PURPOSE: The purpose of this Board item is to vacate a portion of an existing Greenbelt, Drainage and Utility Easement located to the rear of Lot 35, Bear Creek Estates (761 Bear Creek Circle). This will allow the owner of the property to build a tennis court on his property. NOTE: This item was tabled until the October 26, 1998 meeting in order that the City Attorney explore the possibility of granting a license to use the easement instead of vacating it, FINDINGS: 1. The City Commission approved the First Reading oftrus proposed Ordinance No. 706 at their regular meeting of September 28, 1998. 2. The Public Notice for the Second Reading of Ordinance No. 706 was duly advertised in the Orlando Sentinel for the scheduled meeting of October 12, 1998. 3. The applicant has deposited $3,000.00 with the City in an escrow account to guarantee that all excess dirt remaining after construction of the tennis court will be removed from the site. RECOMMENDA TION: It is recommended that the Commission approve the Second Reading and adoption of Ordinance No. 706. The Second Reading and adoption of Ordinance No. 706 will be scheduled for a later meeting. PURPOSE: The purpose of this Board item is to vacate a portion of an existing Greenbelt, Drainage and Utility Easement located to the rear of Lot 35, Bear Creek Estates (761 Bear Creek Circle). This will allow the owner of the property to build a tennis court on his property. FINDINGS: 1) Bear Creek Estates was platted in 1982 (exact date not readable). 2) The UtilitylPublic Works Director, the City Engineer, and all concerned utility companies have reviewed this request and have no objection. 3) The City Engineer has determined that, if the tennis court is constructed as shown, there should be a net increase in the 100-year flood storage capacity at this location . RECOMMENDATION: [t is recommended that the Commission approve the First Reading of Ordinance No. 706, and at a later meeting, approve the Second Reading and adoption of the ordinance. Please take our request off the agenda for the town meeting on 10/26/98, since there is no longer any need to consider this matter.
