ITEM D REGULAR CONSENT X INFORMATIONAL February 12, 1996 Meeting MGR /~ IDEPT j)-r- Authorization REQUEST: Public Works Department Requesting Supplement to Traffic Engineering Study PURPOSE: The purpose of this Board item is to request authorization to execute Supplement #1 to Amendment 45 - Consulting Engineering Services for Traffic EngineeringIPlanning Services with Conklin, Porter & Holmes Engineers, Inc. to Complete the Traffic Circulation Element of the Comprehensive Plan. CONSIDERATIONS: This supplement is needed to assist City staff in compiling traffic zone data that is required to update the traffic circulation element of the Comprehensive Plan. Amendment 45 - Consulting Engineering Services for Traffic EngineeringIPlanning Services was entered into between the City and Conklin, Porter & Holmes Engineers, Inc. on December 13, 1995. This was executed after the use ofCPH as the City's Traffic Engineer was agreed upon at the November 27, 1995 City Commission meeting. The scope of services in Amendment 45 called for the City to provided updated traffic zone data to the consultant. Tom Grimms has indicated that this information is not readily available and that he would not be able to provide this data in the time frame allocated for this task. Supplement # 1 provides for CPH to assist in compiling this data utilizing census data, land use maps, approved development plans, tax rolls, building permits and various other sources as described in Exhibit I of Supplement 1. Considering Mr. Grimm's time commitments to the ongoing Comp Plan Amendments, we need CPH assistance to keep this project on track. . FUNDING: The cost for Supplement #1 is $3,450. This is in addition to the $36,759 original cost of Amendment 45. Funds are available from the Transportation Impact Fee Consulting Services line code (#53180). Funds for this project will be expended by June 1, 1996. RECOMMENDATION: I recommend that authorization be given to execute Supplement #1 to Amendment 45 for additional Traffic Engineering Services to be paid from the Consulting Services line code of the Transportation Impact Fee Fund. IMPLEMENTATION SCHEDULE: The scope of services will be incorporated into the original time line of Amendment 45. The anticipated completion date is July 1, 1996. Attachment No ~ 1 AMENDMENT NO. 45 Supplement No. 1 Consulting Engineering Services This Supplement is made and entered into this _ day of , 1996 by and between the City of Winter Springs and Conklin, Porter and Holmes-Engineers, Inc. WHEREAS, the CITY and ENGINEER have previously entered into an Agreement for the ENGINEER's professional services (Amendment No. 45); and WHEREAS, the CITY and the ENGINEER shall refer to Amendment 45 herein, and desire to have it incorporated by reference; and WHEREAS, the CITY and the ENGINEER now wish to modify and add specific items to' Amendment 45; NOW THEREFORE, in consideration of the mutual promises and covenants contained herein and given one to the other, the sufficiency of which is hereby acknowledged, the parties agree as follows: I. SCOPE OF WORK The scope of work has been agreed to by the parties, and is attached hereto and incorporated herein, by reference, as Exhibit 1. II. FEE The fee has been agreed to by the parties, and is attached hereto and incorporated herein, by reference, as EXHIBIT II. ID. No additions, alterations, or variations to the terms of this Supplement shall be valid, nor can the provisions of this Supplement by waived by either party, unless such additions, alterations, or waivers are expressly set forth in writing in a document of import equal to Amendment 45 or the Supplement, and duly executed. Assist the City in updating data and projecting specific development (socio-economic data by traffic zone) that may occur between the base year of 1990 or 1992 and the year 2010. 2. The zonal socio-economic data update will be accomplished by examining what vacant land (or land that might be redeveloped) exists in each of the traffic zones since the base year. It will then be determined for each vacant parcel within the traffic zone what can be developed (single family, multiple family, office, retail, institutional, etc.) and when. The following will be used to make this determination: a. Tax rolls of Seminole County to determine the parcel size, nature of ownership, improvements, etc. b. Most current aerial of Winter Springs c. Existing Land Use Map - 1990 as prepared by Engineering and Land Systems, Inc. d. Master Planning Map - August, 1995 e. Zoning Map - Update December 20, 1995 f. Future Land Use Map - 2010 g. Parcel Boundary Maps - August, 1994 h. Zoning and Land Development Codes of the City of Winter Springs 1. This Amendment dated November 30. 