PURPOSE: The purpose of this Board item is to authorize entering into an Interlocal Agreement with Seminole County for Engineering Design Services for Tuskawilla Road Utility Improvements. CONSIDERATIONS: Seminole County is widening Tuskawilla Road from two lanes to four lanes with a center median. The portion through Winter Springs is being designed in two phases identified as Phase ill (East Lake Drive to Winter Springs Boulevard) and Phase IV ( Winter Springs Boulevard to S.R 434). Seminole County has retained a consulting engineer, Bowyer, Singleton and Associates, to perform the roadway design. We would like to utilize the services ofBSA to design utility improvements that will be constructed as part of the roadway improvements. Those improvements include water main extensions and replacements, reclaimed water main extension, force main replacement, utility conflict resolution, modifications to the median irrigation, and upgrading the median sod to St, Augustine. The scope of work is defined in more detail and is attached to the agreement as Exhibit "A". It is desirable to use the services of the roadway consultant so that all design responsibility rests with a single party. ISSUE ANALYSIS: Weare currently working under the similar agreement the County for the NPDES Stormwater Permit application. This arrangement promotes cooperation and keeps the County in the loop as to what OUT plans are. Our engineering consultant, CPR, could be used to perform this scope of work. However, I would prefer that the roadway design engineer perform these tasks so that the party responsible for determining the impact to OUT project of any roadway design changes is the same party initiating the changes. FUNDING: The cost estimate for this design is $31,280.00. This project is budgeted in the Utility Department Capital Improvement Budget under line code #56310. Funds for this item will be expended within 120 days of the Notice To Proceed issuance. RECOMMENDATION: I recommend that authorizatiou be given to enter into an Interlocal Agreement with Seminole County for Engineering Design Services for Tuskawilla Road Utility Improvements at a cost of$31,280.00 plus a 10% contingency for design additions. The costs of the interlocal Agreement to be paid from the Utility Department Capital Improvement line code. IMPLEMENTATION SCHEDULE: This project will be initiated upon approval from the City Commission and subsequent execution by Seminole County. SEMINOLE COUNTY AND CITY OF WINTER SPRINGS INTERLOCAL AGREEMENT FOR UTILITY ENGINEERING DESIGN TillS AGREEMENT is made and entered into this _ day of 1996, by and between SEMINOLE COUNTY, a political subdivision of the State of Florida, whose address is Seminole County Services Building, 1101 East First Street, Sanford, Florida, 32771, hereinafter referred to as COUNTY; and CITY OF WINTER SPRINGS, a Florida municipal corporation, whose address is 1126 East State Road 434, Winter Springs, FL 32708 , hereinafter referred to as CITY. WIT N E SSE T H: WHEREAS, the parties hereto have the common power to perform utility engineering services within their g'eographical jurisdictions; and WHEREAS, CITY desires to contract with COUNTY for payment of utility engineering services performed under COUNTY I S contract with Bowyer-S ingleton & Associates, Inc. hereinafter referred to as "ENGINEER", dated Februaury 14, 1992; and WHEREAS, COUNTY is agreeable to providing these services under the terms and conditions of the referenced Agreement; and WHEREAS, COUNTY, at the request of CITY, will amend Work Order' Number 2 to the above referenced Agreement specifically to authorize the work requested by CITY and detailed as Exhibit A; and WHEREAS, this Agreement is authorized pursuant to the provision of Section 163.01, Florida Statutes, which authorizes the exercise by Agreement of two (2) or more public agencies of any power common to them. NOW, THEREFORE, in consideration of the mutual understandings and covenants set forth herein, the parties agree as follows: 1 OJ' .; SECTION 1. SERVICES. COUNTY, at the request of CITY will authorize its Engineer, pursuant to Work Order Number 2 to the above referenced Agreement to perform services in CITY. The scope of services for Work Order Number 2 is attached hereto as Exhibit A and incorporated by reference. '~, ': ,0 SECTION 2. COST PAYMENT.'CITY agrees to pay COUNTY all costs for performance of the services set forth in Exhibit A to the above referenced Work Order Number 2. Work Order Number 2 establishes that the Engineer shall be paid a fixed fee of THIRTY ONE THOUSAND TWO HUNDRED EIGHTY AND NOIlOO DOLLARS ($31,280.00). CITY agrees to pay COUNTY the above sum within thirty (30) days of invoicing and further agrees to pay the overruns or other causes. SECTION 3. INDENINIFICA TION. Neither party to this Agreement, its officers, employees and agents shall be deemed to assume any liability for the acts, omissions and negligence of the other party, its officers, employees and agents. SECTION 4. NOTICES.
