MUNICIPALITY X i ~,1~ ~~ J 3 ~ ~~ ID No hereinafter referred to as the Using Agency, and the State of Florida, Department of Management Services, Information Technology, hereinafter referred to as ITP. Whereas, the Using Agency has applied for services from the state telecommunications network known as SUNCOM; and Whereas, the Using Agency complies with all requirements of Chapter 282, Florida Statutes, and the rules of ITP; NOW THEREFORE, it is agreed: 1. ITP shall provide SUNCOM Services to the Using Agency according to the Services noted and detailed in Exhibit 1 to this AGREEMENT. 2. ITP shall provide the Using Agency accessibility to SUNCOM. All lines not restricted by the Using Agency shall have access to SUNCOM. 3. Charges shall be paid to ITP by the Using Agency for these services and shall be based upon the current rates established and published by Information Technology to all state agencies and local government Communications Service Authorization (CSA) representatives. These rates shall cover administrative costs as well as network utilization, and access costs. ITP shall provide the Using Agency with an invoice each month for services utilized by the Using Agency, consistent with the billing system, rates and concepts used to develop the overall SUNCOM rate structure and cost recovery methodology. 4. Nonpayment of an invoice presented to an agency within 40 consecutive calendar days constitutes sufficient reason for Information Technology to: (a) notify the applicable common carrier to terminate service to the agency in the case of a non-state agency; or (b) notify the State of Florida Comptroller to transfer funds to the Department of Management Services under the provision of Chapter 216.292(7), Florida Statutes, in the case of a state agency. If non payment is for a SUNCOM Network Service, in the case of a non-state agency, the SUNCOM Network Control Center (NCC) will be notified to block the non-state agency's access to the network. 5. The Using Agency recognizes and agrees that the billing concepts and network configuration may be subject to changes from time-to-time as a result of changes in applicable laws, regulations, traffic patterns, and other conditions which may result in modifications to existing policy decisions or directives. 8/15/97 SUNCOM NETWORK SERVICES AGREEMENT PAGE TWO (2) 6. The resale of any SUNCOM service to a non-qualified subscriber, where qualified subscribers are set forth in Chapter 282, F.S., is expressly prohibited. SUNCOM Special Services (RIDER V). 8/15/97 RIDER I to Exhibit 1 of the SUNCOM NETWORK SERVICE AGREEMENT SUNCOM Lonq Distance Telephone Communication Service shall be provided according to the following terms and conditions: 1) Access to the SUNCOM network shall be provided either by dedicated facilities, by single digit access code or other appropriate method. 2) A PO1 level of service shall be maintained by the SUNCOM backbone network. All access facilities shall be maintained at a P03 level of service. 3) Station Message Detail Recording of all calls shall be captured and used to bill using agencies at the published rates then in effect. 4) Failure to maintain traffic levels consistent with SUNCOM participation criteria shall be grounds for ITP to terminate this agreement. 5) Toll fraud will be reported to Information Technology immediately. 6) Special conditions for City of Winter Springs USING AGENCY (PLEASE TYPE) ~}~ NO. SEE BELOW. 8/15/97 RIDER II to Exhibit 1 of the SUNCOM NETWORK SERVICE AGREEMENT SUNCOM Local Telephone System Services shall be provided according to the following terms and conditions: 1) Local telephone service shall be provided to the User Agency from the ' local service's identified on the CSA. 2) This local service shall be a centrex type system and shall be in accordance with tariffs established by the FPSC, special ITP pricing or other pricing methodology, as appropriate. 3) Consolidated billing shall be rendered to the user agency at the published rates then in effect. 4) A PO1 grade of service will be maintained for access to the Public Switched Network (Local Service), and P03 for access to SUNCOM. 5) Toll fraud will be reported to Information Technology immediately. 6) Special conditions for City of Wint?r Springs USING AGENCY (PLEASE TYPE) (XX) NO . We at Information Technology appreciate your interest in SUNCOM Network Services, and trust we can meet your telecommunications needs. A three-digit agency ID code, RK3, has been established for your organization for use with any future requests. This code is also noted on your SUNCOM Network Services Agreement. This code must be entered in block (1), Authorization Number, on all Communications Service Authorization (CSA) forms, and these forms must be used to order service. All CSA forms must be processed through this Division before being directed to the Telephone Company for service. There is one notable exception involving SUNCOM voice service. After the initial CSA requesting ESSX, CENTREX, or CENTRANET service has been processed through this office, agencies can forward all subsequent requests directly to the telephone company, provided the quantity of lines does not exceed 25. questions.
