Authorization REQUEST: The City Manager is requesting the Commission hold a Public Hearing relative to the second reading and approval of Ordinance No. 624 relative to the adoption of Final Budget for Fiscal Year 1996-1997. PURPOSE: The purpose of this agenda item is to have the Commission adopt Ordinance No. 624 and approval of the Final Budget for Fiscal Year 1997. CONSIDERATIONS: The actions requested in this agenda item are necessary to comply with Statutory requirements of adopting a balanced budget to enable the City to effectively operate. 1. Hold Public Hearing on the Second reading of Budget Ordinance No. 624 and adopt same. 2. Re-Adopt: (a) Resolution 796 setting the Ad Valorem Tax Millage Rate for Fiscal Year 1996-1997. RECOMMENDATION: 1. The Commission hold a Public Hearing relative to adoption of the Ad Valorem Tax Millage Rate and Final Budget for Fiscal Year 1997, and 2) Approve for second reading Ordinance 624 establishing the Fiscal Year 1997 budget, and 3) Re-adopt Resolution No. 796 setting the at 3.6083 mils. IMPLEMENTATION SCHEDULE: Effective October 1, 1996 upon approval of City Commission. ATTACHMENTS: a. Resolution No. 796 b Ordinance No.624 for Second Reading. c Pinal Budget COMMISSION ACTION: ORDINANCE NO. 624 AN ORDINANCE OF THE CITY OF WINTER SPRINGS, FLORIDA, ADOPTING THE MUNICIPAL BUDGET FOR THE FISCAL YEAR 1996-1997; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; SEVERABILITY; CONFLICTS AND EFFECTIVE DATE. WHEREAS, the City Commission of the City of Winter Springs, Florida, must establish the budget for the City of Winter Springs, Florida, for the forthcoming fiscal year beginning on the first (1 st) day of October, 1996, through the thirtieth (30) day of September 1997; and WHEREAS, the City Commission of the City of Winter Springs, Florida, has made a detenrunation of the anticipated amounts of revenues available and the corresponding appropriations and expenditures. NOW, THEREFORE, THE CITY OF WINTER SPRINGS, FLORIDA, HEREBY ORDAINS: SECTION 1: that the proposed Budget for fiscal year beginning October 1, 1996 through September 30, 1997 as attached hereto as Appendix "A" (General Municipal and Utility Budget) is declared to be adopted as the Annual Budget for the City of Winter Springs, Florida, for the fiscal year 1996-1997. SECTION II: That all ordinances or parts of ordinances in conflict herewith shall be and the same are hereby repealed. SECTION III: If any section or portion of a section or sub-section of this Ordinance proves to be invalid, unlawful or unconstitutional, it shall not be held to invalidate or to impair the validity, force or effect of any other section or portion of a section or sub- section or part of this Ordinance. SECTION IV: This Ordinance shall take effect October 1, 1996. PASSED AND ADOPTED this CITY OF WINTER SPRINGS JOHN F. RESOLUTION NO. 796 A RESOLUTION OF THE CITY OF WINTER SPRINGS, FLORIDA, SETTING THE AD VALOREM TAX MILLAGE RATE AT 3.6083 FOR THE CITY OF WINTER SPRINGS, FLORIDA, FOR THE FISCAL YEAR 1996-1997, SEVERABILITY CONFLICTS AND EFFECTIVE DATE. WHEREAS, the City Commission of Winter Springs, Florida, pursuant to the general laws of the State of Florida, must set the Ad valorem tax millage rate for the City of Winter springs, Florida, and WHEREAS, the City Commission deems it to be necessary and in the best interest of the citizens of Winter Springs, Florida, to set the Ad Valorem millage rate at 3.6083 mills and thus continue the services now offered by the City as well as provide funds for the continued growth of the City and to fund the budget for Fiscal Year 1996-1997, and WHEREAS, the City Commission is required by law to state the percent, if any, by which the millage rate to be levied exceeds the rolled back rate, and characterize such as the percentage increase in property taxes adopted by the Commission. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, FLORIDA: SECTION I: That pursuant to the General Laws of the State of Florida, the Ad Valorem Tax millage rate is set at 3.6083 mills for the year 1996 through 1997 and said certified millage rate shall be forwarded to the County Property Appraiser. SECTION II: That the Ad Valorem millage rate of3.6083 mills is set so that the City of Winter Springs, Florida, will be able to continue existing services and provide for future growth and City Commission deems it to be in the best interest of the citizens of Winter Springs, Florida, that said 3.6083 mills be established as the Ad Valorem tax millage rate to enable the City to completely fund the City's budget for the fiscal year beginning October 1, 1996 and ending September 30, 1997. SECTION III: That the millage rate of3.6083 mills exceeds the rolled back rate of3.6083 mills by (.0000) mills and is in fact a .0000% change in property taxes. SECTION IV: This Resolution shall remain in force until supplemented, amended, repealed or otherwise altered. SECTION V: All resolutions or parts of resolutions in conflict with this resolution are hereby repealed. SECTION VI: This resolution shall take immediate effect upon its passage and approval.
