PURPOSE: The purpose of this item is to request the City Commission approve the first reading of Ordinance 691, which amends Chapter 2, Section 2-152 of the Code of Ordinances increasing the purchasing authority of the City Manager. CONSIDERA TIONS: At the November 10, 1997, City Commission meeting, Regular Agenda Item F requested the City Commission increase the City Manager's purchasing authority without formal bids from $4,000 to an approximate level between $10,000 and $15,000; and authorize the City Manager to prepare the appropriate amendment to the City's Code of Ordinances. The City Commission approved Regular Agenda Item F, increasing the City Manager's purchasing authority from $4,000 to $12,500, and directed the City Manager to prepare the appropriate amendment to the City's Code of Ordinances. Ordinance 691 amends Chapter 2, Section 2-152 of the Code of Ordinances increasing the City Manager's purchasing authority. FUNDING: No Funding Requested RECOMMENDATIONS: City Manager recommends the City Commission approve the first reading of Ordinance 691, which amends Chapter 2, Section 2-152 increasing the purchasing authority of the City Manager. ORDINANCE NO. 691 AN ORDINANCE OF THE CITY OF WINTER SPRINGS, FLORIDA, AMENDING CHAPTER 2 SECTION 2-152 (WHEN WRITTEN BIDS ARE REQUIRED; WAIVER) OF THE CODE OF ORDINANCE, PROVIDING FOR SEVERABILITY, CONF.LICTS AND AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Winter Springs, Florida has determined that the following amendments to the Code of Ordinances is in the best interest of the City of Winter Springs, Florida. NOW THEREFORE THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, FLORIDA HEREBY ORDAINS: Section I. Chapter 2 Section 2-152 of the Code of Ordinances shall be amended to read as follows: Section 2-152. When written bids are required; waiver. The City Manager is authorized to purchase or contract for all commodities and services required by the City which does not exceed twelve thousand five hundred dollars ($12,500). The City may receive written bids on purchases of more than twelve thousand five hundred dollar ($12,500), or the City Commission may waive this requirement for the best interest of the City. The City Manager is authorized to establish a system, or amend the existing system, of uniform procurement procedures and practices to supplement this policy. Additions, deletions or amendments to these procedures and practices shall be at the sole discretion of the City Manager. Section n. If any section or portion of a section of this ordinance proves to be invalid, unlawful, or unconstitutional, it shall not behMd to invalidate or impair the validity, force or effect of any section or portion of a section. Section m. All ordinances or parts of ordinances in conflict are hereby repealed. Section IV. This ordinance shall take effect immediately upon its adoption. PURPOSE: The purpose of this agenda item is for the City Commission to consider increasing the City Manager's purchasing authority without formal bids from $4,0.0.0. to a level between $10.,0.0.0. and $15,0.0.0.. CONSIDERA TIONS: At the October 27th City Commission Meeting, Commissioner McLeod requested the City Manager survey local government to determine the level of purchasing authority without formal bids being utilized by other communities. He also requested the City's current $4,0.0.0. authority established in 1974 be calculated to today's equivalent purchasing authority by use of the Consumer Price Index. This is an increase of 224.34%. The equivalent purchasing threshold at today's dollars is $12,973.60. On October 7, 1997, the City Commission of Altamonte Springs increased their purchasing authority without formal bids from $10,000 to $15,000. The reasons cited were: . Consistency with the State of Florida Threshold. . City's threshold has remained unchanged since 1991. . Inflation has increased costs of goods and services. The City Commissioners of Lake Mary and Oviedo will consider requests to increase their purchasing authority without formal bids based on similar reasons cited by Altamonte Springs. FUNDING: None RECOMMENDA TIONS: It is recommended that the City Commission increase the City Manager's purchasing authority without formal bids from $4,000 to an appropriate level between $10,000 and $15,000; and authorize the City Manager to prepare the appropriate amendment to the City's Code of Ordinances.
