HomeMy WebLinkAbout1996 04 08 Consent Item C ._:; COMMISSION AGENDA ITEM C REGULAR CONSENT X INFORMATIONAL April 8. 1996 Meeting REQUEST: General Services Department (Land Management Division) requesting Commission approval to allow the City Manager to execute an easement agreement with BellSouth. PURPOSE: The purpose of this Board item is to allow the City Manager to execute an easement agreement with BellSouth to extend an existing easement (now 20' X 20') by an additional 20' X 15'. This easement is at the entry to Sunshine Park, off Edgemon Avenue. CONSIDERATIONS: BellSouth is planning to bring the latest fiberoptic technology to the area. This will require an additional cabinet to house the equipment, which in turn, requires an extension to the existing easement. FINDINGS: 1) This BellSouth action will provide the latest technology to the residents of the City. 2) The City is in the process of vacating utility easements on City-owned property. The location is off Moss Road where the Fire Station and the Public Works/Utility Department are. This is being done to allow the City more flexibility in the utilization of this property. To finalize this action, all utility companies must approve the vacation of these easements. All utility companies have replied to this request except BellSouth. 3) The Utility Department has reviewed this request and have no objection. 4) The Parks and Recreation Department have reviewed this request and has conceptual plans to alter the existing entrance to Sunshine Park to provide a safer and more aesthetically pleasing entrance. April 8, 1996 AGENDA ITEM ~ Page 2 The Department's concern is that this plan may require a slight encroachment on this easement. BellSouth should be aware of this and not object to this potential encroachment provided that it does not disrupt their operations. 5) The existing 20' X 20' easement was granted to Southern Bell by Commission action on April 8, 1991. RECOMMENDA nON: It is recommended that the Commission approve the request which will allow the City Manager to execute the easement with BellSouth with the following stipulations - BellSouth agrees to: 1) Receipt of no objection letter, if technically possible, to City's request to vacate those easements located on City-owned property, and, 2) Allow the City to encroach upon this easement to reconstruct the existing ingress/egress access point to Sunshine Park. COMMISSION ACTION: MEMORANDUM TO: DON LEBLANC, LAND MANAGE~IENT SPECIALIST FRO~I:(fXU DON WILSON, PARKS AND RECREATION DIRECTOR SUBJECT: BELLSOUTH EASEMENT REQUEST DATE: ~lARCH 14, 1996 This is a follow-up to our on-site visit of the Senior Center at 4:45pm on Tuesday, March 12, 1996. As discussed, we have a concept of improving the ingress and egress of the Senior and Civic Center in the future. The purpose would be to provide a safer and more aesthetically pleasing entrance for the patrons. Our tentative thoughts are to provide an independent paved entrance road and an independent exit road separated by a landscaped median with an identification marker. . Per our telephone conversation this date, please assure that Bellsouth is unquestionably cognizant of the fact that slight encroachment on the easement may be necessary in- the future in order to facilitate this entrance improvement.
