O Meeting A thorization REQUEST: The Community Development Department, Urban Beautification Division, is requesting that the City Commission consider Resolution 2010 -07, authorizing the submission of a request to the U.S. Highway 17 -92 Community Redevelopment Agency to fund the Shepard Road Streetscape Project at an estimated cost of $500,000. SYNOPSIS: Winter Springs has been a member of the U.S. Hwy 17 -92 Corridor Redevelopment Planning Agency (CRA) since October 21, 1998 with approximately $750,000 being put into the related Redevelopment Trust Fund (RTF) since inception. To date, there has been only one redevelopment project by a private business within the Winter Springs portion of the CRA. Staff has identified Shepard Road as the area that would benefit most from a redevelopment project under the program and is recommending that the City Commission consider approving staff to move forward in submitting the Shepard Road Streetscape Project to the CRA for funding. CONSIDERATIONS: Shepard Road is the northwestern gateway to Winter Springs at U.S. 17 -92 serving the Highlands Community, Wildwood, Highlands Elementary, and several businesses that are located directly within the boundaries of the CRA. The condition of this roadway has deteriorated over the years and several areas along the western portion are visually blighted and appear economically depressed. Rejuvenation of this area is seen as a positive action relative to future economic development efforts within this section of the City and along the entire City frontage with the 17 -92 Corridor. As part of the redevelopment program, the CRA will reimburse Winter Springs for all construction costs for the Shepard Road Streetscape Project including funding of the related March 8, 2010 Agenda Item 600 maintenance for a two (2) year time period. After the project has been reviewed and approved by the CRA, an Interlocal Agreement will be presented to the Winter Springs City Commission for approval and execution by all parties prior to start of the project. PROJECT SCOPE • Resurfacing from U.S. 17 -92 to Wildwood Drive (approx. 1600' feet), including the installation of curb and gutter. • Installation of an 8' sidewalk from U.S. 17 -92 to Wildwood Drive on the south side of the roadway. • Installation of a gateway feature, Florida friendly landscaping and street furnishings. • Installation of decorative street lighting and signage. • Conversion of any open storm water ditches to underground systems. PROJECT BENEFITS • Furthers the City's Comprehensive Plan goals, objectives and policies: • Intergovernmental Coordination Element Policy 1.2.5. • Housing Element Policy 2.2.11 (See FLU Element, Policy 1.5. 7). • Transportation Element Objectives 1.2, 1.2.12, 1.3 & 1.5.13. • Resurfacing of Shepard Road segment between Sheoah Boulevard and U.S. 17 -92. • Improved pedestrian access to bus facilities on U.S. 17 -92. • Improved pedestrian access and safety for Highlands Elementary and the surrounding communities. • Improved storm water retention and conveyance. • Enhanced environment for economic development efforts for the area. • Provides a northwestern gateway feature to the City. • Offsets future expenditures by the City and private developments. • Beautifies and encourages additional conservation landscaping projects. FISCAL IMPACT: If approved, the project will be funded from the U.S. Hwy 17 -92 Corridor Redevelopment Planning Agency Redevelopment Trust Fund, in the estimated amount of $500,000 as follows: Project Start 1/3 of project cost paid to the City 50% Completion 1/3 of project cost paid to the City Completion 1/3 of project cost paid to the City The City will be required to fund design costs in the amount of $10,896 plus reimbursable expenses of up to $375 (see Attachment 'A), for the background, engineering and concept plans submittal to the CRA. This expense would be funded initially from the City's General Fund Reserves and is expected to be reimbursed by the CRA as part of the total project cost. The estimated total of $500,000 is projected to be the maximum cost of the project, however, the actual cost is unknown until the project is let for public bid and a contract awarded by the City Commission. March 8, 2010 Agenda Item 600 COMMUNICATION EFFORTS: The Shepard Road Streetscape Project has been shared with the public through contact from city staff with stakeholder groups that will be directly affected by improvements related to this redevelopment project. Staff is planning to review conceptual designs with the public and seek final input prior to commencement of the project. Staff has sought