Authorization REQUEST: Public Works Department/Utility Division Requesting Approval of the First Raeding of Ordinance #617 Implementing Water Conservation Rates. PURPOSE: The purpose of this Board item is to authorize the first reading of Ordinance #617 which implements the water conservation rate structure mandated by the St. John's River Water Management District as part of the 1995 Consumptive Use Permit. CONSIDERATIONS: The adoption of this ordinance is needed to comply with condition #21 of the St. John's River Water Management District Consumptive Use Permit and to also achieve the Comprehensive Plan goal for per capita water consumption. The CUP is the permit issued by the SJRWMD every seven years which limits the withdrawal amounts from the aquifer for our potable water supply. Condition #21 requires more stringent water conservation rates be adopted by June 1, 1996 which resulted from negotiations with the SJRWMD in 1995 for the West system CUP. The East system CUP expires in 1996 and is currently under review by the SJRWMD. The East CUP application proposes to combine both systems under a single CUP. The City Commission previously adopted Ordinance #563 on July 11, 1994 which implemented water conservation rates as required by the Comprehensive Plan and in anticipation of SJRWMD requirements. These rates are necessary to promote water conservation and meet the levels of service for per capita potable water consumption. The SJR WMD reviewed the 1994 adopted rates and noted that per capita consumption rates Apri122, 1996 Regular Agenda Item A Page .1... for 1995 were still excessive and above the 1995 interim level of service in the Comp Plan. ISSUE ANALYSIS The objective of a water conservation rate structure is to lower per capita water consumption. The level of service (LOS) in 1992 when the Comp Plan was adopted was 143 gallons per capita per day (GPCPD). An interim LOS was established for 1995 of 125 GPCPD but the actual was 138 GPCPD. The LOS goal for 1997 is 115 GPCPD which is still above the national average of 100 GPCPD. A usage of 100 GPCPD equates to 10,000 gallons per month. The SJRWMD noted that the 1994 rate change had not achieved the desired reduction in per capita consumption and wanted two changes; 1) a rate structure with greater economic impact and 2) for the water conservation rates to be implemented at a usage of 10,000 gallons per month instead of 15,000 gallons per month. We were able to convince the District that increasing the number of rate increments beginning at 10,000 gallons per month without a significant rate increase would achieve the desired results. However, our goal is to raise the awareness of wasteful irrigation by making it cost prohibitive thereby reducing usage. We fully expect that any increase in revenue will be offset within the next 18 to 24 months by a loss of revenue from the conversion of 7 to 10 subdivisions to reclaimed water irrigation. The cost of reclaimed water to the residents is about one fifth of potable water. The average customer usage for the West system is approximately 11,000 gallons per month. This rate increase would result in an average montWyincrease of$0.34 per month for those West system customers whose usage does not change. The average customer usage for the East system is 17,500 gallons per month. This rate increase would result in an average montWy increase of$3.18 per month for those East system customers whose usage does not change. April 22, 1996 Regular Agenda Item A Page~ RECOMMENDATION: I am recommending for the Commission to approve the first reading of Ordinance #617 revising the water conservation rates to be in compliance with condition #21 of the 1995 Consumptive Use Permit issued by the St. John's River Water Management District. The approval of the ordinance would also be consistent with the Comprehensive Plan Potable Water goal of lowering per capita water consumption. WHEREAS, the City Commission of the City of Winter Springs, Florida, has determined it to be in the best interest of the safety, health, and welfare of the citizens of the City of Winter Springs to provide for the adoption of Rates, Fees and Charges relating to water and wastewater and WHEREAS, it is necessary to update these Codes from time to time. NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, FLORIDA: SECTION I - That Sec. 19-102(1) User Charge Schedule, Monthly Water Service Rates is hereby deleted in its entirety, and the following replaced therefore: Sec. 19-102(1). B. Xeriscape specific Condition No. 11 requires the permittee to use native vegetation that needs little supplemental irrigation within the project service area. The permittee, i. e., the city of winter springs, complies with this requirement. This is enforced through the Development Review Committee of which the utility Director is a member. ci ty projects are not approved until all items and departments are satisfied with the plan. During construction the landscaping items are enforced by the Building Department and after construction is complete, the City has a Code Enforcement Board/Officer which takes over responsibility for enforcing the requirements of the City Code. Please note that the City is also planning on adopting a xeriscape ordinance (previously submitted to SJRWMD) which would cover all new construction within the City of Winter springs. It is intended that adoption will occur by April '1, 1996. Enforcement will remain the same as described above. The city will also commit to the construction ofaxeriscape demonstration site in a median on Moss Road. C. Installation of Water saving Devices The ultra low volume devices shown in the SJRWMD Water Conservation Plan Form are identical to the requirements of the Standard Building Code which is used by the City of winter Springs. Therefore we believe we are in compliance with your requirements. . Attachment 4 Potable Water Section GOAL Provide an adequate public supply, treatment, and distribution of potable water for the city of Winter Springs. OBJECTIVE A) Winter Springs shall require that the following policies, which establish level of service standards, which are met when planning capital improvements and reviewing applications for development approval. Policies 1) Winter Springs adopts the following level of service standards for annual average daily volume in gallons of potable water per capita for the City owned system: Current LOS 143 GCPD Interim LOS (1995) 125 GCPD Future LOS (1997) 115 GCPD For the other potable water providers, the following levels of service are adopted: Seminole Pines 100 GCPD Seminole County 100 GCPD Casselberry 125 GCPD 2) Winter Springs shall require an Application for Service to the Utilities Department for connection to public potable water system for all proposed projects within the service areas. 3) Facilities for providing a minimum fire flow rate of 500 gallons per minute for residential areas and 1250 gallons per minute for commercial, industrial and institutional areas, shall be required as a condition of development approval. 4) Winter Springs shall require the connection to the City system and installation of a public water system. 5) Winter Springs may require the developer to provide and dedicate to the City the public water distribution system within any new development.
