PURPOSE: The purpose of this Board item is to request approval of Resolution #836 which states that the surplus FDOT right of way will be used for public purpose and authorizes the City Manager to take the necessary steps to acquire the surplus right of way. CONSIDERA TIONS: This resolution is needed to meet the Florida Department of Transportation requirements for the acquisition of surplus right of way and also to authorize the City Manager to acquire the property for the City of Winter Springs. The surplus right of way was created when the realignment of State Road 434 from S.R. 419 to Tuskawilla Road was officially completed in February of 1997. The new alignment bypassed the section known as "Wagner's Curve" where approximately 2,600 feet of right of way was not utilized as a result of the new alignment. A sketch included as Attachment No.3 depicts the old and new rights of way. The right of way proposed to be acquired will be used for the park entrance realignment. Portions of the current entrance are situated on an easement provided by the adjacent property owner. The entrance was constructed as required by DOT in order to open the park prior to the improvements to S.R. 434. The easement is revokable upon notification by the property owner which has not yet been received. When required, the entrance modifications will take into consideration the park expansion and trail. February 9, 1998 Consent Agenda Item E Page .1 FUNDING: There is no additional funding required at this time. To date, our expenses have been $1,500 for the survey and legal description. RECOMMENDATION: It is recommended that Resolution #836 be approved which states that the surplus FDOT right of way Will be used for public purpose and authorizes the City Manager to take the necessary steps to acquire the surplus right of way. IMPLEMENTATION SCHEIDULE: The resolution and signed and sealed surveys will be forwarded to FDOT and they will provide an official response to our request. ATTACHMENTS: 1. Resolution #836 2. WHEREAS, the realignment of State Road 434 has created surplus Department of Transportation right of way as described in Exhibit "A", and WHEREAS, the City of Winter Springs utilizes said right of way for ingress and egress from Central Winds Park, a public facility, and WHEREAS, the Winter Springs High School, a public school of the Seminole County School District, also uses said right of way for ingress and egress, and WHEREAS, the City of Winter Springs needs the right of way to improve and realign the entrance to Central Winds Park, NOW, THEREFORE, BE IT RESOL YED BY THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, FLORIDA, AS FOLLOWS: SECTION I - The Mayor and City Council of the City of Winter Springs hereby authorize the City Manager to enter into an agreement to acquire the surplus right of way from the Florida Department of Transportation. SECTION II - The City Clerk of The City of Winter Springs is hereby directed to send copies of this Resolution to the Department of Transportation and all other persons as directed by the Mayor and City Council. A City resolution that specifically states that the purpose of requesting and accepting our surplus land is for Public Purpose and ~lso spells out that purpose in more detail, i.e.: ~ improved access to Central Winds Park. 2. Two (2) copies of signed and sealed surveys covering surplus area and legal description too. 3. Any site plans or drawings of your proposed usage of surplus area; especially as it impacts access onto State Road 434.