feedback regarding this project from stakeholder groups including Dittmer Architectural Aluminum and with representatives from The Highlands and Wildwood Subdivisions. All have received the concept well and look forward to the economic stimulus, public safety and beautification aspects that will come to the subject roadway section as a result of this project. Conceptual plans will be shared with each group for input prior to finalization of the project. RECOMMENDATION: Staff recommends the City Commission consider the proposed project for the Shepard Road Streetscape Project and Resolution 2010 -07, allowing for staff to move forward with the conceptual design phase of the project and for submittal to the CRA for funding approval. The initial cost of $10,896, plus reimbursable expenses of ap to $375, for the background work, engineering and concept plans submittal, would be paid from the City's General Fund Reserves to continuing landscape and architectural services vendor Bellomo- Herbert & Company (RFQ# 011 /09 /KL). It is anticipated that reimbursement of this expense in full will be part of the total project cost and provided to the City at project start. (CONSULTANT) and made a part thereof. The purpose of this Task Assignment is to specify the required services of the Landscape Architect for the Shepard Road Streetscape, located in Winter Springs, Florida II. GENERAL SCOPE OF THE WORK The project consists of providing concept and preliminary engineering for the widening of Shepard Road from east of US 17/92 to Wildwood Drive in Winter Springs, Florida. The roadway typical section will consist of the existing two 12 -foot travel lanes in each direction with Type F curb on the outside, an 8 -foot wide sidewalk on the south side of the road and a 5 -foot wide sidewalk on the north side of the road both with 3 -foot utility strips behind the curb, and a closed drainage system. The existing travel lanes will be milled and resurfaced. II, GENERAL SCOPE OF THE WORK The part of the Project for which the CONSULTANT is to perform services is generally described as follows: A. TASK 1-- SURVEY Perform a Topographic Survey of Shepard Road, located in Winter Springs, Seminole County, Florida, as per Chapter 61G17 -6 of the Florida Administrative Code in compliance with the minimum technical standards of surveying and mapping of the State of Florida. • 50' grid of Shepard Road as defined as run east from the apparent west right -of -way line of S.R. 17 -92 to Wildwood Drive (approximately 1,600'). • Location of existing visible above ground improvements & visible utilities within right-of-way. • Invert elevations of existing drainage structures • Depict apparent right -of -way lines of Shepard Road (this is not a boundary survey) • Establish two (2) on -site benchmarks. The following related services are not included in the scope of this proposal, and may or may not be required, but can be provided at an additional fee: Soil Borings, Sketch and Description, Wetland Location/Delineation, Ordinary High Water/Mean High Water and Underground Utility Location, Title Review and Right -of -Way Maps. The CONSULTANT will take all the available site information and prepare up to two (2) conceptual streetscape designs along with typical sections and/or perspective sketches for the street to clearly show the design intent for this corridor. These plans shall indicate new sidewalks, landscaping, lighting and street furnishings. The plans will be reviewed with city staff for comment. 2. The CONSULTANT will provide conceptual design sketches (elevations) of a gateway feature to be located at the intersection of Shepard Road and 17 -92. 3. The CONSULTANT will provide estimates of probable cost for the designs. D. TASK 3 — PLAN REVISIONS & RENDERING 1. At the direction of the City staff, the CONSULTANT will make changes to the conceptual streetscape plan and prepare a final colored rendering for use by the City. 2. The CONSULTANT will provide a final estimate of probable cost for the design. E. TASK 4 — CRA MEETING The CONSULTANT shall attend one CRA meeting to present the conceptual streetscape design. F. TASK S — PRLIMINARY ENGINEERING 1. The CONSULTANT shall provide preliminary engineering for the widening of the roadway which will include reviewing the preliminary concept designs and developing a drainage concept. 