REQUEST: The General Services Department requests the City Commission to approve the
surplus property list, and participation in the joint governmental auction of such
property on June 15, 1996, at the Seminole County Greyhound Park in the City of
Casselberry.
PURPOSE:
The purpose of this request is to obtain City Commission approval of:
1. The attached list as surplus property.
2. Participation in the joint governmental auction on June 15, 1996.
3. The piggyback of the Volusia County state contract (via Lake County) at
7.5% auctioning fee for the first $50,000 gross proceeds, 8% of $50,000 to
$100,000 gross proceeds, and 8.5% for amounts over $100,000.
CONSIDERA TIONS:
The attached list of items have been declared surplus by the City Department
Heads and the City Manager.
The cities of Oviedo, Longwood, Casselberry, Winter Park, Maitland, Lake Mary,
Sanford, Altamonte Springs, and Seminole County will be participating in this
auction, and are piggybacking on the Volusia County contract via Lake County.
The City has used this piggyback bid before with much success.

The Seminole County Greyhound Park will provide security at a reduced rate for
the nights of June 13 and 14, 1996.
The auctioneer will collect all funds and disclose each city's amounts within ten
(10) days after the auction. The auctioneer will also do all the title work for all
vehicles.
Miscellaneous items will be auctioned at a tent (cost split among all participants).
The auctioneer will visit each City on May 20, 1996 to obtain a copy of the surplus
list, and take pictures for the advertising brochure. An advertisement will be
placed in the Orlando Sentinel publicizing the auction.
ISSUES:
Does the City Commission desire to declare the attached list surplus?
Does the City Commission desire to participate in the Casselberry auction and
piggyback on the V olusia County's state contract rather than re-bid, via Lake
County?
The staff feels that we can achieve economies of scale by joining with the other
area cities in the auction rather than bidding out separately.
FUNDING:
There would be no funding requirements for this request. Auctioneer fees would be paid
from the sale of proceeds according to the following schedule:
a. - First $50,000 of gross proceeds - 7.5% commission.
b. - $50,000 to $100,000 of gross proceeds - 8% commission.
c. - Allover $100,000 of gross proceeds - 8.5% commission.
c. - Tent fee - paid for from the proceeds.
IMPLEMENTATION SCHEDULE:
This recommendation needs to be effective immediately upon adoption in order to comply
with the June 15, 1996 auction schedule.

The auction will be held June 15, 1996 at the Seminole Greyhound Park in the City of
Casselberry, by a professional auctioneer. The following cities are participating in this event:
Oviedo, Longwood, Casselberry, Winter Park, Winter Springs, Maitland,
Lake Mary, Sanford, Altamonte Springs, and Seminole County.
For your information, we did this last year and had better success then trying to run an auction
ourselves.
I need the following placed on the agenda for approval by Commission:

To All Interested Parties,
The following entities have given tentative approval to holding ajoint auction between nine
cities in Seminole and Orange County.
City of Altamonte Springs
City of Winter Park
City of Casselberry
City of Sanford
City of Winter Springs
City of Longwood
City of Oviedo
City of Maitland
City of Lake Mary
The Auction will be held at the Dog Track on Seminola Blvd (Courtesy of the City of
Casselberry), on June 15th, 1996. Preview from 8:00 am to 9:00 am with the Auction to start at
9:00 am. The Auctioneer will collect all funds, and disburse each City's amount withing 10 days
after the Auction. The Auctioneer will also do the title work for all vehicles. Each entity will
need to provide a signed title, mileage statement and the keys for all vehicles.
We will be piggybacking Volusia County's contract (via Lake County) at 7 1h percent
auctioneering fee for the first $50,000 per each entity. The next $50,000 would be at 8 Y2
percent.
You will be able to take your vehicles and miscellaneous items to the Dog Track on June 13,
1996. The Dog Tract will be providing security at a reduced rate for the nights of June 13 and
June 14. We will be renting a tent for all of the miscellaneous items with the cost to be split
between all entities needing it.
George will visit each City on May 20, 1996 to get a copy of your list and to take pictures for the
advertising brochure that he will have produces. He will also take care of a general add in the
Orlando Sentinel. If you have small local papers, you might also want to advertise this Auction
in them.
I thank each City for their participation. As a group effort, this Auction should be a great
success and get a lot of exposure, which will in return, net greater profits to each Entity.
In sharing the costs, each Entity is wisely spending their tax dollars.

