COMMISSION AGENDA ITEM E REGULAR CONSENT X INFORMATIONAL June 10. 1996 Meeting MGR tf;,..v;lV1 IDEPT , Authorization REQUEST: City Manager requesting the Commission to consider approval of a short tenn Consulting Agreement with retired Chief, Charles Sexton to perfonn certain services for the City. PURPOSE: The purpose of this item is to enter into a short term contract with retired Chief, Charles Sexton to work with the City Manager on several law enforcement related matters that need to be addressed in the upcoming four month's period. CONSIDERA TIONS: On May 29, 1996 Police Chief Charles Sexton retired from the Winter Springs Police Department. Chief Sexton's assistance in perfonning the following scope of services would greatly assist the department during the period of time that the department is without a full time chief. 1) Coordination of the Trotwood/Tuscawilla intersection school traffic routing study including installation of a left hand turn signal at the earliest possible time. 2) Completion of the updating of the Police Department's General Orders. 3) Review of speed limits on collector streets for the purpose of determining where changes are indicated. 4) Coordination of the department's transition to the 800 Mhz radio system. Page 1 .. <l 5) Continuing to represent the department on the Seminole County Law Enforcement Assessment Center Committee. These are projects in which the Chief was extensively involved or in which he has extensive knowledge. During this period Chief Sexton would report directly to the City Manager. It is anticipated that he could complete these projects working approximately 20 hours weekly for the four month period. I am recommending that he be paid $3,000.00 a month for a total of $12,000.00 during the four month period. ISSUE ANALYSIS: None FUNDING: There are ample funds to pay for this Agreement in the Police Department Budget. RECOMMENDATION: It is recommended that the Commission approve a four month's professional services agreement with retired Police Chief, Charles Sexton in the amount of $3000.00 per month to complete the projects enumerated above. IMPLEMENTATION SCHEDULE: The agreement would begin on June 17, 1996 and terminate on October 16, 1996. ATTACHMENTS: COMMISSION ACTION: Page 2 "0 ;l. THE CITY OF WINTER SPRINGS INDEPENDENT CONTRACTOR CONSULTING AGREEMENT THIS AGREEMENT entered into this _day of ,1996, by and between THE CITY OF WINTER SPRINGS, FLORIDA, a political subdivision of the State of Florida (hereinafter referred to as "City") and CHARLES SEXTON (hereinafter referred to as "Consultant") provides as follows: WHEREAS, Consultant previously served as a police officer for the City for twenty-one plus years culminating in his having served as police chief, and WHEREAS, City is desirous of utilizing Consultant expertise and knowledge during the transition period to the selection and employment of a permanent police chief; NOW, THEREFORE, for and in consideration of the mutual promises hereinafter e:\.-pressed and exchanged, the parties agree as follows: 1. Effective June 17 1996, Consultant agrees to provide his police expertise and counsel to City for the period June 17, 1996 to October 16, 1996. During said time, Consultant will perform the services outlined in the scope of services contained in the attached Winter Springs Commission Consent Agenda Item E of June 10, 1996, and be available for consultations with City at any time during the day. 2. City agrees to pay Consultant the sum of $.uJillQ. ($3.000) per month for the period from June 17, 1996 to October 16 1996 payable on or before the fifteenth (15th) day of each month, for said consulting services. 3. Nothing herein shall be construed to create an employer-employee relationship between City or Consultant. Consultant is and shall remain an independent contractor liable for his own insurance, all obligations concerning applicable tax liability for the consulting fees paid herein, expenses incurred in providing the services required under this Agreement, and any other applicable costs or expenses associated with his consulting service. 4. This Agreement is intended as the finaJ. complete and exclusive statement of the terms of the parties' Agreement and is made without reliance upon any other statement or representation other than those contained in the Agreement. This Agreement cannot be modified in any respect except in writing signed by the Consultant and the City.
