Authorization REQUEST: The Community Development Department, Urban Beautification Division, is requesting the Commission adopt Resolution 2009-49, declaring support for the Florida Trail Association (FTA) Gateway Community Program, and requesting execution of the related Memorandum of Understanding (MOU) between FTA and the City, outlining the responsibilities of each party under the program. PURPOSE: The purpose of this agenda item is for the approval of Resolution 2009-49, declaring support for the FTA Gateway Community Program. This mutually beneficial partnership between governmental agencies, community leaders and businesses will promote trail use, eco-tourism and commerce through activities, events, facilities and programs. CONSIDERATIONS: Florida's Trail System is quickly becoming a recreational destination and outdoor nature experience for residents and visitors along the nearly 1600 miles of trails throughout Florida. The City of Winter Springs benefits from having through it the Cross Seminole Trail System, one of the most attractive recreational trails in Central Florida, with the Winter Springs Town Center District being positioned directly in the heart of this unprecedented community development opportunity. The Florida Trail Gateway Community Program allows for communities to market resources to outdoor recreation enthusiasts as nature-based tourism destinations, resulting in local economic stimulus while increasing public awareness of Florida's Natural Resources. Gateway Communities work as partners to bring together community leaders, tourism affiliates, businesses and members of FTA to discuss the eco-tourism needs of the area and plan for growth. Additionally, FTA and participating Gateway Communities can work together to apply for grant funding specifically designed to assist in the development of nature-based tourism and economic development related to the trails system. FTA can provide support like no other organization in promoting eco-commerce for Florida Communities. FUNDING: There is no funding requirement on behalf of the City for approval of Resolution 2009-49. If, in the future, the Commission should decide to fund additional signage or sponsor events related to the FTA Gateway Community Program, opportunities will certainly be available. RECOMMENDATIONS: Staff recommends the Commission approve Resolution 2009-49, establishing and declaring support for the Florida Trail Association Gateway Community Program, making findings supporting the program, and authorize the City to partner with community leaders, government agencies and local businesses to promote nature-based tourism, economic development, and trail related infrastructure development. Staff s recommendation is based on the City Attorney's review and approval of Resolution 2009- 49 and Attachment `B' -Memorandum of'Understandinghetween FTA and the City. IMPLEMENTATION SCHEDULE: The City's participation in the FTA Gateway Community Program will begin immediately upon Commission approval of Resolution 2009-49 and execution of the Memorandum of Understanding with FTA. A volu~tteer from your local Florida Trail chapter will become your key contact, assisting your community in providing visitors information about the Florida'I'rail and in scheduling guided hikes, as well as providing general knowledge about the trail in your area. By working together on promotional products, educational resources or special events, the Florida Trail Association and the Gateway Community can increase each other's ability to apply for targeted grants to assist in the community's efforts towards nature-based tourism development, economic devel- opment, and trail-related infrastructure development. Attachment "B' - 9-28-09 Item C-200 Memorandum of Understanding Between Florida Trail Association and the City of Winter Springs This Memorandum of Understanding (MOU) is entered into by and between Florida Trail Association, a 501©(3) non-profit Florida organization, located at 5415 SW 13th Street, Gainesville, FL 32608, hereinafter referred to as FTA, and City of Winter Springs, located at 1126 E. SR 434, Winter Springs, Florida 32708, hereinafter referred to as Gateway Community. Purpose: The purpose of this MOU is to promote natural Florida as a destination for visitors to the state who increasingly ask for outdoor experiences and places to hike. Statement of Mutual Interests and Benefits: FTA is dedicated to building, maintaining, promoting, and protect ting a 1,400 mile long distance hiking trail through the state of Florida, called the Florida Trail (FT), providing a variety of outdoor experiences throughout Florida to connect visitors to the wonders of nature. The Gateway Community is near FT which offers basic tourism amenities and can be marketed as a nature-based tourism destination, resulting in local economic stimulus and increased public awareness of natural Florida. This MOU is established between FTA and Gateway Community to help each other accomplish mutually beneficial objectives: A. Educate local business of the value of the FT as an economic resource. B. Enable both parties to apply for targeted grants to assist in the community's efforts toward nature- based tourism development, economic development, and trail-related infrastructure development through the development of promotional products, educational resources or signature events. C. Increased usage and awareness of the FT attracting more eco-tourists to local communities. D. Promote responsible tourism development within the community and support of the FT. In consideration of the above premises, the parties agree as follows: FTA shall: 1. Promote the Gateway Community as a destination through its website and other media. 