HomeMy WebLinkAbout2009 09 28 Public Hearing 502 Second Reading and Adoption of Ordinance 2009-13 Regarding Water, Wastewater and Reclaimed Water Rates, Fees and ChargesCOMMISSION AGENDA ITEM 502 September 28, 2009 Meeting CONSENT INFORMATIONAL PUBLIC HEARING X REGULAR MGR /DEPT ~~~e~/ Authorization REQUEST: Utility Department Requesting the City Commission hold a Public Hearing for the 2"d Reading and Adoption of Ordinance #2009-13 Amending Chapter 19, Utilities, of the Code of Ordinances regarding Water, Wastewater, and Reclaimed Water Rates, Fees, and Charges. PURPOSE: The purpose of this Board item is to adopt Ordinance #2009-13, amending Chapter 19 of the Code of Ordinances regarding water, wastewater, and reclaimed water rates, fees and charges, based on the recommendations of the Water and Wastewater Rate and Charge Study prepared by Public Resources Management Group, Inc. CONSIDERATIONS: The City Commission authorized a Utility Rate Study in February 2008 to review the water, wastewater, and reclaimed water rates. The focus of the study was to define the rates needed to operate the Utility system including meeting debt service coverage, fund the additional capital needed to construct the reclaimed augmentation plant and distribution system, and propose rates for the expired reclaimed water agreement with the Tuscawilla Golf Course. The recommendations of the study were reviewed at meetings on May 4t" and August lOt", 2009. Ordinance 2009-13 implements the recommendations discussed at those meetings except for the 2°d and 3`d year of the reclaimed water rates. In summary, the changes are: Water and Wastewater Rates Water Rates are proposed to increase 8% on 10/1/09, 7% on 10/1/10 and 7% on 10/1/11. Wastewater Rates are proposed to increase 15% on 10/1/09, 7% on 10/1/10 and 7% on 10/1/11. September 28, 2009 Public Hearing Agenda Item 502 Page 2 Reclaimed Water Rates Reclaimed water rates are proposed to increase from $0.25 per thousand gallons to $0.75 per thousand gallons (47% of the potable rate) at the bottom level of the rate structure. Usage over 20,000 gallons per month will increase from $0.50 per thousand gallons to $2.13 per thousand gallons (45% of the potable rate). Future rates will be reviewed during the coming fiscal year. Service Availability Charges (Water/Sewer Impact Fee) Increases to the service availability charges are have been spread over the three year period with no increase fiscal year 2010. Water Sewer Single Family Home Current $1.48/gal $7.33/gal $2, 717.00 10/1/2010 $1.59/gal $7.70/gal $2,866.50 10/1/2011 $1.70/gal $8.07/gal $3,016.00 Indexing Rates Consumptive rates, base facility charges, and service availability charges are proposed to be indexed to the national CPI beginning October 1, 2012. Wholesale Reclaimed Rate (Golf Course) The bulk rate for providing reclaimed water to golf courses is proposed to be $0.52 per 1,000 gallons. Currently we are providing reclaimed water to Tuscawilla Golf Course at no charge by agreement which expires October 1, 2009. Miscellaneous Charges Various miscellaneous charges are proposed to be slightly increased to reflect updated cost to provide these services. They have not been changed since 2002. Two new fees are proposed -Meter Bench Test Fee of $25.00 and Reinstatement before Cutoff Fee of $20.00. The meter bench fee would not be charged for any meter which falls outside of meter accuracy standards (generally 98.5% to 101.5%). The Reinstatement before Cutoff Fee gives Utility September 28, 2009 Public Hearing Agenda Item 502 Page 3 billing staff a customer friendly option to reduce the cutoff fee from $40 to $20 if the Service Technician has not physically shut off the meter prior to payment being received. RECOMMENDATION: It is recommended that the City Commission hold approve a public hearing for the 2nd reading and adoption of Ordinance 2009-13 amending Chapter 19, Utilities, of the Code of Ordinances regarding water, wastewater, and reclaimed water rates, fees and charges. ATTACHMENTS: 1. Ordinance 2009-13 IMPLEMENTATION: The public hearing was advertised in the Orlando Sentinel on September 17, 2009. If adopted, the new rates will be effective October 1, 2009. The first bills that will include the increase will be mailed the week of October 12t". This is due to the rate codes needing to be installed in the meter reading devices and the subsequent lag before billing. COMMISSION ACTION: ORDINANCE N0.2009-13 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, FLORIDA, AMENDING CHAPTER 19, UTILITIES, OF THE CODE OF ORDINANCES REGARDING WATER, WASTEWATER, AND RECLAIMED WATER RATES, FEE5 AND CHARGES; PROVH)ING FOR THE REPEAL OF PRIOR INCONSISTENT ORDINANCES AND RESOLUTIONS; INCORPORATION INTO THE CODE; SEVERABILITY; AND AN EFFECTIVE DATE. WHEREAS, the City is granted the authority, under § 2(b), Art. VIII of the State Constitution, to exercise any power for municipal purposes, except when expressly prohibited by law; and WHEREAS, the City Commission of the City of Winter Springs has determined it to be in the best interest of the safety, health and welfare