HomeMy WebLinkAbout2009 09 28 Public Hearing 500 Approval of Resolution Number 2009-47 Final Operating Millage Rate and Final Debt Service Millage RateFIRST ITEM OF THE EVENING COMMISSION AGENDA ONSENT ORMATIONAL ITEM 500 LIC HEARING I XX GULAR September 28, 2009 Meeting MGR /DEPT. ~~j Authorization PUBLICLYANNOUNCE THE REQUEST REQUEST: The City Manager is requesting that the City Commission hold a Public Hearing relative to the approval of Resolution No. 2009-47, which establishes the Final Operating Millage Rate and the Final Voted Debt Service Millage Rate for Fiscal Year 2009-2010 for the City oI' Winter Springs. PURPOSE: The purpose of this agenda item is to have the Commission approve Resolution No. 2009- 47, otherwise known as the Final Millage Rates for Fiscal Year 2009-2010. CONSIDERATIONS: On September 14, 2009, the Commission adopted a tentative operating millage rate of 2.4714 mills and a tentative voted debt service millage rate of 0.1100 mills for a total tentative millage rate of 2.5814 mills. Tonight the Commission will set the final millage rates which cannot exceed the tentative millage rates. Since the tentative millage rate of 2.4714 is less than the rolled-back rate of 2.7395 mills the vote will only require a simple majority. RECOMMENDATION: It is recommended that the Commission adopt Resolution No. 2009-47 establishing the final operating millage rate at whatever rate the Commission deems necessary for fiscal year 2009-2010, the final voted debt service millage rate at 0.1100 mills for fiscal year 2009-2010 and publicly announce the percentage by which the final operating millage rate is less than the rolled-back rate. A `sample' motion follows which includes the necessary elements for statutory compliance: I make the motion that the City of Winter Springs adopt Resolution No. 2009-47 establishing the final operating millage rate at 2.4714 mills, establishing the voted debt service rate at 0.1100 mills and publicly announce that the final operating millage rate is 9.79% less than the computed rolled-back rate of'2.7395 mills. 092809_COMM_Public_Hearing_500_Final_ Millage.docx IMPLEMENTATION SCHEDULE: Upon approval and adoption of Resolution No. 2009-47, the millage rates for fiscal year 2009-2010 would be communicated to the Seminole County Property Appraiser and the Seminole County Tax Collector as the millage rate to be levied by the City of Winter Springs for the 2009 tax year (Fiscal Year 2009-2010). WHEREAS, the City Commission of Winter Springs of Seminole County, Florida, on September 28, 2009, adopted Fiscal Year 2009-2010 Final Millage Rates following a public hearing as required by Florida Statute 200.065; WHEREAS, the City Commission of Winter Springs of Seminole County, Florida, held a public hearing as required by Florida Statute 200.065; WHEREAS, the gross taxable value for operating purposes not exempt from taxation within Seminole County has been certified by the Seminole County Property Appraiser to the City of Winter Springs as $1,818,059,818; WHEREAS, the City Commission of Winter Springs desires to adopt the final operating millage rate and publicly announce the percent, if any, by which the final operating millage rate is more than or less than the rolled-back rate, and adopt the final voted debt service rate; and WHEREAS, the City Commission of Winter Springs deems that this Resolution is in the best interest of the public health, safety, and welfare of the citizens of Winter Springs. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, SEMINOLE COUNTY, FLORIDA, AS FOLLOWS: Section 1. Incorporation of Recitals. The foregoing recitals are deemed true and correct and are hereby fully incorporated by this reference. Section 2. The City Commission adopts its final operating millage rate of 2.4714 mills and its final voted debt service millage rate of 0.1100 mills for the fiscal year commencing October 1, 2009 and ending September 30, 2010. City of Winter Springs, Florida Resolution 2009-47 Page 1 of 2 Section 3. The final operating millage rate of 2.4714 mills is 9.79% less than the computed rolled-back rate of 2.7395 mills. Section 4. Within three (3) days of the date of this Resolution, the Finance Director shall forward the Resolution adopting the tinal millage rates to the Seminole County Property Appraiser and the Seminole County Tax Collector. Section 5. Within thirty (30) days of the date of this Resolution, the Finance Director shall certify compliance with Chapter 200, Florida Statutes by causing the Certification of Compliance, along with all necessary documentation, to be sent to the Property Tax Administration of the Department of Revenue. Section 6. Repeal of Prior Inconsistent Resolutions. All prior resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of the conflict. Section 7. Severability. If any section, subsection, sentence, clause, phrase, word, or portion of this Resolution is for any reason held invalid or unconstitutional by any court of~ competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion hereto. Section 8. Effective Date. This Resolution shall become effective immediately upon adoption by the City Commission of the City of Winter Springs, Florida.