1995, by and between the City of Winter Springs (hereinafter called the OWNER) and Conklin, Porter & Holmes - Engineers, Inc. (hereinafter called the Engineer), is mutually agreed upon and declared an authorized Amendment to an Agreement dated November 27, 1984, between the parties, herein setting forth the scope, terms and conditions of the services herein authorized. The appropriate provisions of the November 27, 1984, Agreement apply as fully as if repeated herein. SECTION 1 GENERAL 1.1 The purpose of this Amendment is to provide for Traffic Engineering/Planning Services, more specifically itemized herein, for the updating of the traffic circulation element of the Comprehensive Plan, appropriate updating of the transportation impact fee schedule, and certain additional data / analysis needed for concurrency and assistance with public involvement. SECTION 2 BASIC SERVICES OF THE ENGINEER 2.1 GENERAL 2.1.1 The ENGINEER agrees to perform professional services in connection with the project as hereinafter stated. 2.1.2 The ENGINEER will serve as the OWNER's professional engineering representative in those phases of the project to which this Amendment applies, and will give consultation and advice to the OWNER during the performance of his services. The ENGINEER will perform the services for the City Commission under the general supervision of the City Manager, Community Development Coordinator, and Utilities Director and will submit interim information to them for their review, input, decision, etc. as appropriate. SECTION 3 SCOPE OF SERVICES 3.1 GENERAL The OWNER hereby authorizes the ENGINEER to proceed with the study. 3.2 TRAFFIC ENGINEERING / PLANNING SERVICES DATA COLLECTION AND ANALYSIS 3.2.1. Review latest update of Traffic Circulation element and suggest modification, if appropriate, in the following sections: o Goals, Objectives and Policies CI Capital Improvement (Transportation) Funding " . o Concurrency Management Testing · Transportation Impact Fee Calculations o Land Use Element Q Level of Service (Transportation) · Roadway Classifications/Systems Selection 3.2.2 Obtain FSUTMS (Florida Standard Urban Transportation Model Structure) Networks and TZ Data (existing / 2010) from Tipton Associates, Inc. and verify accuracy. 3.2.3 Obtain Traffic Studies for developments approved since adoption of the Comprehensive Plan or alternatively available capacity by link on the circulation map and determined to be vested traffic. 3.2.4 Make Baseline (1996) Traffic Counts to track concurrency. 3.2.5 Coordinate with the City on update of the TZ data for model input. This would be accomplished by the City or could be by CPH as a supplemental service. If CPH develops this data, City approval will be required before input to FSUTMS. 3.2.6 Prepare interim technical report (memo) containing results of data collection and analysis. 3.3 RE-EVALUATE THE COLLECTOR ROAD SYSTEM 3.3.1 Review the need for specific roads and develop typical cross sections for those proposed in the current fiscal year. Those collector rods requiring review are: · Hayes Road north of Bahama Road · West Panama Road · Moss Road north of Panama Road It is understood that Task 3.3.1 will be conducted concurrently with Tasks in 3.2. 3.3.2 Attend City Commission work session to present alternatives. Prepare and make presentation at one public hearing on current fiscal year projects. 3.3.3 Prepare location and corridor studies for the following road extensions: · Shore Road / Fisher · Panama Road from Shore Road to Tuskawilla Road Functional plans will be prepared without surveyor new aerial photography. Drainage design and cross-sections are not anticipated. It is understood that Task 3.3.3 will be conducted following Tasks 3.3.1 and 3.2. It will be done concurrently with 3.3.4. "I 3.3.4 Update Traffic Circulation Plan including the following work items: . Test alternative systems with 2010 traffic projections. Four alternative tests are anticipated. · Meet with City Commission to discuss alternative tests. o Prepare for and attend one public hearing. Cl Staff assistance in preparing Comprehensive Plan Amendment. 3.4 ' UPDATE TRANSPORTATION IMPACT FEES 3.4.1 Estimate Capital Improvement Costs including bridge/drainage improvements. 