HomeMy WebLinkAbout1997 05 12 Regular Item C COMMISSION AGENDA ITEM C REGULAR X CONSENT INFORMATIONAL May 12. 1997 Meeting REQUEST: Land Development Division requesting Commission approval of the Second Reading and Adoption of Ordinance No. 660 vacating a portion of of a 15 foot drainage easement located to the rear of Lot 44, Chestnut Ridge (216 Chestnut Ridge Street). PURPOSE: The purpose of this Board Item is to vacate a portion of an existing 15 foot drainage easement located to the rear of Lot 44, Chestnut Ridge (216 Chestnut Ridge Street). This will allow the owner of the property to build a screen enclosure. FINDINGS: 1.) The City Commission approved the First Reading of this proposed Ordinance No. 660 at their regular meeting on April 28, 1997. 2.) The Public Hearing for the Second Reading of Ordinance No. 660 was duly advertised in the Orlando Sentinel for the scheduled meeting of May 12, 1997. RECOMMENDATION: It is recommended that the Commission approve the Second Reading and adoption of Ordinance No. 660. ATTACHMENT: Agenda item of April 28, 1997. COMMISSION ACTION: I . Action at this meeting is for the First Reading of this Ordinance. The Second Reading and adoption of this Ordinance No. 660 will be at a later meeting. The Public W orkslUtility Director and the City Engineer have reviewed this request and have no objection to this action. CONCLUSION: The vacating of a portion of this drainage easement will allow the owner to build a screen enclosure to the rear of his property. RECOMMENDATION: It is recommended that the Commission approve the First Reading of this ordinance, and at a later meeting approve the Second Reading and adoption of the ordinance. .--.... The Public WorkslUtility Director and the City Engineer have no objection. The other utility companies are not involved with drainage easements. It is the policy of the City Manager that you review all ordinances prior to enactment. I - I I '. , , (':" ORDINANCE NO. 660 AN ORDINANCE OF THE CITY OF WINTER SPRINGS, FLORIDA VACATING, ABANDONING AND CLOSING THE SOUTHERLY 8.5 FEET OF THAT 15 FOOT DRAINAGE EASEMENT LOCATED TO THE REAR OF LOT 44, CHESTNUT RIDGE, PLAT BOOK 46, PAGES 25 AND 26, PUBLIC RECORDS OF SEMINOLE COUNTY, FLORIDA, MORE PARTICULARLY DESCRIBED AS FOLLOWS; PROVIDING FOR CONFLICTS, SEVERABILITY AND EFFECTIVE DATE. WHEREAS, the City Commission of the City of Winter Springs, Florida has determined it to be in the best interest of its citizens to vacate the drainage easement described herein; NOW, THEREFORE, be it ordained by the City Commission of the City of Winter Springs, Florida as follows: SECTION I: The City hereby vacates, abandons and closes the following described property: THA T SOUTHERLY 8.5 FEET OF THAT 15 FOOT DRAINAGE EASEMENT LOCA TED TO THE REAR OF LOT 44, CHESTNUT RIDGE, PLAT BOOK 46, PAGES 25 AND 26, PUBLIC RECORDS OF SEMINOLE COUNTY, FLORIDA. THE ABOVE DESCRIBED PARCEL OF LAND LIES IN SEMINOLE COUNTY, FLORIDA. SECTION D: That any portion of any City Ordinance in conflict herewith shall be hereby repealed.