AUCTIONEER SERVICES AGREEMENT
THIS AGREEl\tIENT is made and emered this qft1 day of G fY~

between Rene' BATES AUCTIONEERS, INC., whose address is 1209 Jaguar Court, Winter Springs, FL
32708, hereinafter referred to as CONTRACTOR, and LAKE COUNTY, a political subdivision of the
State of Florida, whose address is P. O. Box 7800, Tavares, Fl., hereinafter referred to as County.
WITNESSETH:
'WHEREAS, the CONTRACTOR agrees to provide auctioneer services to the COUNTY in
accordance with this Agreement; and
WHEREAS, Lake County Code authorizes procurement of services from contracts of other local
governments; and
WHEREAS, the CONTRACTOR and COUNTY agree to incorporate by reference the terms and
conditions of the Agreement between Rene' Bates Auctioneers, Inc; and V olusia County dated February
12, 1990.
NOW, THEREFORE, in consideration of the mutual understandings and covenants set forth
herein, the COUNTY and CONTRACTOR agree as follows:
Section 1. Incorporation By Reference. The CONTRACTOR and COUNTY agree to
incorporate by reference the terms and conditions of the agreement between Rene' Bates Auctioneers, Inc.,
and Volusia County dated February 12, 1990 attached as Exhibit A. Specifications contained in Exhibit
A shall constitute the working contract for the auctioneer and Lake County. The term "Lake County" shall

be substituted in place of the term "Volusia County."
Section 2. Tenn. The term of this Agreement is for a period of one (1) year commencing upon
execution of this Agreement by COUNTY.

Section 3. Notices, Whenever either party desires to give notice unto the other, notice may be

Either of the parties may change, by written notice as provided herein, the addresses or persons for receipt
of notices.
Section 4. Records and Audits. CONTRACTOR shall maintain in its place of business all books,
documents, papers, and other evidences pertaining to work performed under this Agreement.
CONTRACTOR shall maintain for three (3) years from the date of fInal payment under this Agreement
for audit or inspection by COUNTY or other authorized agent of the COUNTY.
Section 5. Auction Collection. CONTRACTOR agrees to collect all funds from the auction in
their name, and remit checks to each entity, less auction commission and any pro-rated labor expe,nse,
within ten (10) working days.
Section 6. Title Transfers. CONTRACTOR agrees to transfer vehicle titles for each entity
according to State of Florida Law.

Summary/Highlights
Requests for qualifications and performance data were properly advertised
and mailed on RFP No. 90-P-19 to provide professional auctioneer services
for Surplus County Vehicles and Equipment. Two responses were received on
December 5, 1989:

Renet Bates Auctionners, Inc., Winter Springs, FL
Proposals were reviewed by a Selection Committee of:

On February 10th, Mr. Bruso, Capt. Rickmyre, Brenda Thompson, Buyer and
Mary McConnel, Fixed Assets Account, traveled to Valdosta, GA, to view an
auction and to interview the First Coast Auction tew~.
Recommended Motion
On February 12th, the Selection Committee met to review the proposals and
discuss the results of the Valdosta interview. It is the unanimous deci-
sion of the Selection Committee to recommend Rene' Bates Auctioneers, Inc.
Winter Springs, FL, to provide professional auctioneer services for the
County for a periof of three (3) years. Mr. Bates has agreed to provide
the services at the same commission rate previously negotiated with the
County of Volusia:

SUBJECT: Provide Professional Auctioneer Services for the County of

Gentlemen:
Expressions of interest, qualification and performance data will be
received at the office of the County Purchasing Director, 123 W.
Indiana Ave., 3rd FL, DeLand, FL, 32720-4608, until 2:00 PM, T~esday,
December 5, 1989.
A general description of the scope of service required is as Iollows:
Disposal at public auction of all types of surplus property,
except real estate, in accordance with the attached
specifications.
NOTE:
It is anticipated Volusia County will schedule its next
auction in late March or April, 1990.
Firms desiring to provide the required professional services shall
submit one "ORIGINAL" and six (6) "COPIES" (marked as such) of their
qualifications and performance data for evaluation and ranking by a
Selection Committee consistent with the provisions of the administra-
tive procedures of the County of Volusia. Commission rate shall be
negotiated with the number one ranked firm.
Any or all firms submitting proposals may be subject to making a
presentation and submitting to interviews by the Selection Committee.
Any awarded contractor resulting from this Invitation for Proposals
is given the privilege and is required to permit all municipalities
and governmental agencies in the counties of Volusia, Osceola, Orange,
Lake, Seminole and Brevard to obtain auctioneering services under the
same prices, terms and conditions.

The County of Volusia reserves the right to reject any or all
proposals, to waive informalities, and to accept all or any part of
any proposal as they may deem to be in the best interest of the
County.

SPECIFICATIONS
1.0 Services required shall be for the disposel, et public auction,
of all types of surplus property except real estate.
2.0 The contract awarded as a result of proposals submitted shall be
for a period of three (3) years. The contract shall be renewable
annually, thereafter, upon mutual consent of the County and the
contracted Auctioneer, at the same terms end conditions as the
original contract except that the contract may be cancelled by
either party with thirty (30) days written notice.
3.0 A general description of the services required of the Auctioneer
is as follows:
3.1 PROMOTION AND ADVERTISING
a. Maintenance of mailing list of prospective
buyers and adding newly registered prospective
buyers from each auction.
b. Preparation, printing, end mailing of a minimum
of 1,000 auction brochures at least twenty (20)
days prior to each auction. Brochures to include
a list and pictures of the items to be offered
tor sale as well as any other information the
County requires.
c. Providing a minimum of 500 brochures to the County
Purchasing Division at least twenty (20) days prior
to each auction.
d. Advertise in national publications targeting buyers
of this type of merchandise.
e. Advertise in specialized trade publications targeting
buyers of specialized merchandise when the County
offers such items as aircraft, boats, and heavy road
machinery.
f. List Volusia County auctions on Auctioneer's printed
and advertised calendar.
g. Provide Volusia County Auction brochures and verbally
announce Volusia County auctions at all other auctions
conducted by the contracted Auctioneer.
h. Advertise in local newspapers.
i. Conduct press conference type interviews with local
newspapers, television and radio stations.

