REQUEST: Land Management Division requesting Commission approval of Ordinance No. 625
to vacate a portion of the drainage and utility easement located along the lot line
between lots 231 and 232, Tuscawilla Unit 14B (679 and 681 Canadice Court).
Action at the meeting of April 22, 1996 is for the First Reading of this ordinance. The
Second Reading and adoption of this Ordinance No. 625 will be at a later meeting.
PURPOSE: The purpose of this Board item is to vacate a portion of the existing drainage and
utility easement located along the lot line between Lots 231 and 232, Tuscawilla Unit
14B (679 and 681 Canadice Court). A future request by the owner of these lots will
be for a lot split of Lot 232 and to combine a portion of Lot 232 with all of Lot 231
which will make this a buildable lot.
FINDINGS: 1) A substantial portion of Lot 231 and a smaller part of Lot 232 were taken for the
road Right-of-Way for the Expressway (ORB 2084, Pages 1462-1465, Public
Records, Seminole County, Florida) causing Lot 231 to be non-buildable because of
Deed Restrictions.
2) The '~otice of Restrictions on Real Estate" (ORB 1832, Pages 0928-0933, Public
Records, Seminole County, Florida) state: '~o dwelling shall be constructed on a plot
having an area of less than 15,000 square feet, and such plot shall be not less than 80
feet in width at the front building set-back line. No dwelling shall be erected nearer
than 35 feet to the front lot line nor farther than 60 feet from the front lot line. No
dwelling shall be erected nearer than 30 feet to the rear lot line .....".

3) Acccording to the recorded Plat of Tuscawilla Unit 14B (Plat Book 37, Pages
6-10, Public Records of Seminole County, Florida) "There is a 7.5 Drainage
and Utility Easement reserved along all rear and side lot lines, except adjacent
to street right of ways or unless otherwise shown.".
4) All concerned utility companies have reviewed the drainage and utility
easement proposed to be vacated and have offered no objection to this action.
CONCLUSION:
The vacating and abandonment of this utility easement will allow the owner of
Lot 232 to proceed with a request of a lot split and to combine this split with all
of Lot 231 and make one (1) buildable lot.
RECOMMENDA TION:
It is recommended that the Commission approve the First Reading of this
ordinance and at a later meeting approve the Second Reading and Adoption of the
ordinance.

Dear Dr. Maninez and Dr. Lozano:
I am in receipt of your letter requesting the vacating of the easement between lots 231 and 232 in
Chelsea Woods, The City of Winter Springs Utility Department has no objections to vacating the
Drainage and Utility Easements comprising the Northwesterly 7.5 feet of Lot 231, and the
Southeasterly 7.5 feet of Lot 232 in Tuscwilla Unit 14B, as described on sheet three of Seminole
County Plat Book 37 Page 8, The vacating oftrus easement is inclusive of the 100 foot Florida
Power and Light easement.
1 want to caution you that there may be a problem supplying water and sewer service to these lots
jf they are split into three lots, If you have any questions please call.

Dear Dr. Martinez and Dr. Lozano:
Florida Power Corporation has no objection to the abandonment of those certain 7.5 foot wide
Drainage and Utility Easements comprising the Northwesterly 7.5 feet of Lot 231, and the
Southeasterly 7.5 feet of Lot 232, TUSCAWILLA UNIT 14 B, as recorded in Plat Book 37, Pages
6 through 10, of the Public Records of Seminole County, Florida; LESS and EXCEPT those
portions of the aforesaid Lots 231 and 232, lying within that certain 100 foot wide Florida Power
Corporation Easement, recorded in Deed Book 193, Page 304, of the Public Records of Seminole
County, Florida.

7.5 FOOT \VIDE DRAINAGE AND UTILITY EASEMENTS COlVIPRISING
THE NORTHWESTERLY 7.5 FEET OF LOT 231, Ai'll) THE
SOUTHEASTERLY 7.5 FEET OF LOT 232, TUSCAWlLLA UNIT 14B
AS RECORDED IN PLAT BOOK 37, PAGES 6 THROUGH 10, PUBLIC
RECORDS OF SElVIINOLE COUNTY, FLORIDA, LESS Ai~ EXCEPT
THOSE PORTIONS OF THE AFORESAID LOTS 231 AND 232 LYING
WITHIN THAT CERTAIN 100 FOOT WIDE FLORIDA POWER
CORPORATION EASElVIENT, RECORDED IN DEED BOOK 193, PAGE
304, PUBLIC RECORDS OF SElVIINOLE COUNTY, FLORIDA, lVIORE
PARTICULARLY DESCRIBED AS FOLLOWS; PROVIDING FOR
CONFLICTS, SEVERAB~ITY AND EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Winter Springs, Florida has determined
it to be in the best interest of its citizens to vacate the drainage and utility easement described
herein;
NO\V, THEREFORE, be it ordained by the City Commission of the City of Winter
Springs, Florida as follows:
SECTION I: The City hereby vacates, abandons and closes the following described
property:
THOSE CERTAIN 7.5 FOOT WIDE DRAINAGE' AND UTILITY EASEMENTS
COlVIPRISING THE NORTHWESTERLY 7.5 FEET OF LOT 231, AND THE
SOUTHEASTERLY 7.5 FEET OF LOT 232, TUSCAWlLLA UNIT 14B AS
RECORDED IN PLAT BOOK 37, PAGES 6 THROUGH 10, PUBLIC RECORDS
OF SElVIINOLE COUNTY, FLORIDA, LESS AND EXCEPT THOSE PORTIONS
OF THE AFORESAID LOTS 231 AND 232 LYING \VITHIN THAT CERTAIN
100 FOOT WIDE FLORIDA POWER CORPOR;\. TION EASEMENT,
RECORDED IN DEED BOOK 193, PAGE 304, PUBLIC RECORDS OF
SElVIINOLE COUNTY, FLORIDA.
THE ABOVE DESCRIBED PARCEL OF LAND LIES IN SEMINOLE COUNTY,
FLORIDA.

SECTION II: That any portion of any City Ordinance in conflict herewith shall be hereby
repealed.
SECTION ill: This Ordinance shall be effective upon its passage.
