PURPOSE: The purpose of this Board item is to request authorization for the execution of Amendment 12 for the Design of a Reclaimed Water Distribution System along Seneca Boulevard and Vistawilla Drive with Conklin, Porter & Holmes Engineers, Inc. at a cost of$4l,160.00. CONSIDERATIONS: This amendment is needed to design a reclaimed water distribution system for the purpose of reducing the irrigation demand on the potable water system which will improve peak demand pressures on the northern half of Chelsea Woods. The reclaimed water main extension will begin at the existing 8" main on Owasco Street supplying the percolation ponds and proceed northerly along Seneca Boulevard to Vistawilla Drive. The proposed main is then planned to be installed north on Vistawilla Drive to S.R. 434. The surveying and design of distribution systems for Cayuga Drive, Saranac Drive, Oswego Court, and Waneta Court are included with the main extension surveying and design for Seneca Boulevard and Vistawilla Drive. Although not originally planned for inclusion in this portion of the distribution design, their proximity provided an opportunity to incorporate the survey and design into this scope at a cost of about $5,000 less than if it were surveyed separately. The surveying portion of the design is $21,600. November 23, 1998 Consent Agenda Item D Page 2 This project is listed as the fourth project in the recently adopted East Reuse Master Plan with the first three already completed (Tusca Oaks, Arrowhead Unit 2, and Grand Reserve). The project will be designed to serve approximately 485 residences in Chelsea Woods, Eagles Watch, Howell Creek Reserve and Creeks Run. It will also be able to provide service to the medians of S.R. 434. The estimated $400,000 construction cost will be proposed in the FY 1999/2000 budget. FUNDING: The funding source for this project expenditure of$4l,160.00 is the capital improvement line code of the Utility Enterprise Fund - (3600-56310). This project was budgeted at $20,000 in the current budget, however, sufficient funds for this project exist due to the reclaimed water interconnect being under budget. The funds for this project will be expended over the next 240 days. RECOMMENDATION: It is recommended that authorization be given for the execution of Amendment 12 for the Design of a Reclaimed Water Distribution System along Seneca Boulevard and Vistawilla Drive with Conklin, Porter & Holmes Engineers, Inc. at a cost of $41,160.00 payable from the capital improvements line code of the Utility Enterprise Fund - (3600-56310). IMPLEMENTATION SCHEDULE: The scope of services will be completed within 240 days of approval. ATTACHMENTS: 1. Amendment 12 COMMISSION ACTION: ATTACHMENT NO.1 AMENDMENT 12 TO AGREEMENT DATED OCTOBER 14, 1991 CONSULTING ENGINEERING SERVICES FOR THE SENECA / VISTA WILLA / CHELSEA WOODS RECLAIMED WATER MAIN EXTENSION BETWEEN THE CITY OF WINTER SPRINGS AND CONKLIN, PORTER & HOLMES - ENGINEERS, INC. This Amendment dated , 1998 by and between the City of Winter Springs (hereinafter called the OWNER) and Conklin, Porter & Holmes - Engineers, Inc. (hereinafter called the Engineer), is mutually agreed upon and declared an authorized Amendment to an Agreement dated October 14, 1991, between the parties, herein setting forth the scope, terms and conditions of the services herein authorized. The appropriate provisions of the October 14, 1991, Agreement apply as fully as if repeated herein. SECTION 1 GENERAL 1.1 The purpose of this Amendment is to provide for Engineering Services, more specifically itemized herein, in the preparation of Plans and Specifications for reclaimed water main extension along Seneca and Vistawilla to serve the subdivisions at Chelsea Woods, Howell Creek, Creek's Run and Eagles Watch. Residents along the alignment will also be connected. SECTION 2 BASIC SERVICES OF THE ENGINEER 2.1 GENERAL 2.1.1 The ENGINEER agrees to perform professional services in connection with the project as hereinafter stated. 2.1.2 The ENGINEER will serve as the OWNER's professional engineering representative in those phases of the project to which this Amendment applies, and will give consultation and advise to the OWNER during the performance of his services. The ENGINEER will perform the services for the City Commission under the general supervision of the City Manager and Utilities Director and will submit interim plans to them for their review, input, decision, etc. as appropriate. SECTION 3 SCOPE OF SERVICES 3.1 GENERAL The OWNER hereby authorizes the ENGINEER to proceed with the preparation of plans and specifications for reclaimed water main improvements as listed below. No construction permitting from FDEP is required since this line improvement is within the reclaimed water service area. 3.1.1 Route The route for this line extension was previously selected and provides a service around and through these subdivisions. The three subdivisions scheduled for service have existing reclaimed systems which will be disconnected from potable use and connected to the reclaimed system. These subdivisions are Creek's Run, Howell Creek Reserve and Eagle's Watch. In addition, new service lines will be provided to the northern section of Chelsea Woods including the streets of Seneca, Waneta Ct., Oswego Ct., Saranac Drive, Owasco Street and Cayuga Drive. We will set up some of these streets as additive bid items so that the project can be increased or decreased based on the bids received and the budget available. The main line route consists of an extension from the percolation ponds north along Seneca to Vistawilla and north on Vistawilla to S.R. 434, with service to Chelsea Woods off this line. 3.1.2 Evaluate the existing East Reclaimed Master Plan and the associated piping for the Tuscawilla Area Phase I and II. The alignment includes approximately 3600 lineal feet of 8-inch piping and 1200 lineal feet of 8-inch piping to connect the existing subdivisions. An additional 655 lineal feet of8-inch piping is required to extend the line to S.R. 434, which is not included in the Phase I costs identified in the East Reclaimed Master Plan. The use of 8-inch lines will allow for future growth in the service area without requiring additional lines. Phase II consists of an existing 8-inch line on Owasco Street and 5400 lineal feet of 4-inch and 2-inch piping to serve the streets described above. 