Rh-0 IDER. -..j ~ Authorization REQUEST: Community Development Department advising the City Commission of the City's intent to seek request for proposals (RFP) from consultants to conduct and Evaluation and Appraisal Report (EAR) of the City's Comprehensive Plan. PURPOSE: The purpose of this Board Item is to advise the Commission that the City needs to prepare notice for request for proposals (RFP) from consultants to prepare and Evaluation and Appraisal Report of the City's comprehensive Plan as required by state law. APPLICABLE LAW AND PUBLIC POLICY: The provisions of 163.3191(1) F.S. which states "The planning program shall be a continuous and ongoing process. The local planning agency shall prepare periodic reports on the comprehensive plan, which shall be sent to the governing body and to the state land planning agency at least once every 5 years after the adoption of the comprehensive plan. Reports may be transmitted at lesser intervals as may be required or upon request of the governing body. It is the intent of this act that adopted comprehensive plans be periodically updated as provided by this section through the evaluation and appraisal report. The evaluation and appraisal report process shall be the principal process for updating local comprehensive plans to reflect changes in state policy on planning and growth management. " The provisions of 163.3191(5) F.S. states "The first periodic report (EAR) for each local government shall be prepared not later than 7 years after the adoption of the comprehensive plan. Every other periodic report shall be prepared not more than an additional 5 years thereafter. " Rule Chapter 9J-33.005 F.A.C. establishes the schedule for when the Ear must be adopted by the local governing body. Three (3) months prior to the dates included in the schedule, the Local Planning Agency must transmit the draft EAR to the City Commission and to the Florida Department of Community Affairs (DCA). I '''"' .... .. ~ ... FEBRUARY 10, 1997 AGENDA ITEM Page 2 CONSIDERATIONS: . For the City of Winter Springs, the draft EAR must be in the offices of DCA by 5:00 p.m. June 3, 1998. The adoption date of the EAR by the City Commission is September 1, 1998. . It requires approximately one (1) year to complete all the data and analysis requirements indicated in 163.3191(2) F.S. . DCA has allocated $ 14,069 to local governments to aid in preparation of the EAR in accordance with Chapter 163 Part II and Chapter 9J-5 F.A.C. and pursuant to the 1996/97 General Appropriations Act Line Item 1075 of the Florida Legislature. The local government receives an initial 25% ($ 3,517.25) upon submission of a work product identifying who will do the various required sections and dates when they will be submitted to DCA. The remaining 75% ($ 10,551.75) will be paid upon submission offour (4) additional specified work products. . The 1996/97 Community Development Department was budgeted for $ 8,000 for consulting services as of January, 1997. . For a city the size and complexity of Winter Springs the cost of preparation ofan EAR would be approximately $ 30,000 to $ 35,000.
