EMPLOYMENT SOFTWARE AGREEMENT
The undersigned, J"~ PAJ' u.'^. , an employee of the City of Winter Springs, Florida,
hereby executes this Employee Software Agreement, and acknowledges the conditions and
covenants contained herein:
WITNESSETH
WHEREAS, the City of Winter Springs, a Florida Municipal Corporation within the State
of Florida and party to an End-User License Agreement regulating the use of a commercial
computer word processing software and program; and
WHEREAS, the undersigned is an employee of the City of Winter Springs, and as defined
within the End-User License Agreement is the primary user of a City computer, operating said
licensed software; and
WHEREAS, the City of Winter Springs desires to provide convenience and flexibility to
its employees providing the opportunity to secure a copy of the licensed word processing software,
to be used in accordance with the End-User License Agreement, for the employees' exclusive use
and benefit while employed with the City of Winter Springs; and
NOW, THEREFORE, in consideration of the City of Winter Springs (hereinafter "City")
granting, ~II\ f:&...lln ~ . · A V ' (hereinafter "Employee") the right to use the licensed software
for the Employee's exclusive use and benefit and of the Employee's continued employment with
the City, the Employee agrees as follows:
1. The Employee shall obtain from the Information Services Department a copy of the
licensed word processing software which is operating upon the Employee's .assigned computer.
2. The Employee agrees and covenants that this software will only be used for the
Employee's exclusive use and benefit in the furtherance of the Employee's services to the City.
3. The Employee agrees and covenants to use the licensed software as provided within

the End-User License Agreement, and as directed by the Information Services Department. A
copy of the End-User Agreement is attached hereto as Exhibit" A" and fully incorporated herein
by this reference.
4. The employee agrees and covenants that the software shall not be used by any person
who is not in the employ of the City of Winter Springs.
5. The Employee agrees and covenants that the licensed software shall not be copied
further, distributed, or misused.
6. The Employee agrees and covenants to delete the licensed software from the
Employee's computer, and return the copy prepared by the Information Services Department at
any time requested by the City, or at the termination of the Employee's services with the City.
7. The Employee agrees and covenants to indemnify and hold harmless the City, its
officials, managers and attorneys from any claim of damages arising out of the misuse of the
licensed software, as contemplated by this Agreement and the End-User License Agreement.
8. The Employee acknowledges that any work performed upon their personal computer
relating to City business is subject to the public record laws under Chapter 119 of the Florida
Statutes. Employee agrees to abide by Chapter 119, Florida Statutes. Upon request by the City
Manager, Employee agrees to provide the City access to any and all computer files related to City
business.
