PURPOSE: The purpose of this agenda item is to present to the Commission the recommendation of the Districting Commission as it relates to the redistricting of the City and to request approval of the Second Reading of Ordinance No. 701. FINDINGS: 1. The City Commission approved the First Reading of Ordinance No. 701 at their regular meeting of April 13, 1998. 2. The Public Notice for the Second Reading of Ordinance No. 701 was duly advertised in the Orlando Sentinel for the scheduled meeting of April 27, 1998. RECOMMENDA TION: It is recommended that the Commission approve the Second Reading and adoption or Ordinance No, 701. PURPOSE: The purpose of this agenda item is to present to the Commission the recommendation of the Districting Commission as it relates to the redistricting of the City and to request approval of the First Reading of Ordinance No. APPLICABLE CODE AND LAW: Sectiion 4.02. Commission distrkts; adjustment of districts. (a) Number of districts, The city commission of the City of Winter Springs, Florida, shall by separate ordinancl:: divide the city into five (5) geographical commission dIstricts. . (b) Districting commission. By the first day of February, 1991, the first day of F ebmary 1992, and every three (3) years thereafter, the city commission shall appo:int seven (7) city electors detennined from the registration of the last regular election, one (1) to be appointed by each commission from hislher respective distrkt, and two (2) appointed by the mayor from the city at large who shall comprise the districting commission. Electors chosen shall not be employed by the. city in any other capacity. The initial districting commission, creating and estab.lishing the first commission districts, shall be appointed by each coOunissioner and the mayor from the city at large. April 13, 1998 REGULAR AGENDA ITEM G Page 2 (c) Report specifications, The di,5tricting commission shall file with the official designated by the city commission a report containing a recommended plan for establishment or adjustment of the commission district boundaries. The initial districting commission, creating and establishing the first commission districts, sha!II file such report within ninety (90) days of appointment. Thereafter, such reports shall be filed within one hundred twenty (120) days of appointment to the districting commission, The commission district boundaries shall comply with the following specifications: (1) Each district shall be ti)fmed by compact contiguous territory, and its boundary lines shall follow the center lines of streets insofar as practical or possible, or other boundaries available. (2) The districts shall be b.ised upon the principle of equal and effective " y representation as required by the United States Constitution and as represented in the mathematical preciseness reached in the legislative apportionment of the state. (3) The report shall include a map and description of the districts recommended and shall be drafted as a proposed ordinance. Once filed with the designated official, the report shall be treated as an ordinance introduced by a commissioner. (d) Support. It shall be the responsibility of the city manager to provide staff assi~itance and technical data to the districting commission. (e) Procedure, The procedure for the city commission's consideration of the report shall be the same as for oth,er ordinances, provided that if a summary of the ordinances is published pursuant to this Charter and general law, it must include both the map and a description of the recommended districts. (f) Failure to enact ordinance. The city commission shall adopt the redistricting ordinance at least one hundred twcmty (120) days before the next city election. If the city commission fails to eithericcept or reject the redistricting ordinance, the report of the districting commission shall go into effect and have the same effect of an ordinance. The proposed redistricting ordinance may not be rejected for any reason except for failure to comply with the specifications listed in section 4.02(c) of this Charter or failure to comply with other local, state or federal law. April 13, 1998 REGULAR AGENDA ITEM G Page 3 (g) Effect of enactment, The new commission districts and boundaries as of the date: of enactment shall supersede previous commission districts and boundaries for all purposes; provided all incumbent commissioners shall continue to hold office for the entire term to which elected notwithstanding any change in commission distIict and boundaries. Florida Statutes, County Organization and Intergovernmental Relations, Chapter 124, Commissioners' Districts. (1) There shall be five county commissioners' districts in each county, which shall be numbered one to five, inclusive, and shall be as nearly equal in proportion to population as possible. FINDINGS: (1) The Districting Commission was appointed by City Commission action on January 26, 1998. (2) The one hundred twenty (120) day requirement for the District Commission repOlt filing expires May 25, 1998. (3) The District Commission recommendation to the Commission allows all present City Commissioners to remain in their respective seats (4) The only