HomeMy WebLinkAbout1997 06 09 Consent Item D COMMISSION AGENDA ITEM D REGULAR CONSENT X INFORMATIONAL June 9. 1997 Meeting MGR pCWf!/DEPT /,Lt- Authorization REQUEST: Public Works Department Requesting Authorization to Enter into a Contractual Agreement for Drainage, Roadway and Water Main Improvements on Moss Road, Hayes Road and Panama Roads PURPOSE: The purpose of this Board item is to request authorization to enter into a contractual agreement with BE;!rg~ron Land Development, Inc. for drainage, roadway and water main improvements on Moss Road, Hayes Road and Panama Roads at a cost of $449,000.00 plus a 10% contingency. CONSIDERA TIONS: This project is needed to improve Moss Road (Bahama to Panama), Hayes Road (Sailfish to Bahama), and Panama Road (Edgemon to Moss) to collector road standards as planned for in the Traffic Circulation Element of the Comprehensive Plan. Bids for this project were opened on May 14, 1997 under Bid # 97-017. The low bidder was Bergeron Land Development, Inc. of Kissimmee, Florida, with a bid $449,000.00. The project scope of work includes drainage, paving and shell rock recreation trails along these roads consistent with the rural collector road standards adopted in 1996. A water main is also being installed on Moss/Panama Road to connect the existing stubs on those roads. FUNDING: The bid of $449,000 was below the amount budgeted for this project in the Transportation Impact Fee Fund Capital Improvement line code (5410-56310). Transportation Impact Fee Fund Utility Fund TOTAL the water main improvements, $45,124, must be paid from the Utility Fund Capital Improvements line code (3600-56310) which is slightly over the $40,000 budgeted for the water main. Sufficient funds exist in the Bond Anticipation Note for the $45,124 project cost. Funds would be expended over the next 180 days. BUDGET $840,000 $40.000 $880,000 .lllD $403,876 $45.124 $449,000 RECOMMENDATION: It is recommended that authorization be granted to enter into a contractual agreement with B.ergeron Land Development, Inc. for drainage, roadway and water main improvements on Moss Road, Hayes Road and Panama Roads at a cost of $449,000.00 plus a 10 % contingency of which $403,876 and $45,124 are payable from the capital improvements line codes of the Transportation Impact Fee Fund (#5410-56310) and Utility Fund (#3600-56310), respectively. IMPLEMENT A TION SCHEDULE: The scope of work will be completed within 180 days of issuance of the Notice To Proceed. Construction is tentatively planned to begin mid-July. A TT ACHMENTS: 1. GENERAL 1.01 THIS AGREEMENT, made this _ day of , 19_, by and between (1) the Citv of Winter Sorinas , hereinafter called the Owner, and (2) Beraeron land Develooment. Inc. doing business as a (3) Corooration , and hereinafter called the CONTRACTOR. 1.02 WHEREAS, the Owner and the contractor are desirous of entering into an Agreement for construction of the Hayes, Moss and Panama Road Improvements by CONTRACTOR for OWNER. NOW, THEREFORE, for and in consideration of the mutual promises hereinafter exchanged theJB1Es agree as follows: 1. Contract Documents - The Contract Documents consist of this Agreement; all Technical, General, and Supplementary Conditions and Sections contained in the Project Manual; the Drawings as listed on the Bid Form and Index to Drawings; all Addenda issued prior to and all Change Orders issued after execution of this Agreement. Contract Time - The CONTRACTOR shall begin work within ten (10) days after the issuance of a written Notice to Proceed and shall complete the work within one hundred eighty (180) calendar days from the date of the Notice to Proceed. 4. Liauidated Damaaes - OWNER and CONTRACTOR recognize that time is of the essence of this Agreement and that OWNER will suffer financial loss if the Work is not substantially complete within the time specified in Paragraph 3 above, plus any extensions thereof allowed in accordance with the General Conditions. They also recognize the delays, expense and difficulties Involved in proving in a legal arbitration proceedilJg the actual loss suffered by OWNER if the Work is not substantially complete on time. Accordingly, instead of requiring any such proof, OWNER and CONTRACTOR agree that as liquidated damages for delay (but not as a penalty) CONTRACTOR shall pay OWNER $250.00 for each day that expires after the time specified in Paragraph 3 for final completion until the work is finally complete. 5. Contract Price. lumo Sum Contract - The Owner will pay the Contractor in current funds for the performance of the work, subject to additions and deductions by Change Order, the Total Contract Price of Four Hundred Fortv-Nine Thousand Four Hundred Fortv Nine Dollars ($449,000.00). Payments will be made to the Contractor based on the Lump Sum Bid amount, the Schedule of Values, and subject to completion of the work, in accordance with the Contract Documents. 6. Pavments - The Owner will make payments as provided in the General Conditions and Supplementary Conditions. 7. Enaineer - The Project has been designed by Conklin, Porter & Holmes-Engineers, Inc., referred to in the documents as the Engineer, whose authority during the progress of construction is defined in the General Conditions and Supplementary Conditions. MediationNenue - The parties agree that should any dispute arise between them regarding the terms or performance of this Agreement, both parties will participate in a mediation. The parties agree to mutually select a mediator and in the event they cannot mutually agree upon a mediator, one will be appointed by the American Arbitration Association. The parties agree to equally share the cost of the mediator. Should the parties fail to resolve their differences through mediation, then any casue of action filed hereunder shall be filed in the Circuit or County Court for Seminole County, Florida. 10. Recently Bergeron Land Development was chosen as a low bidder on another project that we were the engineering consultant on. Therefore, their references were recently checked by our staff and they appear to be in good standing. In summary, we have no objection to the City's award of this project to Bergeron Land Development based on available jnfoITnation and their base bid price of $449,000.00.
