Authorization REQUEST: The Parks and Recreation Department is requesting that the City Commission approve Resolution 2009-26, an amendment to Resolution 2008-55, which established new fees and charges for use of City Facilities and Program participation. PURPOSE: The purpose of this item is to receive Commission approval for Resolution 2009-26, an amendment to Resolution 2008-55, to remove the Splash Playground Fees if purchased after April 30, 2009 and have one fee structure per season and to correct a scribners error on a Civic Center Rental Fee. CONSIDERATIONS: • At the March 9, 2009 City Commission meeting, the City Commission passed a motion that a single fee structure -the fees that were proposed before Apri130, be the seasonal fees for the Splash Playground. The fees are as follows: Seminole County residents $10 per person, per season; Family Rates: lperson - $10 per person, per season, 2 or more family members - $5 per person, per season; $30 Maximum per family. Non Seminole County residents: $10 per person, per day. • The City Attorney and staff have made the change to Resolution in Resolution 2009-26. • Staff also noticed a scribner's error in the fee schedule for the Civic Center of $376 for a 5 hour rental and recommends that it be corrected at this time to $336 fora 5 hour rental. This change is also in Resolution 2009-26. RECOMMENDATIONS: The Parks and Recreation Department recommends approval of Resolution 2009-26, an amendment to Resolution 2008-55. ATTACHMENTS: Attachment #1 Resolution 2009-26 with Exhibit "A" COMMISSION ACTION: r i RESOLUTION NO. 2009-26 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, FLORIDA, AMENDING RESOLUTION 2008-55 TO REVISE THE SCHEDULE OF FEES FOR VARIOUS PARKS AND RECREATION FACILITY USES AND ACTIVITIES; PROVIDING FOR REPEAL OF PRIOR INCONSISTENT RESOLUTIONS; SEVERABILITY AND AN EFFECTIVE DATE. WHEREAS, the City is granted the authority, under Section 2(b), Article VIII, of the State Constitution, to exercise any power for municipal purposes, except when expressly prohibited by law; and WHEREAS, the City Commission has the authority to establish fees pursuant to section 166.201, Florida Statutes; and WHEREAS, the City Commission adopted Resolution 2008-55 on December 8, 2008 setting forth a revised and amended fee schedule for facility uses and activities within the City; and WHEREAS, the City Commission desires to revise the fees for the City's splash playgrounds and to correct an error reflected in the Civic Center fees adopted by Resolution 2008- 55, as set forth in this Resolution; and WHEREAS, the City Commission of the City of Winter Springs finds that this Resolution is in the best interests of the public health, safety, and welfare of the citizens of Winter Springs. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, SEMINOLE COUNTY, FLORIDA, AS FOLLOWS: Section 1. Recitals. The foregoing recitals are deemed true and correct and are hereby fully incorporated herein by this reference. Section 2. Fees Established. The City Commission hereby adopts the fee schedule set forth in Exhibit "A," attached hereto and fully incorporated herein by this reference. The fees set forth in Exhibit "A" shall become effective immediately upon adoption of this Resolution by the City Commission. Section 3. Repeal of Prior Inconsistent Resolutions. All prior inconsistent resolutions adopted by the City Commission, or parts of prior resolutions in conflict herewith, are hereby repealed to the extent of the conflict. If any section, subsection, sentence, clause, phrase, word, or portion of this resolution is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion hereto. Section 5. Effective date. This Resolution shall become effective immediately upon adoption by the City Commission.
