HomeMy WebLinkAbout1998 02 09 Regular Item C-2 ADD-ON COMMISSION AGENDA ITEM C-2 REGULAR X CONSENT INFORMATIONAL February 9. 1998 Meeting r/ ~/// MGR. ftlr' /DEll, --- Authorizat~ REQUEST: City Manager recommending the Commission to authorize the Manager to prepare a comprehensive plan amendment to establish an underlying Conservation Land Use on the unbuildable wetlands of the Battle Ridge Property to be deeded to an appropriate governmental or not-for-profit agency. PURPOSE: The purpose of this agenda item is to amend the City's comprehensive plan in order to establish an underlying Conservation Land Use for that portion of the Battle Ridge Property that is going to be deeded to a pubic or not-for-profit agency. CONSIDERA TIONS: This agenda item is needed to create an underlying Conservation Land Use designation in the City of Winter Springs Comprehensive Plan for the Battle Ridge Property wetland area. The City has a "Conservation" land use category in its comprehensive plan. In the past, the City has dealt with small environmentally sensitive areas by creating a conservation easement over the area to be conserved. The City has a proposed agreement with Battle Ridge Property for Battle Ridge Property to donate approximately 256 acres of wetlands to a public or not-for-profit agency for .conservation in perpetuity. Seminole County desires the conservation area to be protected by a comprehensive plan conservation designation, rather then in conservation easement over a R-l A Zoning District. FEBRUARY 9, 1998 ADD-ON AGENDA ITEM C-2 Page 2 To accomplish this, the City will need to apply the "Conservation" designation in its comprehensive plan to the Battle Ridge Property wetlands. By amending the proposed R-1A Zoning Ordinance scheduled for adoption tonight to have an effective date consistent with the adoption of the comprehensive plan amendment providing for the Conservation Land Use, the City Commission will not have to delay approval of the R-1A rezoning this evening. RECOMMENDATION: It is recommended that the City Commission authorize the City Manager to propose a comprehensive plan amendment to establish a "Conservation" land use designation in the City's comprehensive plan for the Battle Ridge Property wetlands. FINDINGS: None required. IMPLEMENTATION: Staff will present the proposed comprehensive plan amendment, designating the Battle Ridge Property wetlands "Conservation" to the Local Planning Agency in March, 1998. Staffwill prepare the plan amendment for transmittal to the Florida Department of Community Affairs in March, 1998. The amendment should be completed in approximately four (4) months. The R-1A rezoning will become effective upon passage of the amendment to the City's comprehensive plan in approximately four (4) months.
