HomeMy WebLinkAbout1998 06 08 Regular Item C June 8. 1998 Meeting REQUEST: CO~MMISSION AGENDA ADD ON ITEM C Consent Informational Public Hearing Regular X MGR ;1/vv" DEPT Authorization City Manager requesting authority to provide the Schrimsher Realty Company with a non-binding letter of intent relative to Schrimsher's participation in the realignment of the Cross County Trail. CONSIDERA TIONS: The purpose of this agenda item is for the Commission to adopt a tentative policy relative to Schrimsher Realty Company's participation in the reali~lnment of the trail. CONSIDERATION: Staff and the developer have determined that the Schrimsher property involved in the Town Center Plan would be more effectively developed if the current trail alignment crossing the Schrimsher property is realigned as recommended in the Town Center Plan. The Florida Department of Greenways and Trails has certain rules requiring a two for one land swap in acreage that must be at least as valuable as the initial alignment. The proposed realignment plan proposed by the City will accomplish this objective. SeminolE~ County is requiring that an agreement be entered into between Schrimsher, the City and the County relative to what roles tl1e various l~ntities will play in the development and maintenance of the realigned trail. The City staff believes that Schrimsher Realty's role should be limited to the donation of the right of way, while the construction and maintenance cost should be the burden of the City and the County. A non-binding letter of intent is needed immediately from Schrimsher relative to Schrimsher's willingness to donate the land as required by the State. Schrimsher desires a non-binding letter of intent from the City relative to the deml:mds the City and County will be placing upon Schrimsher for development and maintenance of the trail as realigned. RECOMMENDATION:: City Manager is recommending the Commission authorize him to provide Schrimsher with a non-binding letter of intent limiting Scrhimsher's participation in the trail development to the donation of land consistent with Florida Department of Greenways and Trails Rules and Regulations.
