HomeMy WebLinkAbout1997 03 10 Regular Item A .~ y COMMISSION AGENDA ITEM A REGULAR X CONSENT INFORMATIONAL March 10, 1997 Meeting M!iR il~EPT y ~ Authorization REQUEST: Community Development Department requests the City Commission to approve the first reading for adoption of Ordinance No. 650, to annex a .229 acre parcel located on the north side of State Road 434 approximately 3,000 feet east ofD.S. 17/92. PURPOSE: The purpose of this Board Item is to request the Commission to approve the first reading of Ordinance No.650 to annex a .229 acre parcel that would be developed along with two other parcels into a Winn-Dixie Grocery Store. APPLICABLE LAW AND PUBLIC POLICY: The provisions of 171. 044( 1) Florida Statutes which states "The owner or owners of real property in an unincorporated area of a county which is contiguous to a municipality and reasonably compact may petition the governing body of a said municipality that said property be annexed to the municipality." The provisions of 171.044 F.S. which states "Upon determination by the governing body of the municipality that the petition bears the signatures of all owners of property in the area proposed to be annexed, the governing body may, at any regular meeting, adopt a nonemergency ordinance to annex said property and redefine the boundary lines of the municipality to include said property." The City has expressed an interest in annexation in the past, (ref. 8-14-95 City Commission meeting). MARCH 10, 1997 AGENDA ITEM A Page 2 CONSIDERATIONS: FINDINGS: 1. The Planning & Zoning BoardILocal Planning Agency recommends approval to the City Commission the annexation of the .229 acre parcel (parcel 3) into the City, based on the findings indicated in the Staff Report. 2. The Future Land Use Map designation and zoning designation requests for the .229 acre parcel were reviewed by the Planning & Zoning BoardILocal Planning Agency on February 5, 1996 and the Board recommeded to the City Commission that the parcel be designated "Commercial" on the City's Future Land Use Map and designated C-l "Neighborhood Commercial" on the City's Zoning Map. . The applicant is the sole (contract) owner of the .229 acre property (parcel 3). . The applicant states the intention is to develop Parcel 3 in conjunction with Parcel 1 and Parcel 3 as a Winn-Dixie Grocery Store. * * The proposed land use is compatible with the commercial nature of S.R. 434. The adjacent parcels are indicated as "Commercial" on the City's Official Future Land Use Map. * The adjacent parcels are indicated as C-l "Neighborhood Commercial" on the City's Official Zoning Map. * The Legislature recognizes that enclaves can create significant problems in planning, growth management, and service delivery, and therefore declares that it is the policy of the State to eliminate enclaves [ref 171.046(1) F.S.]. . The City has expressed an interest in annexation in the past (ref 8-14-95 City Commission meeting). RECOMMENDATION: Staff recommends approval of the first reading of Ordinance No. 650 to annex a .229 acre parcel into the City based on: 1. That it is consistent with the state policy of the Florida Legislature that, "The Legislature recognizes that enclaves can create significant problems in planning, growth management, and service delivery, and therefore declares that it is the policy of the state to eliminate enclaves. "; 4. The City has this enclave within its service area whereas the county does not; therefore, the City can best service this enclave or portions thereof with sewer and water service; IMPLEMENTATION SCHEDULE: 1. The City Commission would hold a second reading on March 24, 1997 and adopt Ordinance 650 to annex the .229 acre parcel. The ordinance for annexation immediately takes effect upon adoption. 3. The City Commission holds the first reading of an ordinance to designate the .229 acre annexed parcel on the City's Future Land Use Map on March 10, 1997, and the fu:.s1 reading of an ordinance to designate the .229 acre annexed parcel on the City's Zoning Map on March 10, 1997. 