2. The CONSULTANT'S engineer shall meet with representatives of the St. Johns River Water Management District to determine if the preliminary engineering concept will result in the need for a SJRWMD stormwater permit or if the project will qualify for a permit exemption. III. COMPENSATION Total compensation for all the services necessary to complete the work as described herein shall be a lump sum fee of $ 11,271.00, inclusive of the reimbursable expenses described below. A detailed hourly Task Breakdown associated with the work to be completed is attached as Exhibit `A'. IV. SCHEDULE The work described herein shall be completed within 45 calendar days of receipt of a Notice to Proceed from the CITY. WHEREAS, the City is granted the authority, under § 2(b), Art. VIII of the State Constitution, to exercise any power for municipal purposes, except when expressly prohibited by law; and WHEREAS, on June 24, 1997, the Seminole County Board of County Commissioners adopted Resolution 97 -8 -130, establishing the United States Highway 17 -92 Corridor Community Redevelopment Agency (the "CRA "), pursuant to section 163.357, Florida Statutes, and determining that the United States Highway 17 -92 Corridor Community Redevelopment Area (the Redevelopment Area) is a blighted area; and WHEREAS, on December 16, 1997, the Seminole County Board of County Commissioners approved Ordinance No. 97 -54, which adopted a Redevelopment Plan for the Redevelopment Area; and WHEREAS, on December 16, 1997, the Seminole County Board of County Commissioners adopted Ordinance No. 97 -55, which authorized the establishment of a Redevelopment Trust Fund, as provided for in section 163.3 87, Florida Statutes, in which tax increment revenues deriving from the Redevelopment Area will be deposited for the purposes of financing particular elements of the Community Redevelopment Project; and WHEREAS, on November 24, 1997, the City Commission of the City of Winter Springs adopted a resolution which, pursuant to section 163.356, Florida Statutes, concurred with the Redevelopment Plan adopted by the Seminole County Board of County Commissioners so that the portions of the Redevelopment Area and the programs and projects of the Redevelopment Plan that fall within or which will be implemented within the corporate limits of the City of Winter Springs will function as intended by the County and City; and WHEREAS, on October 21, 1998, the City entered into a Multi -Party Interlocal Agreement establishing the U.S. Highway 17 -92 Corridor Redevelopment Planning Agency (Multi -Party Agreement) with Seminole County, the City of Casselberry, the City of Lake Mary and the City of City of Winter Springs Resolution No. 2010 -07 Page 1 of 3 Sanford to establish a partnership for the purposes of carrying out the intent of the Redevelopment Plan; and WHEREAS, the purposes of the Redevelopment Plan include the eradication of blight as evidenced in defective street layout, faulty lot layout, unsafe conditions and visual blight; and WHEREAS; the portion of Shepard Road that is located in the Redevelopment Area shows evidence of a blighted condition; and WHEREAS, the City is proposing a beautification and improvement plan for that portion of Shepard Road that is located in the Redevelopment Area in order to eliminate the blighted condition, advance economic development and increase the valuation of property in the Redevelopment Area (the "Shepard Road Streetscape Project "), consistent with the criteria for development projects set forth in the Multi -Party Agreement; WHEREAS, City Commission deems that this Resolution is in the best interests of the public health, safety, and welfare of the citizens of Winter Springs. NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, SEMINOLE COUNTY, FLORIDA, THAT: Section 1. Incorporation of Recitals. The foregoing recitals are deemed true and correct and are hereby fully incorporated herein by reference. Section 2. Implementing Administrative Actions. The City Commission hereby directs the City Manager to prepare and submit a request to the U.S. Highway 17 -92 CRA for funding of the Shepard Road Streetscape Project in an amount estimated at $500,000. Section 3. Severability. If any section, subsection, sentence, clause, phrase, word, or portion of this Resolution is for any reason held invalid or unconstitutional by a court of competent jurisdiction, whether for substantive or procedural reasons, such portion shall be deemed a separate, distinct, and independent provision, and such holding shall not affect the validity of the remaining portions of this Resolution. Section 4. Repeal of Prior Inconsistent Resolutions. All prior resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of the conflict. Section 5. Effective Date. This Resolution shall become effective immediately upon its adoption by the City Commission of the City of Winter Springs, Florida.