3.1.3 Evaluate the route by using existing information to determine which side of the ROW to place the reclaimed water line. Discuss issues with the City. 3.1.4 City shall notifY all residents and non-resident owners that reclaimed water will be available to determine in advance of construction how many connections are required along Seneca. 3.2 ENGINEERING SERVICES -DATA COLLECTION, ANALYSIS AND DESIGN 3.2.1 Survey services will be provided by a licensed surveyor. The surveyor will perform the survey for a full right-of-way along the route selected using an aerial base. ENGINEER will coordinate the work of the surveyor with the design. The survey will include: a) Approximate right-of-way location b) Location of all visible improvements c) Coordination with utilities d) Location of utilities (horizontal) e) Cross sections at 100' intervals f) Inverts of crossing or adjacent sanitary and storm structures g) ACAD disc with drafting at 1" = 50'. 3.2.2 In order to reduce engineering costs, we will perform final designs of the reclaimed water main on double plan sheets and the scale shall be 1 inch equals 50 feet. Plans will also include a cover sheet, general notes sheet, and the City of Winter Springs standard reclaimed water details sheet. Line sizes will be based on the Master Plan piping model as discussed in 3.1.2 with the exceptions noted above. 3.2.3 Prepare a Specification using the short form documents for review by OWNER. 3.2.4 Perform field checks of completed Plans and Specifications with the OWNER's representative. 3.2.5 Prepare opinions of probable construction cost based upon final plans and Contract Documents. 3.2.6 Provide the OWNER with three sets of final plans and Contract Documents. 3.2.7 No soils work is included in this scope. 3.3 PERMITS 3.3.1 This project is within the reuse service area and does not requIre an FDEP Construction Permit. 3.3.2 No permits are anticipated for SJRWMD or other agencies. We do not anticipate and Dredge and Fill or Wetlands permits at this time. 3.3.3 These are City streets and no right-of-way permit is required. 3.4 BIDDING SERVICES The ENGINEER can provide these services after separate Notice to Proceed from the OWNER for the value stated in Section 6. 3.5 ADMINISTRATION OF CONSTRUCTION SERVICES The ENGINEER can provide these services after separate Notice to Proceed from the OWNER for the value stated in Section 6. SECTION 4 SUPPLEMENTARY SERVICES OF THE ENGINEER 4.1 If authorized in writing by the OWNER prior to the rendering of such services, the ENGINEER will furnish or obtain under subcontracts, supplementary services of the following types which will be paid for by the OWNER as described in SECTION 6, Paragraph 6.1.2. 4.2.1 Additional services due to significant changes in the scope of the project or its design including, but not limited to, changes in size, complexity, character of construction or due to time delays in initiating or completion of the work as described herein. 4.2.2 Additional services in connection with the project including services normally furnished by the OWNER as described in Section 5 herein and services not otherwise provided for in this Amendment. 4.2.3 Preparing to serve and serving as an expert witness for the OWNER in any protest, litigation, or other proceeding involving the project. 4.2.4 Additional engineering services required by revisions to regulations (after the date of this Amendment) as applicable to the Florida Department of Environmental Protection, the St. Johns River Water Management District, or other regulatory agency requirements. 4.2.5 Provide, through a subconsultant, additional surveYing servIces if required or requested by the OWNER. 4.2.6 Provide, through a subconsultant, soils investigation services if required or requested by the OWNER. SECTION 5 THE OWNER'S RESPONSIBILITIES 5.1 The OWNER will: 5.1.1 Advise the ENGINEER of his requirements for the project and designate a person to act as the OWNER's representative with respect to the work to be performed under this Amendment, and such person shall have complete authority to transmit instructions, receive information; interpret and define the OWNER's policies and decisions pertinent to the work covered by this Amendment. 5.1.2 Guarantee access to and make all provision for the ENGINEER to enter upon public and private lands as required for the ENGINEER to perform his work under this Amendment. 5.1.3 Provide data requested that is reasonably available on the existing utility systems, population and projections, land use and planning information. 5.1.4 Provide personnel to locate facilities and mow, trim, or otherwise make them accessible for inspection and surveying. 