3.4.2 Review/modify ability to finance capital improvements, i.e. transportation. · Make five year revenue projection. 3.4.3 Modify section 9-386 of the Code of Ordinances - Transportation Impact Fees and develop new impact fee schedule and formula, if appropriate. SECTION 4 SUPPLEMENTARY SERVICES OF THE ENGINEER 4.1 If authorized in writing by the OWNER prior to the rendering of such services, the ENGINEER will furnish or obtain under subcontracts, supplementary services of the following types which will be paid for by the OWNER as described in SECTION 6, Paragraph 6.1.2. 4.2.1 Additional services due to significant changes in the scope of the project or its design including, but not limited to, changes in size, complexity, character or due to time delays in initiating or completion of the work as described herein. 4.2.2 Additional services in connection with the project including services normally furnished by the OWNER as described in Section 5 herein and services not otherwise provided for in this Amendment. 4.2.3 Preparing to serve and serving as an expert witness for the OWNER in any protest, litigation, or other proceeding involving the project. " J 4.2.4 Additional engineering services required by revisions to the Comprehensive Plan as applicable to the Florida Department of Community Affairs, or other regulatory agency requirements. 4.2.5 Provide, through a subconsultant, services if required or' requested by the OWNER. SECTION 5 THE OWNER'S RESPONSIBILITIES 5.1 THE OWNER WILL: 5.1.1 Advise the ENGINEER of his requirements for the project and designate a person to act as the OWNER's representative with respect to the work to be performed under this Amendment, and such person shall have complete authority to transmit instructions, receive information, interpret and define the OWNER's policies and decisions pertinent to the work covered by this Amendment. 5.1.2 Guarantee access to and make all provision for the ENGINEER to enter upon public and private lands as required for the ENGINEER to perform his work under this Amendment. 5.1.3 Provide requested data by traffic zone necessary for modeling of traffic projections. 5.1.4 Examine all studies, reports, sketches, and other documents presented by the ENGINEER and render decisions pertaining thereto within a reasonable time so as not to delay the work of the ENGINEER. 5.1.5 Obtain approval of all governmental authorities having jurisdiction over the project, and such approvals and consents from such other individuals or bodies as may be necessary for completion of the Project. 5.1.6 Furnish, or direct the ENGINEER in writing to provide at the OWNER's expense, land use projections and traffic zone data to update the 2010 projections if not provided by the Owner. 5.1. 7 Furnish, or direct the ENGINEER in writing to provide at the OWNER's expense, necessary additional services as stipulated in Section 4 of this Amendment, or other services as required. 5.1.8 Provide such legal, accounting, and insurance counseling services as may be required for the project, and such auditing services as the OWNER may require. 5.1.9 Give prompt written notice to the ENGINEER whenever the OWNER observes or otherwise becomes aware of any defect in the Project. SECTION 6 PAYMENT 6.1 PA YMENT Payments for services of the ENGINEER to be as set forth below: 6.1.1 Principals and Employees of the Engineer. 6.1.2 Compensation paid ENGINEER for services described herein and rendered by principals and employees assigned to the Project will be computed by multiplying Direct Personnel Expense (defmed in Paragraph 6.2.4 herein) times a factor of 2.0 plus all reimbursable expenses. The fee for the services described herein is itemized below. It is understood that the Owner may authorize each task separately or by phase: Data Collection and Review/modify circulation 3.2.1 $1,381.00 Analysis elements Obtain and verify FSUTMS 3.2.2 $938.00 Accuracy Review Traffic Studies for vested 3.2.3 $1,807.00 traffic 1996 Traffic Counts 3.2.4 Summary Report 3.2.5 Re-evaluate the collector Current FY Review 3.3.1 system Hearings, meetings 3.3.2 Corridor studies 3.3.3 Update Circulation Plan 3:3.4 Phase Total Update Transportation Estimate Capital Improvements 3.4.1 Impact Fees costs Financial Study 3.4.2 New impact fees, Section 9-386 3.4.3 . .. ~ - 6.2 6.2.1 6.2.2 6.2.3 6.2.4 6.2.5 6.2.6 7.1 REIMBURSED EXPENSES Expenses for items not specifically valued herein are to be reimbursed to the ENGINEER at the actual cost thereof. Said expenses shall include transportation