HomeMy WebLinkAboutUS Department of Agriculture Natural Resources Conservation Service (NRCS) Project Agreement 69-4209-9-1705 Amendment No.2AMENDMENT NO.2 To PROJECT AGREEMENT 69-4209-9-1705 Between CITY OF WINTER SPRINGS And The UNITED STATES DEPARTMENT OF AGRICULTURE NATURAL RESOURCES CONSERVATION SERVICE RE: Emergency Watershed Protection project resulting from Tropical Storm Fay. This amends the Project Agreement 69-4209-9-1705 between the above parties relative to the Tropical Storm Fay Emergency Watershed Protection Project. Clause A is amended to decrease the estimated construction cost by $180,000.00 and to read as follows: A. It is agreed that the following described works of improvement is to be constructed at an estimated cost not to exceed $220,000.00 Location Description DSR No. Bear Creek Stabilize eroded areas to prevent erosion and WS-SEM-001FAY remove debris to prevent flooding. Gee Creek Stabilize eroded areas to prevent erosion and WS-SEM-002FAY remove debris to prevent flooding. Clause B.8 is amended to increase the maximum value of in-kind technical services that will be reimbursed to the Sponsor from not to exceed 7.5 percent to not to exceed 12.5 percent and to read as follows: 5. Provide in-kind technical services (survey the site, design the project, develop engineering plans and specifications, let and administer contracts, inspect work performed, certify the completed work, and prepare as-built drawings). The maximum value of in-kind technical services that will be reimbursed to the Sponsor will not exceed 12.5 percent of the actual eligible construction cost from contracts for constructing the emergency watershed protection measures described in Section A and in accordance with Section B.5 and B.6 of this agreement. Costs for in-kind technical services utilized for Sponsor in-kind construction services are not eligible for reimbursement. Clause C.2 is amended to increase the NRCS' reimbursement for the Sponsor in-kind technical services from not to exceed 7.5 percent to not to exceed 12.5 percent of the actual cost of constructing the emergency watershed protection measures and to read as follows. 2. Provide the value of the Sponsor in-kind technical services not to exceed 12.5 percent of the actual eligible construction cost from contracts for constructing the works of improvement described in Section A and computed as described in B.B.
