WHEREAS, the hereinafter described property held by the
Department of Transportation is no longer used or needed and the
Seqretary of District Five, Florida Department of Transportation on
b-/S-9~ has approved conveyance to the Grant~e without
consideration, to be used solely for public purposes, pursuant to
the provisions of section 337.25(4), Florida Statutes.
WHEREAS, the realignment of State Road 434 has created
surplus Department of Transportation right of way as described in
Exhibi t "A", and .
o WHEREAS, the City of Winter Springs utilizes said right
.J of way for ingress and egress from Central Winds Park, a public u.>

~ WHEREAS, the winter Springs High School, a public schoQ1 u.> t;
~ of the Seminole County School District, also uses said right of way ;:

NOW, THEREFORE, THIS INDENTURE WITNESSETH: That the
Party of the First Part does hereby remise, release and quitclaim
unto the Party (Parties) of- the Second part, and assigns, forever,
all the right, title and interest of the State of Florida and/or
the State of Florida Department of Transportation to the property
described on Exhibit "A", attached hereto and made a part hereof,
with the terms and conditions set forth therein;
TO HAVE AND TO HOLD the said premises and the
appurtenances thereof unto the Party (Parties) of the Second Part.
THIS CONVEYANCE IS made subject to any unpaid taxes,
assessments, liens, or encumbrances of any nature whatsoever which
the Party (Parties) of the Second Part hereunder and herein
assumes.
THIS CONVEYANCE is further conditioned on the following:
All rights of access from adjoining property owned by the Party of
the First Part and all rights of light, air, and view are hereby
reserved to the Party of the First Part.. In addition, if, at any
time, Party of the Second Part abandons the property, ceases use of
the property for public purposes, all right, title and interest in
and to the property shall automatically revert to the Party of the
First Part. The Party of the Secqnd Part, by acceptance of this
deed, further agrees that in the event that any of the property is
ever needed for transportation purposes by the Party of the First
Part, it will reconvey, without. compensation, any such property
needed.