2. Offer outreach materials to the community such as brochures, newsletters, posters, displays, etc. 3. Provide detailed information on hiking opportunities near the community which can be reproduced and distributed to visitors to Gateway Community. 4. Provide periodic guided hikes that depart from the Gateway Community. 5. Provide support at local festivals or other community events to encourage interest in the Florida Trail when possible. 6. Provide two 18" x 24" metal signs with the Florida Trail Gateway Community logo for posting at the entrances to Gateway Community. 7. Regularly maintain the section(s) of the Florida Trail near the Gateway Community so that casual day hikers can easily locate and follow it. Attachment "B' - 9-28-09 Item C-200 Gateway Community shall: 1. Include the FT and FTA in their promotional materials. 2. VIII of the State Constitution, to exercise any power for municipal purposes, except when expressly prohibited by law; and WHEREAS, The Florida Trail Association is anon-profit organization whose mission is dedicated to building, maintaining, promoting and protecting over 1,500 miles of hiking trail throughout the state of Florida, referred to as the "Florida National Scenic Trail" of which over forty (40) miles exist within Seminole County; and WHEREAS, trails provide a variety of outdoor experiences that promote "natural" Florida as an eco-tourism destination for our citizens and visitors to connect with the environmental wonders of the State of Florida; and WHEREAS, The Florida Trail Association has established the "Gateway Community Program" to recognize mutually beneficial partnership with governmental agencies, local business, convention and visitors bureaus that help provide resources, educate, support and promote trail use through activities, events, facilities and programs that attract usage by both residents and visitors alike; and WHEREAS, Winter Springs desires to support the Florida Trail Association by promoting the "Gateway Community Program" through signage and activities that highlight nature based tourism, trail usage and wellness through organized hikes, awareness of Florida Hiking Trails Month, National Trails Day and Florida Greenways and Trails month; and WHEREAS, City Commission deems that this Resolution is in the best interests of the public health, safety, and welfare of the citizens of Winter Springs. If any section, subsection, sentence, clause, phrase, word, or portion of this Resolution is for any reason held invalid or unconstitutional by a court of competent jurisdiction, whether for substantive or procedural reasons, such portion shall be deemed a separate, distinct, and independent provision, and such holding shall not affect the validity of the remaining portions of this Resolution. Section 4. Repeal of Prior Inconsistent Resolutions. All prior resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of the conflict. Section 5. Effective Date. This Resolution shall become effective immediately upon its adoption by the City Commission of the City of Winter Springs, Florida. VIII of the State Constitution, to exercise any power for municipal purposes, except when expressly prohibited by law; and WHEREAS, The Florida Trail Association is a non - profit organization whose mission is dedicated to building, maintaining, promoting and protecting over 1,500 miles of hiking trail throughout the state of Florida, referred to as the "Florida National Scenic Trail" of which over forty (40) miles exist within Seminole County; and WHEREAS, trails provide a variety of outdoor experiences that promote "natural" Florida as an eco- tourism destination for our citizens and visitors to connect with the environmental wonders of the State of Florida; and WHEREAS, The Florida Trail Association has established the "Gateway Community Program" to recognize mutually beneficial partnership with governmental agencies, local business, convention and visitors bureaus that help provide resources, educate, support and promote trail use through activities, events, facilities and programs that attract usage by both residents and visitors alike; and WHEREAS, Winter Springs desires to support the Florida Trail Association by promoting the "Gateway Community Program" through signage and activities that highlight nature based tourism, trail usage and wellness through organized hikes, awareness of Florida Hiking Trails Month, National Trails Day and Florida Greenways and Trails month; and WHEREAS, City Commission deems that this Resolution is in the best interests of the public health, safety, and welfare of the citizens of Winter Springs. Incorporation of Recitals. The foregoing recitals are deemed true and correct and are hereby fully incorporated herein by reference. Section 2. Support and