HomeMy WebLinkAbout1998 10 12 Informational Item B COMMISSION AGENDA ITEM B CONSENT INFORMATIONAL X PUBLIC HEARING REGULAR October 12. 1998 Meeting REQUEST: The Community Development Department-- Code Enforcement Division would like to inform the City Commission of the status of the Home Builders Association's HomeFest signage campaign, PURPOSE: The Community Development Department-Code Enforcement Division advises the City Commission that the Home Builders Association's HomeFest signage campaign which ended Oct. 4, 1998 resulted in eleven (11) violations, APPLICABLE LAW AND PUBLIC POLICY: Section 16-76 of the Winter Springs Code prohibits the placement of signs on rights-of-way. Section 16-51 limits placement of a real estate sign to that parcel being offered for sale. CONSIDERA TIONS: On September 16, 1998 ,at the direction of Ron McLemore, City Manager, an exception to the current off-site sign regulation was granted to the Home Builder's Association for their advertising campaign, "HomeFest", with the following conditions; . Signs advertising the Home Builders Association's "HomeFest" will be allowed on private property only with the property owner's permission to be obtained by the Home Builders Association. . Signs will be displayed during the weekend only. (Saturday and Sunday) September 191h through October 41h, . Signs shall be 6 square feet or less in size. . No signs will be placed in the public rights-of-way. On September 24, 1998, six (6) violations of the above conditions were noted and reported to the Home Builders Association. On September 25, Rick Mckee of the Home Builders Association said that his organization apologizes and that they would comply completely with our agreement. On September 28, four (4) violations were again noted and reported to the Home Builders Association, These violations were corrected by September 29. On October 3, an additional (1) violation was noted, RECOMMENDA TION: Staff recommends that special exception should not be granted to the Home Builders Association for any advertising campaign in the future because of the repeated violations by the Home Builders Association of the conditions of our agreement to waive the current sign regulations, and because of the possibility of the perception that preferential treatment is given to the Home Builders Association over other builders and home sellers in the City of Winter Springs,
