depositories which is small and the P & Z recommended that it be bigger. Commissioner Martinez said this item is Item A on .the Consent Agenda and asks for approval and said there was no mention of the concern or response to the questions raised by the P&Z Board. Donald LeBlanc, Land Development Coordinator, stated that the development team was present for the P & Z meeting and answered the questions to the Board's satisfaction and also stated that the landscape architect, the engineer for the developer and Mr. Sheldon Green is present for questions. Commissioner Martinez asked if the P & Z Board's questions were answered. Mr. LeBlanc stated that the P & Z Board recommended that this be approved at their October 12, 1998 meeting, without the approval of their minutes. Discussion. Charles Carrington, Community Development Director, mentioned that at the P&Z meeting, the Board members raised several questions about the relationship of the plan to an approved Master Plan for the P.U.D. and directed Staff to go back and compare the proposal to the previously approved P.U.D. Master Plan for the Highlands. Staff researched this and discovered that the formal approval of the Highlands P.D.D. simply does not exist in Public Records and stated that this information was given to the City Attorney and stated that the information was presented to the P&Z Board and the Board made the recommendation for approval, subject to a ruling from the Attorney on the status of the Highlands P.U.D. Mr. Carrington stated that the items of concern were addressed and stated that the drainage pipe is properly sized and adequate. Discussion. Attorney Guthrie stated that the staffresearch indicates that P.D.D. zoning was affixed to the property and done by Ord. No. 56, March 12, 1971, and said there is no evidence that this was formally approved and stated that this development is almost fully developed and there are only a few parcels left to be developed; one solution is to treat this as a component of the final development plan for this phase, which tonight's action would do, and said the other fix would be to go through a public hearing process that would affect existing parts of the P.U.D. and undeveloped parts and suggested that with this parcel and any other undeveloped parcels (if any) that the City look at creating those as mini-master development plans for the portions that are developed. Discussion. Regular Meeting City Con_SionOctober 26.1998 97-98-47 e Page 3 There was discussion about having the minutes of the P&Z Board to the Commission when the Commission is hearing an item from that Board. ~ Commissioner Blake had questions on the size of the pipe and about having one fire hydrant. Mr. LeBlanc stated that the Fire Chief has approved that, as the dwelling units will be sprinkled. Discussion on the development standards. Attorney Guthrie said the development standards that are set forth in the covenants and restrictions (now), if the Commission approves those, then we can make them a text portion of the Master Development Plan that the Commission is approving. Sheldon Green, developer, stated that some of the questions the Commission are asking were answered at the October 7, 1998 meeting of the P&Z and stated that both his engineers are present and said they answered the P&Z Board's questions. Commissioner Gennell mentioned that she has repeatedly pointed out that it is difficult approving something without the benefit of the P&Z minutes. Discussion. Motion was made by Commissioner McLeod to approve the preliminary engineering contingent upon the City Manager and City Attorney bringing back to the Commission a resolution to Section 20-355(12). Seconded by Commissioner Gennell. Discussion. Vote: Commissioner Miller: aye; Commissioner Blake: aye; Commissioner Martinez: aye; Commissioner Gennell: aye; Commissioner McLeod: aye. Motion passes. Discussion on Consent Agenda Item B. Commissioner Martinez asked about the flood plain. Commissioner McLeod spoke about his concern with having cut-through traffic into Oak Forest. Manager McLemore stated that the road would be "trail like" for walkers and roller skaters. Commissioner McLeod said he would like to see it meander. Commissioner McLeod also stated he would like to see the plans. Motion was made by Commissioner Blake to approve Consent Agenda Item B. Seconded by Commissioner McLeod. Discussion. However, the Commission (at their meeting of October 26, 1998 when the Preliminary Engineering for this project was approved), wanted to ensure that the requirements of Section 20-357(12)a of the Code were met. Therefore, Section 12 of the proposed Covenants is to be amended to include the below listed items: (a) Uses - 20 townhouses (b) Height - will not exceed thirty five (35) feet (c) Building area limitation - limited to that area within the property lines for each lot as depicted on the plat (d) Front, rear and side yard setbacks (minimum required): Front - 0 Side - 0 Rear - 10' from the golf course (e) Lot area coverage - one hundred (100) percent (f) Minimum living area - one thousand (1,000) square feet per dwelling unit (g) Other restrictions - please refer to restrictions throughout the covenants (h) Parking - One (1) enclosed garage space and two (2) open spaces per dwelling unit This amendment must be incorporated into the covenants prior to platting. All terms and charges of the proposal dated February 14, 1997 were valid for 30 days from the . date of that letter. Due to changes in the tariff the construction charge has changed and the work order deleted from our system. I will need new plans to verify that the old design will meet your current needs. Lead time required to engineer, permit, and schedule/construct projects varies depending on the size and complexity of the project. Currently, we are experiencing an approximate eight (8) to fourteen (14) week time frame from when we receive the necessary final information until construction is completed.