and subsistence of principals and employees, when traveling in connection with the Project, toll telephone calls, telegrams and similar project-related items. . The OWNER will make prompt monthly payments in response to ENGINEER's monthly statements without retention for all categories of services rendered under this Amendment and for reimbursable expenses incurred. Direct Personnel Expense used as a basis for payment shall mean the salaries and wages paid to principals and employees of all classifications engaged directly on the Project, plus the cost of fringe benefits including but not limited to, social security contributions, worker's compensation, health and retirement benefits, bonuses, sick leave, vacation and holiday pay applicable thereto. For purposes of this Amendment, Direct Personnel Expense shall be considered an amount equal to 1.48 times applicable salaries and wages. Charges for the services rendered by principals and employees as witnesses in any litigation, hearing or proceeding in accordance with Paragraph 4.1.4 will be computed at a rate of $400.00 per day or any portion thereof (but compensation for time spent in preparing to appear in any such litigation, hearing or proceeding will be computed in accordance with the funding levels as set forth in Paragraph 6.1.1 and 6.2.1 herein). If this Amendment is terminated during prosecution of the services prior to completion of the services of Section 3, payments to be made in accordance with Paragraph 6.1.1 and 6.2.1 on account of that and all prior work under this Amendment shall be due and payable, and shall constitute total payment for services rendered. In addition, upon termination, the ENGINEER shall be paid for any Additional Services authorized and rendered under Section 4. The ENGINEER shall promptly begin work on the services authorized by this Amendment upon receipt of notice to proceed from the OWNER, including the specific work tasks authorized. SECTION 7 GENERAL CONDITIONS Since the ENGINEER has no control over the cost of labor, materials, or equipment, or over any construction contractor's method of determining prices, any opinions of probable construction cost which may be provided in the services of this Amendment are made on the basis of his experience and qualifications and represent his best judgement as a design professional familiar with the construction industry, but the ENGINEER cannot and does not guarantee that bids or the construction cost will not vary from opinions of probable cost prepared by him. 7.2 The OWNER and the ENGINEER each binds himself and his partners, successors, executors, administrators and assigns to the other party of this Amendment and to partners, successors, executors, administrators, and assigns of such other party in respect to all covenants of this Amendment. Nothing herein shall be construed as creating any personal liability on the part of any officer or agency of any public body which may be a party hereto, nor shall it be construed as giving any rights or benefits hereunder to anyone other than the OWNER and the ENGINEER. SECTION 8 8.1 The ENGINEER agrees to prosecute the work in a timely manner until the Project is completed. ' Attorney Kruppenbacher mentioned that on the City Manager background checks, we are down to three, we now have signed authorizations from the three applicants. From the two that I have read, there are no criminal background negative reports that have come up. In the process of doing the credit check, which we should have at the end of the week or beginning of next week. City Manager - John Govoruhk (1) Reports (2) Proposed HealthlLife Ins, Committee Selection of Final Three (3) East Central Florida Regional Planning Council FY 96 Assessment (4) Discussion on Code of Ordinances on the Internet: Manager Govoruhk stated that the Commission has a package on the proposed Health/Life Insurance and asked the Commission if they would like to have the three companies to give a presentation at the next meeting or set up a special meeting, Discussion. It was determined that there will be a special meeting on December 4, 1995 at 7:00 p,m. to hear the presentations of the three final compames. Manager Govoruhk said that the East Central Florida Regional Planning Council's sent us a bill and does the Commission want to pay it or not. Discussion. Motion was made by Commissioner Langellotti to pay the fee of $6,193.00 to the E.C.F.R.P.C. yearly fees to stay in the council. Seconded by Commissioner Ferring.
