REQUEST: General Services Department requesting the Commission to consider approval of
the first reading of Ordinance 620, amending Section 2-152 of the City Code
providing the Commission authority to waive bidding requirements when
deemed in the best interest of the City.
PURPOSE: The purpose of this Agenda Item is to give the Commission the flexibility to
waive bidding requirements when the Commission finds that it is in the best
interest of the City to do so.
CONSIDERA TIONS:
As written Section 2-152 requires bids for all items over $4000. This is a very
rigid provision which fails to provide the Commission with common sense
discretion in the procurement process.
Unless constricted by other applicable law the proposed amendment will give the
Commission the option to waive bidding for a sole source procurement, or the
renegotiations of a contract over $4000.

RECOMMENDATION:
The City Manager is recommending that the Commission adopt the first reading
of Ordinance 620, amending Section 2-152 of the City code providing the
Commission the authority to waive bidding requirements for procurement in
excess of $4000 when it determines such waivers to be in the long term best
interest of the City.
IMPLEMENTATION SCHEDULE:
This item will be returned to the Commission on June 24, 1996 for second
reading and implemented immediately following the adoption of the second
reading.

AN ORDINANCE OF THE CITY OF WINTER SPRINGS,
FLORIDA, AMENDING SECTION 2-152, WHEN WRITTEN
BIDS ARE REQUIRED, OF THE CODE OF ORDINANCES OF
THE CITY OF WINTER SPRINGS, FLORIDA; PROVIDING
FOR PURCHASES WITHOUT BIDS; PROVIDING FOR
CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE.
WHEREAS, the City of Winter Springs, Florida, finds it to be in the best interest
of the City and its citizens, to provide for greater flexibility in the purchase of services and goods
than presently permitted by City Code.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF WINTER SPRINGS,
FLORIDA, THAT:
CHAPTER 2 OF THE CODE OF ORDINANCES IS
HEREBY AMENDED AS FOLLOWS:
ARTICLE VI.
FINANCE
Section 2-152.
When written bids are required; waiver.
"The City shall receive written bids on all purchases for more than
four thousand dollars ($4,000.00), unless this requirement is waived
upon unanimous vote by the City Commission. Nothing herein shall
be construed as a waiver of the requirement to comply with Florida
law in the purchase of its services and supplies."
SECTION II. CONFLICTS. All ordinances or resolutions in conflict herewith
are hereby repealed. Nothing herein shall be construed as a waiver of applicable federal or state
law.
SECTION m. SEVERABILITY. Ifany section or portion ofa section of this
Ordinance proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or
impair the validity, force, or effect of any other section or part of this Ordinance.
SECTION IV. EFFECTIVE DATE. This Ordinance shall become effective in
accordance with Florida law.