of the citizens of the City of Winter Springs to provide for the adoption of rates, fees and charges relating to water, wastewater and reclaimed water; and WHEREAS, at the request of the City, Public Resources Management Group, Inc. ("Consultant") has conducted a review of the existing water, wastewater and reclaimed water rates to determine the appropriateness of such rates to meet the anticipated expenditure requirements of each respective utility division; and WHEREAS, the Consultant's findings are set forth in the Water and Wastewater Rate and Charge Study ("Rate Study") dated July 2009; and WHEREAS, on August 10, 2009, the City Commission reviewed the Consultant's Rate Study and directed that the Consultant's recommendations contained therein be implemented; and WHEREAS, the City Commission desires to adopt the revisions to the City's water, wastewater and reclaimed water rates, fees and charges as set forth in this Ordinance and consistent with the Consultant's recommendations as set forth in the Rate Study; and WHEREAS, prior to adoption ofthis Ordinance, the City provided notice of this Ordinance to its water, wastewater, and reclaimed water customers through the City's utility billing process in accordance with section 180.136, Florida Statutes; and WHEREAS, the City Commission hereby finds the rates, charges, and fees to be paid to the City for the use of the City's water, wastewater, and reclaimed utilities to be just and equitable and City of Winter Springs Ordinance No. 2009-13 Page 1 of 14 therefore, said rates, charges, and fees are hereby deemed in compliance with section 180.13, Florida Statutes; and WHEREAS, the City Commission ofthe City of Winter Springs, Florida, hereby finds this ordinance to be in the best interests ofthe public health, safety, and welfare ofthe citizens of Winter Springs. NOW, THEREFORE, THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS HEREBY ORDAINS, AS FOLLOWS: Section 1. Recitals. The foregoing recitals are hereby fully incorporated herein by reference as legislative findings ofthe City Commission of Winter Springs. Section 2. Code Amendment. The City of Winter Springs Code Chapter 19, Utilities, is hereby amended as follows (underlined type indicates additions and ~ type indicates deletions, while asterisks (***) indicate a deletion from the Ordinance of text existing in Chapter 19. It is intended that the text in Chapter 19 denoted by the asterisks and set forth in this Ordinance shall remain unchanged from the language existing prior to adoption of this ordinance): CHAPTER 19. Repeal of Prior Inconsistent Ordinances and Resolutions. All prior inconsistent ordinances and resolutions adopted bythe City Commission, or parts of prior ordinances and resolutions in conflict herewith, are hereby repealed to the extent of the conflict. Section 4. Incorporation Into Code. This Ordinance shall be incorporated into the Winter Springs City Code and any section or paragraph, number or letter, and any heading may be changed or modified as necessary to effectuate the foregoing. Grammatical, typographical, and like errors may be corrected and additions, alterations, and omissions, not affecting the construction or meaning of this Ordinance and the City Code may be freely made. Section 5. Severability. If any section, subsection, sentence, clause, phrase, word or provision of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, whether for substantive, procedural, or any other reason, such portion shall be deemed a separate, distinct and independent provision, and such holding shall not affect the validity of the remaining portions of this ordinance. Section 6. Effective Date. This Ordinance shall become effective immediately upon adoption by the City Commission of the City of Winter Springs, Florida, and pursuant to the City Charter. Section 3. Repeal of Prior Inconsistent Ordinances and Resolutions. All prior inconsistent ordinances and resolutions adopted by the City Commission, or parts of prior ordinances and resolutions in conflict herewith, are hereby repealed to the extent of the conflict. Section 4. Incorporation Into Code. This Ordinance shall be incorporated into the Winter Springs City Code and any section or paragraph, number or letter, and any heading may be changed or modified as necessary to effectuate the foregoing. Grammatical, typographical, and like errors may be corrected and additions, alterations, and omissions, not affecting the construction or meaning of this Ordinance and the City Code may be freely made. Section 5. Severability. If any section, subsection, sentence, clause, phrase, word or provision of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, whether for substantive, procedural, or any other reason, such portion shall be deemed a separate, distinct and independent provision, and such holding shall not affect the validity of the remaining portions of this ordinance. Section 6. Effective Date. This Ordinance shall become effective immediately upon adoption by the City Commission of the City of Winter Springs, Florida, and pursuant to the City Charter.