portion of Florida State Statutes which approximates the "mathematical preciseness reached in the legislative apportionment of the state" is that f,:)und in Florida Statutes Section 124.01 which reads "shall be as nearly equal . in proportion to the population as possible". The District Commission recommendation to the City Commission has a difference of forty five (45) persons betwc::en the most populated district (District 2) and the least populated district (District 5). The goal that the previous Commission had was to have a one (1) percent or less difference. This recommendation has a difference of 0.15 percent. (5) The District Commission recommended, at their meeting of March 11, 1998, that the district boundary adjustments be presented to the City Commission, (6) The city commission shall adopt the redistricting ordinance at least one hundred twenty (120) days before the next election which is to be on November 2, 1999, This should be done on or before July 5, 1999. April 19, 1998 REGULAR AGENDA ITEM G Page 4 (7) The proposed districting ordinance may not be rejected for any reason except for fhilure to comply with the specifications listed in section 4.02(c) of the City Charter or failure to comply with other local, state or federal law. (8) The District Commission recommendation for district boundaries has followed the street right of ways, power easements, streams, etc., as much as possible, RECOMMENDA TION: The District Commission recommends that the City accept their recommendation for the adjustment of the district boundaries and approve the Fi.rst Reading of Ordinance No, 701. The Second Reading and adoption of this ordinance will be held at a later date. " . CALL TO ORDER The meeting was called to order at 7:05 p,m., Wednesday, March 11, 1998, by Don LeBlanc in the Conference Room of the Municipal Building (City Hall, 1126 East State Road 434, Winter Springs, Florida 32708). 2. ELECTION OF OFFICERS Board Member Doug Reid nominated Mr. Thomas Waters for Chainnan. The motion was then seconded. It was agreed unanimously by consensus of the Board. Motion passed. Board Member Doug; Reid nominated Mr. Lee Ferguson for Vice Chairman. The motion was then s4~conded. With consensus of the Board, it was accepted unanimously. MotiolJl passed. The meeting was then handed over to the newly elected Chairman Waters, 4. GOVERNING AUTHORITY AND PROCEDURES Mr. LeBlanc outlined the informational packet that had been distributed to all of the Districting Commission members, and said that this "1998" Districting Commission had 120 days (from appointment) to give the City Commission their recommendation. PRESENTATION OF STAFF RECOMMENDED BOUNDARIES Mr. LeBlanc explaine:d some of the technical details that were suggested and considered in this proposal, in addition to where the criteria was derived from to generate this proposal and recommendation" He explained that the specifications used incorporated the 1995 population, number of building permits issued, and the occupancy rate for each particular type of dwelling, Mr. LeBlanc then explained the fonnula used for each of the proposed five districts and boun.daries. There was further discussion on multi-family designations and locations in the five districts; where elected officials must live in respect to the districts in the City of Wmter Springs; boundaries of each of the districts; and which Conunissioners should be contacted for respective problems. Mr, LeBlanc then elaborated on the numerical changes in each of the five districts: => District! gave up 445 people to District 4, but then gained 621 people from District 5 => District 2 gave up 197 people to District 5 :::) District 3 gave up 161 people to District 5 => District 4 gained 445 people from District 1 => District 5 gave up 621 to District 1, but then gained 197 from District 2, and 161 from District 3 Mr. LeBlanc told the Board that the proposed plan was for three (3) years, Discussion followed about changl~ in residential building and how those changes might affect particular districts, Mr, LeBlanc advised the Board that the factors to consider are those that are in effect February !, 1998. There was concern by several Board Members that perhaps some neighborhoods (and related Homeowners ,Associations) had been split apart in this plan. Mr. LeBlanc explained that the proposed boundaries have just been expanded upon, from previous years' approved plans. Mr. LeBlanc explained that the boundary divisions were set up using streams, power easements, and streets. Further discussion ensued about specific neighborhoods and districts in regards to respective Conunissioners; voting; population density; and area acreagl~. Discussion on possibly re-drawing the boundary lines, and what comments the Commissioners had made about the proposed plan followed, There was concern voiced about future annexatioru~ and how such annexations might affect the proposed plan and those persons living in such areas. ElITURE l'1EETING SCHEDULE There was discussion as to what and when the plan will be presented to the City Commission, Mr, LeBlanc was asked if the Board Members will be notified as to when the proposed plan will be presented.
