MODIFICATION AGREEMENT
This Agreement by and between the STATE OF FLORIDA DEPARTMENT OF
TRANSPORTATION (the "Department"), and the City of Winter Sprinl!s, (the "Contractor");
WITNESSETH:
WHEREAS, the Contractor and the Department previously entered into a contract on
01130/2003, identified as Contract No,: AN054, FIN No.: 413698-4-74-01; and
WHEREAS, the Contractor and the Department have detemiined that there was a clerical
error in the original contract; and
WHEREAS, the original intent and actual agreement of the parties was to perform in
accordance with the contract without said clerical error; and
WHEREAS, the parties desire to amend the contract to correct the clerical error;
NOW, THEREFORE, for and in consideration of the premises hereof and other mutual
benefits to accrue to each of the parties hereto, it is mutually agreed as follows:
1, The above referenced contractis hereby amended as follows:
a. On page 4 of 10, paragraph 11 shall read:
\ \ The beautification grant awarded pursuant to this AGREEMEN:I shall be effective
and continue for a period of one (1) year from the date of the Notice to Proceed."
b. On page 4 of 10, paragraph 12 is omitted

2, This amendment shall be effective as of the date of the original contract as though the
clerical error did not occur.
3, Except, as specifically modified hereby, said contract shall remain in full force and effect.

their duly authorized officers and their official seals hereto affixed, this day of

Dear Mr. Hill:
Attached is a Modification Agreement for the above subject contract, which was fully
executed by the Department on 01130/2003.
The one Modification noted is the Term ofthis contract which begins with the Notice to
Proceed (NTP). The Term of this contract has been extended to 07/29/2004,
Resolution 2001-01, of the City Commission of the City of Winter Springs, Florida
authorizes the City Manager to enter into this Highway Beautification Memorandum of
Agreement. Therefore, we need the City Manager to sign and return this Modification
Agreement to me for execution by the Department, I will return a copy to you once the
Modification Agreement is fully executed by the Department.
