ELEMENTARY SCHOOL "E"
An Interlocal Agreement between
the City of Winter Springs and the School Board of Seminole. County
This INTERLOCAL AGREEMENT (the "Agreement") is made and entered into
by the CITY OF WINTER SPRINGS, a body corporate eXisting under the laws of the
State of Florida (the "City") and the SCHOOL BOARD OF SEMINOLE COUNTY,
FLORIDA, a body corporate existing under the laws of the State of Florida (the "School
Board"),
WHEREAS, the parties to this Agreement have determined to collectively utilize
their individual powers in the Pllblic interest to promote the expeditious development of
Elementary School "E"; and
WHEREAS, the State Regulations for Educational Facilities of the Florida
Administrative Code govern the planning and construction of schools in Seminole County
and the comprehensive plan and land development regulations govern planning and
construction in the City of Winter Springs; and '
WHEREAS, Section 235,193, Florida Statutes requires the coordination of
planning between the School Board and the City of Winter Springs; and
WHEREAS, Section 235,193(9), Florida Statutes, provides authority for a local
governing body and district school Board to establish an alternative process for reviewing
a proposed educational facility and site plan, and off-site impacts; and
WHEREAS, Section 235,02, Florida Statutes, permits and authorizes the use of
school buildings and school grounds as community centers; and
WHEREAS, the City and the School Board serve the same public constituency;
THEREFORE, in consideration of the premises and for good and valuable
consideration, receipt of which is hereby acknowledged by both parties, the parties hereby
agree, stipulate, and covenant as follows:
1, This Agreement is entered into pursuant to the provisions of the Florida Interlocal
Cooperation Act contained in Section 163,01, Florida Statutes,
2. In order to coordinate and expedite the planning of Elementary School"E" and comply
with Section 235.193, Florida Statutes, the City Commission will serve as the approving
authority and the School Board will submit the following infonnation on the property
under review:

a, legal description
b, topograhical survey and location of existing natural features including trees
c,environmental survey
d, identification of existing soil types and conditions
e, surrounding land use and zoning
f, proposed site plan
g, existing and proposed utilities
h, proposed on-site and off-site improvements
i. stormwater management plan, with drainage calculations
j. identification of any proposed deviations to specified standards of the land development
regulations, with explanations for request
k. additional information that the City requests in order to identify and evaluate the site plan and
its adequacy as it relates to environmental concerns, health, safety, and welfare, off site impact, and effects
on adjacent property,
The City staff will review the submitted documents, advise the School Board of
deficiencies, and make recommendations to address the concerns, The revised submittal
will then be scheduled for a public hearing before the City Commission at the earliest
possible date, Following approval by the City Commission, school construction may
proceed with normal utility and site development inspections,
3, The School Board will pay to the City the appropriate connection fees for water and
sewer service based on proposed usage calculations approved by the City,
4. Because the primary access to Elementary School "E" will be a Seminole County (the
"County") facility, the City will accept the County transportation concurrency evaluation
and' determination unless there is an. overriding public safety concern.
5, All notices and clarifications required under this Agreement shall be directed to the
following offices:

6,Each of the parties hereto hereby agree that they will execute arid deliver su'ch further
instruments and do such further acts and things as may be necessary or desirable to carry
out the purpose of this Agreement.

7.Each provision of this Agreement is intended to be severable, If any term or provision
hereof is illegal or invalid for any reason whatsoever, such legality or invalidity shall not
affect the remainder of this Agreement.
8, This Agreement and the rights of the parties shall be governed by and construed or
enforced in accordance with the laws of the State of Florida,
