Homes concerning off-premise advertising will be addressed in the up-coming review of our current sign ordinance. PURPOSE: The purpose of this agenda item is to inform the Mayor and City Commissi,on that questions raised by P.E.I. Homes concerning off-premi:;e advertising will be addressed in the up-coming review of our current sign ordinance which will completed within approximately ninety days. APPLICABLE LAW AND PUBLIC POLICY: The City's current sign regulations prohibit off-premise advertising and limits the location of real estate signs to the parcel being offered for sale. CONSIDERATIONS: . P.E.I. Homes has requested permission to erect signs along S.R. 434 at a location not offered for sale. The request was denied. Our current sign ordinance is under revision and the regulations concerning off-premise advertising will be reviewed. . Sec, 20-466(k),(n) of the State Road 434 redevelopment overlay zoning district regulations prohibits off-site advertising. ATTACHMENTS: 1. Sec. 16-82, Winter Springs City Code. (Sign Ordinance) 2. Sec, 20-466(k),(n) COMMISSION ACTION: (3) Marketing signs shall be set back a minimum of twenty-five (25) feet from the front, side and rear property lines, They shall not create a visibility obstruction to vehicular traffic. (4) For parcels :In excess offive (5) acres or with frontage on more than one (1) road, one (1) additional marketing sign may be permitted. Signs must be a minimum of two hundred (200) feet apart. (5) Marketing signs may be double faced. Sign faces shall be parallel and mounted on the same poles, The total copy area shall not exceed sixty-four (64) square feet and no more than hm (10) feet in height. The total of a single face shall not exceed thirty-two (32) square feet. (6) Marketing signage may be incorporated within the construction sign age, but the signage shall not exceed sixty four (64) square feet in area. (7) Marketing signs may be lit so as to illuminate the lettering on the sign. (1) Political Signs only by permit. (m) Electronic date, time and temperature informational signs are permitted. Such signs shall be counted as part of the total copy area of the overall sign. (n) Prohibited Signs: The following signs and/or devices are prohibited in the corridor, (1) Any sign or part of a sign which is designed, devised, or constructed so as to rotate, spin, gyrate, turn or move in any animated fashion. Signs shall not incorporate neon or reflective materials so as to create the appearance of motion, (2) Any sign painted directly on any exterior wall, (3) Signs projecting more than six (6) inches in depth, (4) Roof signs, (5) Bench signs. (6) Snipe signs (e.g. signs attached to trees and poles). (7) Freestanding signs unless otherwise provided for herein. (8) Trailer signs, (9) Signs attached to temporary structures. November 14, 1997 13 Redevelopment Area (10) Billboards (11) Any vehicle with a sign or signs attached thereto or placed thereon with three exceptions a.s follows: (a) any vehicle when parked or stored within the confines of a building; or (b) any vehicle upon which is placed a sign identifying a firm or its principal product if such vehicle is one which is operated during the normal course of business andl shall be parked in the least visible spot from the road; or ( c) a trailer placed on a job site during construction. (0) Permanent Flags: Only project flags or governmental flags shall be permitted in conformance with the following standards:' (1) One (1) flagpole and one (1) flag may be permitted per parcel. (2) The maximum width from top to bottom of any flag shall be twenty (20%) percent of the total distance of the flag pole. (3) Flagpoles shall maintain the same setback requirements as project identification signs. (4) Flagpole heights shall be between twenty (20) and (35) feet in height above grade. (5) A project flag shall only contain information permitted on the project identification sign. A proj ect flag shall be submitted to the Design Review Board for approval. (p) Temporary signs for special events. (1) Permits for temporary signs, such as pennant and banner signs, not otherwise prohibited alre allowed for such purposes as auctions, special events, notice of opening of new businesses, and going out of business sales. Permits for temporary signs shall authorize thl~ erection of the signs and maintenance thereof for a period not exceeding fourteen (14) days; and permits cannot be renewed on the same sign, nor shall another temporary permit be issued on the same location, within ninety (90) days from the date of expiration of any previously issued temporary permit. (2) Signs for sp'~cific events shall be removed within two (2) working days after conclusion of the event. A freestanding temporary sign shall be no larger than thirty- two (32) square feet, and may be double sided. Banner signs may be sized to extend across road~:, November 14, 1997 14 Redevelopment Area Sec. 20-466 ,(k) Marketing Signs (e.g. "Space for Rent" sign): (1) Only one (1)1 marketing sign shall be permitted on each parcel during the building's "leasing period". At the end of the leasing period, marketing signage shall be removed from the site: by the owner of the site. (2) All marketing signs shall be submitted to the City for approval and location prior to the sign's im;tallation. (Code 1974, 95-113(d)) Sec. 16-80. Political signs. Political signs may be erected as individual can- didates qualify. Signs may remain erected until forty-eight (48) hours after the last election in which the candidate is entered. Each sign shall not exceed thirty-two (32) square feet in com- mercial/industrial zoneB, and sixteen (16) square feet in residential zones, except on developed res- idential lots each sign shall not exceed six (6) square feet in area, (Code 1974, 9 5-113(e)) /' Sec. 16-81. Construction signs. Signs denoting owner, financial institution or contractors may be ereded on a lot or parcel of land under construction, Signs may remain as long as an active building permit is maintained, Collectively, the signs shall not exceed sixty-four (64) square feet per site, (Code 1974, 9 5.113(f)) -- Sec. 16-82. Real estat,e signs. (a) In residential districts, on tracts of five (5) acres or less, one (1) sign, not to exceed six (6) square feet in area shall be permitted, On tracts larger than five (5) acres, each sign shall not ex- ceed thirty-two (32) sqt:lare feet, and more than one (1) may be permittE~d provided additional lo- cations are approved by the building official and are not less than two hundred (200) feet from the nearest residence, No sign shall be erected within , a public right.of-way, (b) In residential districts in a subdivision on property which is being: developed or offered for sale, one (1) combination real estate and identifi. cation sign not to exceed one hundred (100) square feet in area, may be permitted until such time as the subdivision is completed, but not to exceed two (2) years, (c) In residential distJricts, signs exceeding six (6) square feet in area shall be placed a minimum of one hundred (100) feet from any residence, Signs " exceeding thirty-two (32) square feet in area shall be placed a minimum distance of two hundred (200) feet from any residence, (d) In commercial, agricultural and industrial districts, the copy area of real estate signs shall not exceed one hundred (100) square feet, More than one CH sign may be erected provided it does not violate other regulations of the Code, (Code 1974, 95-113(g)) Sec. 16-83. Garage sale signs. Garage sale signs are permitted on the garage sale premises only. Collectively, such signs shall not exceed six (6) square feet in area, All signs shall be removed at the end of the sale, (Code 1974, 95-113(h)) Sec. 16-84. Directional signs. Directional signs are of a permanent nature and may be permitted without expiration date. If such sign is to be located within a city right-of- way, the size and location of the sign must first be approved by the city commission and must meet the sign standards established by the state de- partment of transportation. If such sign is to be located on private property in a planned unit de. velopment, the architectural review board or in the absence of such board, the developer, shall determine its size and location, (Code 1974, 9 5-113(i)) Sec. 16-85, Bench signs. A franchise agreement between the city and the applicant shall be required before bench signs are permitted to be installed, Bench signs are permitted subject to the terms and conditions of such franchise agreement. (Code 1974, 9 5-113(j)) Sec. 16-86. Identification signs. (a) Identification signs may be located on pri- vate property in any district, provided the use or activity is permitted or approved in such a ,district.
