COMMISSION AGENDA ITEM REGULAR CONSENT X INFORMATIONAL D June 10. 1996 Meeting MGR I<~ IDEPT~ Authorization REQUEST: Land Management Division requesting Commission approval for the acceptance of the water and sewer system for public ownership and maintenance, The Seasons. PURPOSE: The purpose of this agenda item is to accept the water and sewer system for public ownership and maintenance. These improvements are located in The Seasons subdivision (that property located directly across Lancers Drive, north of Dolphin Road, east of Moss Road and West of Hayes Road in the Mt. Greenwood Planned Unit Development). APPLICABLE CODE: Code Section 9-76(b) Maintenance Bond. When requesting to record a plat for which the improvements have been installed, inspected and approved by the City engineer and when the City is being asked to accept such improvements, the subdivider shall provide a maintenance bond payable to the City guaranteeing the performance of required and installed improvements for two (2) years after the date of completion and acceptance by the City executed and enforceable in the same manner as the corporate or surety completion bond. The bonds shall be in the amount of ten (10) percent of the estimated construction cost of all improvements to be owned and maintained by the City. As an alternative to the provision of a corporate or surety bond, the subdivider may provide the deposit of equivalent cash in an escrow account with the City, or a letter of credit drawn on an approved institution, drawn in a form approved by the city attorney. June 10, 1996 Agenda Item D Page 2 FINDINGS: I) The plat for The Seasons was approved for recording by the Commission at their meeting of January 22, 1996. 2) The Seasons has been inspected by the Fire Department, Police Department, Utility Department and the City Engineer. All found the work acceptable, but the City Engineer did establish a condition to approval. The condition is that, until the precise underdrain locations are determined for lots 54 through 71, and lots 13 2 through 141, building permits be withheld for those lots. Once these are determined to the satisfaction of the City Engineer, then building permits will be issued. The reason for this condition is to ensure that underdrains are not routed underneath house pads. 3) The Utility Director has determined that the construction cost for the water and sewer system in The Seasons subdivision is $165,648.00. Therefore, a maintenance bond or letter of credit in the amount of$]6,564.80 is required. 4) Letter of Credit Number 0001 issued by Lochaven Federal Savings & Loan, Orlando, Florida, in the amount of$16,565.00 has been filed with the City and sent to the City Attorney for his legal review. 5) This will allow Certificates of Occupancy to be issued for all lots within The Seasons subdivision with the exception of those listed in subparagraph 2) above. Those lots noted will not be eligible for building permits until such time as the underdrain locations are determined. CONCLUSION: This application for acceptance of public facilities has satisfied all applicable law and regulations, contingent upon the conditions established in the City Engineer's Letter dated May 29, 1996 .~. :.:.. June] 0, ] 996 Agenda Item D Page 3 RECOMMENDA TION: The recommendation is that the Commission approve the acceptance of the water and sewer system for public ownership and maintenance, located in The Seasons subdivision. The City Engineer' condition that building permits for lots 54 through 7], and lots ] 32 through ] 4] be withheld until such time that the precise locations of the underdrains are determined is a part of this recommendation. The verbiage appears to be proper. But, I am having the Letter of Credit reissued because of the following reasons: 1) there is no issuance date and "all drafts must reference the number and issue date of this credit"; and, 2) there was no corporate seal over the signature.