5.1.5 Examine all studies, reports, sketches, and other documents presented by the ENGINEER and render decisions pertaining thereto within a reasonable time so as 5.1.6 5.1.7 5.1.8 5.1.9 5.1.10 6.1 not to delay the work of the ENGINEER. Obtain approval of all governmental authorities having jurisdiction over the project, and such approvals and consents from such other individuals or bodies as may be necessary for completion of the Project. Furnish, or direct the ENGINEER in writing to provide at the OWNER's expense, soils investigations if advised in writing by the ENGINEER that they are necessary or advisable. Furnish, or direct the ENGINEER in writing to provide at the OWNER's expense, necessary additional services as stipulated in Section 4 of this Amendment, or other services as required. Provide such legal, accounting, and insurance counseling services as may be required for the project, and such auditing services as the OWNER may require. Give prompt written notice to the ENGINEER whenever the OWNER observes or otherwise becomes aware of any defect in the Project. SECTION 6 PAYMENT PAYMENT Payments for services and expenses of the ENGINEER to be as set forth below: 6.1.1 Compensation paid ENGINEER for services described herein and rendered by principals and employees assigned to the Project will be as described below. The fee for the engineering design and permitting scope of services described in Section 3 shall be $19,560 00. In addition, there are outside consultant fees for Surveying services in the amount of $21,600.00. The fee for design services is a total of $41.160.00 "lump sum" fee. The fee for the bidding services described herein shall not exceed $3,780.00 and the fee for the limited construction administration services shall not exceed $5,580.00 (either item can be authorized separately by the OWNER). 6.2 REIMBURSED EXPENSES 6.2.1 Expenses for items not specifically valued herein are to be reimbursed to the ENGINEER at the actual cost thereof Said expenses shall include transportation and subsistence of principals and employees, when traveling in connection with the Project, toll telephone calls, telegrams and similar project-related items. 6.2.2 The OWNER will make prompt monthly payments in response to ENGINEER's monthly statements without retention for all categories of services rendered under this Amendment and for reimbursable expenses incurred. 6.2.3 Charges for the services rendered by principals and employees as witnesses in any litigation, hearing or proceeding in accordance with Paragraph 4.1.4 will be computed at a rate of$400.00 per day or any portion thereof. 6.2.4 If this Amendment is terminated during prosecution of the services prior to completion of the services of Section 3, payments to be made in accordance with Paragraph 6.1.1 on account of that and ail prior work under this Amendment shall be due and payable, and shall constitute total payment for services rendered. In addition, upon termination, the ENGINEER shall be paid for any Additional Services authorized and rendered under Section 4. 6.2.5 The ENGINEER shall promptly begin work on the services authorized by this Amendment upon receipt of notice to proceed from the OWNER. SECTION 7 GENERAL CONDITIONS 7.1 Since the ENGINEER has no control over the cost of labor, materials, or equipment, or over any construction contractor's method of determining prices, any opinions of probable construction cost which may be provided in the services of this Amendment are made on the basis of his experience and qualifications and represent his best judgement as a design professional familiar with the construction industry, but the ENGINEER cannot and does not guarantee that bids or the construction cost will not vary from opinions of probable cost prepared by him. 7.2 The OWNER and the ENGINEER each binds himself and his partners, successors, executors, administrators and assigns to the other party of this Amendment and to partners, successors, executors, administrators, and assigns of such other party in respect to all covenants of this Amendment. Nothing herein shall be construed as creating any personal liability on the part of any officer or agency of any public body which may be a party hereto, nor shall it be construed as giving any rights or benefits hereunder to anyone other than the OWNER and the ENGINEER. SECTION 8 8.1 The ENGINEER agrees to prosecute the work in a timely manner until the Project is completed. We have estimated the total length of the survey at 10,800 linear feet. Survey services by our firm will include the following: · Location of rights-of-way. · Location of all above ground improvements. · Cross-sections at 100 foot intervals. · Location of sanitary and storm structures with rim elevation and pipe invert. · Bench marks set approximately every 1000 ft. · Coordination with utility companies to flag their underground services. · Location of underground services flagged by the utility companies. · 1" = 30' scaled auto product in auto cad 14 or equivalent. Based on the above we propose to provide services for a FEE of $21,600.00. . Revisions, additional certifications, title reviews, etc. will be provided at an additional fee. The terms of this agreement shall be valid for client acceptance for thirty (30) days. Invoices are due and payable at time of receipt; in the case of delinquent accounts (90 days or over) the client agrees to pay, in addition to the full face amount of the invoice, all reasonable collection, and/or attorney's fees required in the process of collection. Four sets of the survey, signed and sealed, will be provided at job completion.
