Dear Mr. Rozansky:
The project performance proposal for your project has been reviewed for
completeness and sufficiency. This letter provides you with notification of
the approval of this document in accordance with 40 CFR 35.2050, which has
been adopted by reference for state Step 2+3 projects in Section 17-50.015
of the Florida Administrative Code. The effective date of the approval is
August 8, 1986.
Approval of this document does not signify grant eligibility for all items
shown to be required for the project, nor does it constitute a commitment
for the award of any additional grant funds. In addition, approval of this
document does not authorize you to advertise the project for bids.
One copy of the approved project performance proposal is being returned to
you. This document must be kept in your possession along with other
accepted or approved project documents.

AMENDMENT 3 TO AGREEMENT
DATED
NOVEMBER 27, 1984
CONSULTING ENGINEERING SERVICES
FOR
WASTEWATER TREATMENT PLANT IMPROVEMENTS
BETWEEN
THE CITY OF WINTER SPRINGS
AND
CONKLIN, PORTER & HOLMES - ENGINEERS, INC.
This Amendment dated June 16, 1986 by and between the City of
Winter Springs (hereinafter called the OWNER) and Conklin,
Porter & Holmes-Engineers, Inc. (hereinafter called the
Engineer), is mutually agreed upon and declared an authorized
Amendment to an Agreement dated November 27, 1984, between the
parties, herein setting forth the scope, terms and conditions of
the work herein authorized. The appropriate provisions of the
November 27, 1984 Agreement apply as fully as if written fully
herein.

1.4.1 Prepare an Operation and Maintenance Manual and a Final
Plan of Operation for the Wastewater Treatment Sludge Handling
Facilities in accordance with applicable regulations of the
Florida Department of Environmental Regulation and in accordance
with good engineering practice. The schedule for completion and
submission of the Operation and Maintenance Manual and the Plan
of Operation will be in accordance with applicable grant
conditions and FDER regulations.
1.5 Start.Up Phase Services
The start.up phase services will commence with the
issuance of the .Substantial Completion Certificate" to the
gene ra 1 contractor a nd will termi na te one (1) yea r therea fte r.
During the start.up phase, the ENGINEER will:
1.5.1 Pre and post start.up personnel training ... i.e.,
on.site training given plant operation and maintenance personnel
on the operation and control of the specific treatment processes
of the facilities as well as specialized training required for
the operation and maintenance of plant equipment. Prepare
curricula and training materials for plant personnel.
1.5.2 Fine tuning to optimize process control... i.e.,
expert operational assistance for adjustment and "fine tuning"
of the treatment processes and related equipment functions to
optimize performance, safety and reliability under actual
operating conditions. To include the detailing of operational
procedures consistent, reliable, and efficient performance from
each process component at al' times. Also including briefing
officials and plant personnel on the project performance program
and overall project operation.
1.5.3 Laboratory procedures ... i.e., on-site training and
instruction to assure that the sampling and laboratory testing
program needed for satisfactory process control and regulatory
monitoring and reporting are fully understood.
, .5.4 Maintenance management system ... i.e., start-up
services to assure effective implementation of the maintenance
management system outlined in the facility's 0 & M Manual.
Included is training of the operation and maintenance staff in
the details of the maintenance program.
1.5.5 Records management systems ... i.e., services to
provide the training needed to implement a records management
system as outlined in the 0 & M Manual and setting up and
tracking warranty files.

1.5.6 Revise 0 & M Manual... 1.e.. revising the 0 & M Manual
based upon actual operating experience obtained during the
start-up period and distribution to reviewing agency.
1.5.7 Documentation ... i.e., documentation of the
performance of the project and advisement of the grantee of
performance. Includes advisement on capability and performance
of staff to effectively and efficiently operate and maintain the
facility under normal, alternate and emergency modes of
operation; the capability and performance of the organization to
effectively accomplish administrative, management, and financial
utility functions; and actual costs in relation to prior
estimates of costs, the adequacy of revenue sources and actual
charges necessary to meet revenue requirements.
1.6 Project" Performance Certification
Under this phase of the work, the ENGINEER will:
1.6.1 Certify in writing to the OWNER and FDER, one year
after project completion, that based upon the data available,
the project meets the performance and operational requirements
applicable to the project and the requirements and
specifications to which the project was planned, designed and
built to meet.
1 .7 Constructi on Qual i ty Contr'ol Testi ng
Under this phase of the work, the ENGINEER will:
1.7.1 Employ under subcontract a qualified soils engineering
and testing firm to perform independent laboratory testing and
related services to the extent specified in the construction
Contract Documents, specifically the erovisions within Section
01000 of the specifications entitled 'Quality Control". The
ENGINEER will submit the qualifications of the proposed soils
engineering and testing firm for City approval. The ENGINEER
will .provide the necessary coordination and general scheduling
of the work. The intent of the laboratory testing is to provide
protection for the OWNER against defects and deficiencies in the
work, but the furnishing of such testing shall not make the
ENGINEER responsible for the Contractor1s failure to perform the
construction work in accordance with the Contract Documents nor
for testing or not testing various elements of the work. The
ENGINEER will not be responsible for errors or omissions in the
work of the testing firm provided under subcontract, but the
ENGINEER will require said subcontractor to carry professional
liability insurance protecting the OWNER and the ENGINEER.
