HomeMy WebLinkAbout1997 01 13 Informational Item A i {, COMMISSION AGENDA ITEM A REGULAR CONSENT INFORMATIONAL X January 13. 1997 Meeting MGR I~IDEPT JpJ-- Authorization REQUEST: Public Works Department Advising the City Commission as to the Status of the City of Altamonte Springs Permit Application to Discharge Lake Orienta Stormwaters into the Gee Creek Basin. PURPOSE: The purpose of this Board item is to update the City Commission on the success to date of the Lake Orienta stormwater runoff opposition efforts including costs of the interlocal with the City of Casselberry. CONSIDERATIONS: The City Commission authorized the execution of an interlocal agreement with the City of Casselberry on July 8, 1996 to jointly pursue the denial of a St. Johns River Water Management District Permit for the City of Altamonte Springs to use Gee Creek for flood and drainage control. This joint effort has resulted in a SJRWMD staff recommendation for permit denial. To date, the City of Altamonte Springs has not yet and is not expected to file any appeal for a hearing nor pursue formal SJRWMD Board action given the status of their permit application. A copy of the Casselberry City Manager's status letter is attached. The cost for the interlocal agreement to date has been $4,837.67 which was paid from the Stormwater Utility Fund. We do not expect any significant additional costs based the current inactivity of the permit application. ATTACHMENTS: 1. Mail Dear Ron: As we discussed, I am herewith providing a brief status report on the Lake Orienta stormwater runoff opposition efforts. First, as you know, the City of Altamonte Springs' revised request to the St. John's River Water Management District for approval of a permit regarding Lake Orienta stormwater through the Gee Creek Basin received negative (denial) response from the Water Management District staff. We are told, as a result, that the permit is unlikely to proceed in any way based on the negative staff position and normal Board protocol therewith. Further, it is our understanding that Altamonte Springs has not yet and is not expected to file any appeal for a Florida Administrative Code hearing on the matter, nor pursue formal Board action given the status of their permit application. We understand that Altamonte Springs retains their stormwater problem regarding Lake Orienta and intends to pursue other alternatives for the water which would not directly affect the Gee Creek Basin on a . stormwater through-pass basis, as had been the case. Since we have not been directly involved in the study of their problems and alternatives, my staff is not in a position to give further details on the specificity of their plans in this regard', -- Please contact me directly should you desire further information on our efforts or the status of the permit application. The District has permitting jurisdiction under Chapters 40C-l, 40C-42, or 40C-4, F.A.C., Chapters 120 and 373, F.S., and delegated portions of Chapter 403, F.S. for WRM permit applications. The District gives notice of its intent to deny the request for a permit by the following applicant on September 10, 1996: CITY OF ALTAMONTE SPRINGS, ATTN: DONALD F. NEWNHAM, P. E., 225 NEWBURY PORT AVENUE, ALTAMONTE SPRINGS, FL 32701, application #4-117-0368AGY-ERP. The project is located in Seminole County, Sections 13 & 24, Township 21 South, Range 29 East. The ERP application is to CONSTRUCT A 2 MGD SURFACE WATER PUMP STATION WITH AN ALUM TREATMENT SYSTEM TO PUMP WATER FROM LAKE ORIENTA TO PRAIRIE LAKE DURING THE MONTHS OF NOVEMBER 1 THROUGH APRIL 30 IN ORDER TO RECOVER THE FLOOD STORAGE WITHIN LAKE ORIENTA BEFORE THE RAINY SEASON, MAY 1 THROUGH OCTOBER 31. The receiving waterbody is PRAIRIE LAKE. PETITIONS FOR FORMAL ADMINISTRATIVE PROCEEDINGS Any person whose substantial interests ,are or may be affected by this Notice of Intended Aqency Action, may petition for an administrati.ve h~aring in accordance with section 120.57, F.S. Petitions for an administrative hearing on the above application must be "filed" (See Notice of Rights) by you within nineteen (19) days of the District depositing this Notice of Intended Agency Action in the mail. Failure to file a petition within this time period shall consti~ute~a, waiver of any rights you may have to request an administrative determination (hearing) under section 120.57, F.S., concerning the subject permit application. Petitions which are not filed in accordance with the Notice of Rights are subject to dismissal. Attached is a Notice of Rights. You are entitled to appear at the public meeting to address the Governing Board concerning the application. The staff recommendation, any presentation by you or others, and any objections will be considered by the Board before a final permit decision is made. OTHER INFORMATION If you wish to receive a copy of the Technical Staff Report (TSR) which provides the staff's analysis of the application and any recommended conditions on the proposed permit, please submit your request to receive the TSR to the Director of Permit Data Services at the address listed above. The file(s) containing the application is available for inspection Monday through Friday except for legal holidays, 8:00 a.m. to 5:00 p.m. at the St. Johns River Water Management District Headquarters, Highway 100 West, Pa1atka, Florida. You may also view files at one of the District's Field Offices, but you should call Field Office staff in advance to make sure that. the files are at a specific Field Office. The Governing Board will consider this permit application during the meeting which begins at 1:00 p.m. on September 10, 1996, or as soon thereafter as it may come to be heard at: st. Agenda items scheduled for action on Tuesday, September 10, 1996, may be postponed for consideration at the Governing Board meeting which begins at 9:00 a.m on September 11, 1996.