Integration. Winter Springs fully supports the "Gateway Community Program" and will work to integrate the Program events and activities into the educational and recreational agenda for Winter Springs. This Resolution is presented to the Florida Trail Association as a determination of our support for the "Gateway Community Program" in Winter Springs. Section 3. Severability. If any section, subsection, sentence, clause, phrase, word, or portion of this Resolution is for any reason held invalid or unconstitutional by a court of competent jurisdiction, whether for substantive or procedural reasons, such portion shall be deemed a separate, distinct, and independent provision, and such holding shall not affect the validity of the remaining portions of this Resolution. Section 4. Repeal of Prior Inconsistent Resolutions. All prior resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of the conflict. Section 5. Effective Date. This Resolution shall become effective immediately upon its adoption by the City Commission of the City of Winter Springs, Florida. GARGANESE, City Attorney City of Winter Springs Resolution No. 2009 -49 Page 2 of 2 Attachment "B' — 9 -28 -09 Item C -200 Memorandum of Understanding Between Florida Trail Association and the City of Winter Springs This Memorandum of Understanding (MOU) is entered into by and between Florida Trail Association, a 501 (c) (3) non - profit Florida organization, located at 5415 SW 13 Street, Gainesville, FL 32608, hereinafter referred to as "FTA," and City of Winter Springs, located at 1126 E. SR 434, Winter Springs, Florida 32708, hereinafter referred to as "Gateway Community." Purpose: The purpose of this MOU is to promote natural Florida as a destination for visitors to the state who increasingly ask for outdoor experiences and places to hike. Statement of Mutual Interests and Benefits: FTA is dedicated to building, maintaining, promoting, and protecting a 1,400 mile long distance hiking trail through the state of Florida, called the Florida Trail (FT), providing a variety of outdoor experiences throughout Florida to connect visitors to the wonders of nature. The Gateway Community is near FT which offers basic tourism amenities and can be marketed as a nature -based tourism destination, resulting in local economic stimulus and increased public awareness of natural Florida. This MOU is established between FTA and Gateway Community to help each other accomplish mutually beneficial objectives: A. Educate local businesses of the value of the FT as an economic resource. B. Enable both parties to apply for targeted grants to assist in the community's efforts toward nature - based tourism development, economic development, and trail - related infrastructure development through the development of promotional products, educational resources or signature events. C. Increased usage and awareness of the FT attracting more eco- tourists to local communities. D. Promote responsible tourism development within the community and support of the FT. In consideration of the above premises, the parties agree as follows: FTA shall: 1. Promote the Gateway Community as a destination through its website and other media. 2. Offer outreach materials to the community such as brochures, newsletters, posters, displays, etc. 3. Provide detailed information on hiking opportunities near the community which can be reproduced and distributed to visitors to Gateway Community. 4. Provide periodic guided hikes that depart from the Gateway Community. 5. Provide support at local festivals or other community events to encourage interest in the Florida Trail when possible. 6. Provide two 18" x 24" metal signs with the Florida Trail Gateway Community logo for posting at the entrances to Gateway Community. 7. Regularly maintain the section(s) of the Florida Trail near the Gateway Community so that casual day hikers can easily locate and follow it. Attachment "B' — 9 -28 -09 Item C -200 Gateway Community shall, to the extent determined practical and feasible by the Gateway Community: 1. Include the FT and FTA in their promotional materials. 2. Make Florida Trail information available to the public at the local visitor centers and /or Chamber of Commerce and provide space for a FTA display or wall mounted poster. 3. Work with the local FTA contact to promote periodic guided hikes or events. 4. Assist in promoting special designations such as Florida Hiking Trails Month in February and National Trails Day the first Saturday in June. 5. Monitor the number of visitors who are seeking the Gateway Community as a destination for hiking. 6. Attract businesses that support nature -based tourism such as outfitters, hostels and shuttling services and assure that FTA maps and guides will be available from the business in town for visitors to purchase. 7. Encourage local businesses to provide discounts in accommodations or special weekend packages for visitors who show their FTA membership card. Termination: Either party hereto may terminate this MOU at any time and for any reason upon fourteen (14) days written notice to the non - terminating party. We, the undersigned, have agreed on the contents of this MOU. Any changes to this MOU must be set forth in writing and agreed to by both parties hereto.
