PURPOSE: The purpose of this Board item is to vacate a portion of a utility easement located at 583 Walden Court, CONSIDERATIONS: This is being presented to the Commission because a swimming pool is presently encroaching on a utility easement. September 25, 1995 - First inquiry as to procedures to follow to vacate easement. December 04, 1995 - All information necessary to proceed received. January 08, 1996 - First Reading of Ordinance It is unknown when this pool was built because of incomplete records. It is believed that it was prior t 1982. All concerned utility companies have consented to vacating the westerly four (4) feet of the easterly fifteen (15) utility easement located on the property. Vacating this portion of the easement will bring the placement of the swimming pool in Code compliance. February 12, 1996 AGENDA ITEM NUMBER B Page 2 RECOMMENDATION: Staff recommendation is for approval of Second Reading of Ordinance 610, IMPLEMENTATION: Ordinance 610 becomes effective upon approval by the Board, COMMISSION ACTION: -\ ORDINANCE NO. 610 AN ORDINANCE OF THE CITY OF WINTER SPRINGS, FLORIDA VACATING, ABAl'\[DONING AND CLOSING THE WESTERLY FOUR (4) FEET OF THE EASTERLY FIFTEEN (15) FOOT UTILITY EASEMENT LOCATED ON LOT 4, WALDEN TERRACE, AS RECORDED IN PLAT BOOK 18, PAGE 69, PUBLIC RECORDS OF SEMINOLE COUNTY, FLORIDA, MORE PARTICULARLY DESCRIBED AS FOLLOWS; PROVIDING FOR CONFLICTS, SEVERABILITY AND EFFECTIVE DATE: WHEREAS, the City Commission of the City of Winter Springs, Florida, has determined it to be in the best interest of its citizens to vacate the utility easement described herein; NOW, THEREFORE, be it ordained by the City Commission of the City of Winter Springs, Florida as follows: SECTION I: The City hereby vacates, abandons and closes the following described property: THE WESTERLY FOUR (4) FEET OF THE EASTERLY FIFTEEN (15) FOOT EASEMENT LOCATED ON LOT 4, WALDEN TERRACE, AS RECORDED IN PLAT BOOK 18, PAGE 69, PUBLIC RECORDS OF SEMINOLE COUNTY, FLORIDA THE ABOVE DESCRIBED PARCEL OF LAND LIES IN SEMINOLE COUNTY, FLORIDA, SECTION II: That any portion of any City Ordinance in conflict herewith shall be hereby repealed.