4. The City Commission holds the second reading and public hearing of an ordinance to designate the .229 acre annexed parcel on the City's Future Land Use Map on March 24, 1997, and the second reading and public hearing of an ordinance to designate the .229 acre annexed parcel on the City's Zoning Map on March 24, 1997. The ordinance for Future Land Use Map designation takes effect 31 days after adoption and, as a result, the ordinance for zoning designation takes effect 31days after adoption also. ATTACHMENTS: 1. Sec. 20-57 of the city Code which states in part "The planning and zoning board. . . .to act on measures affecting the present and future movement of traffic, the segregation of residential and business districts and the convenience and safety of persons and property in any way dependent on city planning and zoning." The City has expressed an interest in annexation in the past (ref 8-14-95 City Commission meeting). I. BACKGROUND: APPLICANT: Brandon Acquisitions, Inc. (Contract owner) 800 N. Highland Ave. Orlando, FL 32803 (407) 843-4000 OWNER: Big Cypress Associates, Inc. 833 N. Highland Ave., Suite 2-B Orlando, FL 32803 REQUEST: Annexation of .229 acre parcel (parcel 3) into the City. PURPOSE: Applicant wants the .229 acre parcel annexed into the City to d~:velop it under the same City regulations as parcel 2 and parcel 1 and to complete the frontage of the development on S.R. 434. PROPERTY: Location: Approximately 3,000 feet east of the intersection ofS.R. 434 and U.S. 17/92 on the north side of S.R. 434 opposite Timberlane Drive. Legal Description: That portion of Lot 57 Block "D" D.R. Mitchell's Survey of the Levy Grant as recorded in Plat Book 1, Page 5, Public Records of Seminole county, Florida lying north of State Road 434 and west of the Florida Power Corporation Easement. ACREAGE: .229 acres "more or less",- PARCEL NUMBER: 33-20-30-515-0103-0000 EXISTING LAND USE OF SUBJECT PROPERTY: Vacant, no trees, grassed area. CHRONOLOGY OF SUBJECT PROPERTY: Parcel was part of the only portion of the City of Casselberry that extended on the north side of S.R. 434. Casselberry deannexed the parcel recognizing that such a small part of the city was of no value and that it created confusion in the recognition of city boundaries. ORDINANCE NO. 650 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, FLORIDA, ANNEXING A .229 ACRE PARCEL OF LAND LOCATED 3, 000 FEET EAST FROM THE INTERSECTION OF STATE ROAD 434 AND U.S. 17/92 ON THE NORTH SIDE OF STATE ROAD 434 PURSUANT TO 171.044(1) (2) and 166.041 FLORIDA STATUTES; PROVIDING FOR SEVERABILITY; CONFLICTS AND AN EP'FECTIVE DATE. WHEREAS, the applicant, Brandon Acquisitions, Inc. , authorized representative of the owner of the following described property, has petitioned the City of winter Springs to be annexed into the City and has requested the City's sewer and water service, WHEREAS, annexation of this parcel is consistent with the policy of the Florida Legislature wherein the Legislature "recognizes that enclaves can create significant problems in planning, growth management, and service deliver, and therefore declares that it is the policy of the state to eliminate enclaves." WHEREAS, the city can better providE~ sewer and water service to the subject parcel than the county. NOW, THEREFORE, THE CITY OF WINTER SPRINGS, FLORIDA HEREBY ORDAINS; SECTION I - That the City of winter Springs annexes the following described real property: THAT PORTION OF LOT 57, OF BLOCK "0", D.R. ~, If- MITCHELL'S SURVEY OF THE LEVY GRANT, AS RECORDED IN PLAT BOOK 1, PAGE 5, PUBLIC RECORDS OF SEMINOLE COUNTY, FLORIDA LYING NORTH OF STATE ROAD 434 AND WEST OF THE FLORIDA POWER CORPORATION EASEMENT. SECTION II - If any section or portion of this Ordinance proves to be invalid, unlawful or unconstitutional, it shall not be held to invalidate or impair the validity, force or effect of any other section or portion of a section or subsection or part of this Ordinance. SECTION III - That all Ordinances or parts of Ordinances in conflict herewith are hereby repealed.
