HomeMy WebLinkAbout1996 08 12 Regular Item B '.- COMMISSION AGENDA ITEM B REGULAR X CONSENT INFORMATIONAL August 12. 1996 Meeting MGR. ;(1iI11 IDEPT. ~ Authorization REQUEST: Land Management Division requesting approval of the Site Plan Review Board's recommendation that the subdivision entry walls and privacy gates for Seville Chase Subdivision (Earley property) be approved. PURPOSE: The purpose of this Board item is to approve the subdivision entry walls and privacy gates for Seville Chase Subdivision. Approval action will allow the developer to commence construction, with the proper permits, of the entry walls and the privacy gates associated with the subdivision, This subdivision is located east of Fisher Road, south of Panama Road, west of the Florida Power easement and north of Dunmar Circle, APPLICABLE CODE: Southern Building Code, Chapter 16, Section 1606 Wind Loads Section 1606.1 Applications All buildings, structures and parts thereof shall be designed to withstand the appropriate wind loads prescribed herein . . . . (Wind loads for this area are 100 miles per hour). Section 9-346. Prohibitions. Except that used for a single-family dwelling, no parcel of land within the city shall be developed or improved by construction of any nature without a site plan having been first submitted, reviewed and approved as herein set forth, such approval to be valid for a period not to exceed one (I) year. Upon receipt of written application, the site plan review board may extend the approval for a period not to exceed six (6) months. If development has not commenced within one (1) year from the date of approval or within any extension period authorized by the board, the approval of the site plan originally submitted shall be considered null and void and no development or improvement of any August 12, 1996 AGENDA ITEM B Page 2 nature may take place until such time as a site plan is resubmitted for review and approval as set forth in this chapter. No building permit shall be issued by the city until the site plan has been finally approved by the board or the city commission when applicable, No work of any nature shall commence on the property until a building permit has been issued, except with the express approval of the board or the city commission when applicable, CHRONOLOGY: December 11, 1995 - Final Engineering approve by Commission July 11, 1996 - Entry walls and privacy gates construction plans submitted July 17, 1996 - Site Plan Review Board meeting FINDINGS: 1, The City Engineer has determined that the wall design meets the 100 mile per hour wind load criteria, 2, The Staff has recommended that the wall and privacy gates be approved with two (2) stipulations, These are: a) the wall at the Shore Road entry is to be moved back to ensure that sight clearance, for public safety reasons, is met; and, b) the developer must adhere to the Fire Chiefs memorandum dated July 16, 1996 addressing privacy gate codes. 3. The highest portion of the entry wall will be 9' 10". The Commission has previously approved a height of 10' for Parcel 80 (The Reserve at Tuscawilla) on August 22, 1994, August 12, 1996 AGENDA ITEM Page 3 CONCLUSION: The Site Plan Review Board has found this project to be in compliance with applicable laws and requirements. No land clearing burning has been authorized in the City since direction from the City Commission issued on September 25, 1995. The developer will be required to do what is necessary to properly dispose of such materials, . The entrance privacy gate(s) will require: 1. A separate public safety receiver installation that will be controlled by the City for entrance purposes. 2. The developer to supply the City with the keypad entrance code to the community, and the homeowner's association must notify the City of any changes of the code. 3. The entrance privacy gate must go to a fully opened position upon a power failure to the device. 4. The gate(s) when opened must allow a minimum of 12' of clear passage to and from the community. 5. Tuscawilla Parcel 80 (94-SUB-l)-Approval/Disapproval of Final Engineering and Initial Review of Covenants (that property located South of SR 434, North of CSX Railroad and to the immediate West of Howell Branch Creek): Mr. Gosline, Community Development Director, said' the project is recommended for approval. He said the lots along the creek have been eliminated from Commission action this evening because the determination of FEMA of the flood plain line is still pending. Those lots would come back in a Phase 3 once that issue is resolved. Attorney Kruppenbacher said the same comment regarding the covenants as the prior two developments. Mr.Culp explained there was another item to deal with. He said at the entry to the two phases of the subdivision the archways and two main columns would exceed the City's requirement for a maximum of 8 ft. height. At the two entries the two main columns and the arch would go to a maximum of 10 ft. He asked for the Commission's approval. Motion was made by Commissioner Torcaso for approval of final engineering and initial review of covenants, subject to the finalization of the covenants and homeowner documents in accordance with the negotiations in their presentations that have taken place. Seconded by Commissioner Langellotti. Discussion. City Attorney Frank Kruppenbacher: Attorney Kruppenbacher reported that the City Manager has directed the Executive Director of the Senior Center to go forward and do a more indepth analysis of the other senior centers. One survey was done but based upon the input received, City Manager Govoruhk thought there should be follow up on that.