j. Personally contact those prcspectlVe buyers
known to have interest in the types of mer-
chandise the County is offering for sale.
3.2 AUCTION PREPF~.TICN
a. Furnish personnel, forms and equipment for use
at the auction site, at least two (2) days in
advance of each sale, to review merchandise
being offered, to lot items for sale, and to
assist in public preview.
b. Provide information as required by the County
on lot sheets, such as property numbers, depart-
ment, and other necessary accounting data.
3.3 CONDUCT AUCTION
a. Provide personnel and forms for the registration
of prospective buyers on the day of the auction.
b. Provide personnel and forms necessary to record
the sale of each lot during the auction.
c. Provide personnel and equipment necessary
to conduct a professional and orderly auction.
d. Provide a permanent written itemized record of each
auctionts proceedings in a format containing informa-
tion as required by the County.
e. Provide tape recordings of each auction as a perma-
nent record for the County.
4.0 A general description of the responsibilities of the County are
as follows:
4.1 Obtain required authorization and legally post notification
of each auction.
4.2 Provide an auction site.
4.3 Perform maintenance and/or repair of merchandise to be
offered to increase sales value.
4.4 Provide traffic control and security at the auction site.
4.5 Provide an inventory with all pertinent information re-
quired by the County on all property to be sold.

4.6 Provide a Buyer's Guide listing terms ~nd conditions
of each sale to the Auctioneer a~d to prospective
buyers.
4.7 Manage and control payments ror items purchased at
the auction.
4.8 Manage and control removal of items rrom auction site
after payment.
4.9 Take appropriate follow-up action regarding faulty
checks, failure to pay for or pick-up items and other
related post-auction administrative matters.
4.10 Establish in coordination with the Auctioneer the gross
proceeds from each auction to serve as basis for figuring
Auctioneer's fees.
4.11 The County of Volusia reserves the right to dispose of
surplus property by means other than public auction where
deemed to be in the best interest of the County.
5.0 The following qualifications are required for each Auctioneer
submitting proposals:
5.1 A minimum of five (5) years experience conducting auctions
for government entities (Federal, State, County, City or
Public Utilities).
5.2 Experience shall include a minimum of five (5) auctions
conducted per year for five (5) different government enti-
ties of comparable or larger size within the past five (5)
years.
5.3 Auctions listed in past experience shall have contained a
minimum of fifty (50) items of vehicles and heavy road
machinery. A minimum of one (1) auction per year shall
have contained at least one (1) aircraft; a minimum of
one (1) per year containing at least one large boat (over
twenty (20) ft. in length with a sale value of no less
than $20,000).
5.4 Gross proceeds of all auctions held within the past five
(5) years shall average a minimum of $100,000. (Total
gross proceeds divided by the total number of auctions
conducted equals $100,000).
5.5 Auctioneer shall have had prior experience in publicizing
and advertising auctions on a national level.

3.6 Auctioneer shall employ, in addition to himself, a minimlli~
of two (2) licensed full-time auctioneers having a minimlli~
of two (2) years experience each in conducting government
auctions.
5.7 Auctioneer shall employ sufficient support and clerical
personnel to prepare and conduct a sizeable auction.
5.8 Auctioneer shall submit proof of possessing all licenses
and permits required to conduct auctions for and in the
County of Volusia, Florida, in accordance with Chapter
86-119, Florida Statutes.
5.9 Auctioneer shall qualify and obtain bonding for an
amount equivalent to the anticipated gross proceeds of
each sale.
5.10 Auctioneer shall possess the following insurance:
Workers' Compensation - Mandatory
General Liability - $1,000,000 each occurrence
Vehicle Liability - $500,000 each occurrence and $1,000,000
aggregate
Auctioneer shall insure his own interest, employees and
equipment, and vehicles while on County property.
6.0 The following information shall be included in each proposal:
6.1 Proof of experience in government auctions as required
in specifications.
6.2 Proof of advertising on a national level as required
in specifications. (Minimum of five (5) different
national publications within the past two (2) years).
6.3 A list of specialized and trade publications used
regularly for advertising. (Minimum of five (5)
different national publications within the past two
(2) years.
6.4 A description of maintenance and use of the firmts
mailing list.
6.5 A detailed outline of the firm's general promo-
tional practices.
6.6 Samples of brochures of auctions conducted for govern-
ment entities as required in specifications.

6.7 A list of current references which the County may
contact to obtain information regarding experience
in conducting government auctions'as required in
specifications.
6.8 A description and sample of forms used by the firm
for the preparation and conducting of similar auctions.
6.9 A description and sample of the computerized mailing
list, lot sheets, and reports for at lease two (2)
similar types of auctions held within the past twelve
(12) months.
6.10 Proof of bondability and insurance.
